HomeMy WebLinkAboutPC 04-22RESOLUTION PC 04-22 RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF LOS ALTOS HILLS APPROVING A ZONING PERMIT FOR NEW FENCING AT 28001 ELENA ROAD WHEREAS, The Town of Los Altos Hills received an application for a Zoning Permit (ZP21-0047) from Sea Landing LP for new fencing at 28001 Elena Road ("Project"); and WHEREAS, based on the record presented before it, the Project is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303(e) since the project involves new fencing; and WHEREAS, the Project application was processed in accordance with the applicable provisions of the California- Government Code and the Los Altos Hills Municipal Code; and WHEREAS, the Site Development Committee held a duly noticed public hearing on the Project on July 6, 2021 and considered all written documentation and public comments and remanded the project to the Planning Commission; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on August- 5, 2021 and considered all written documentation and public comments and continued the Project to a date uncertain; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on October 7, 2021 and considered all written documentation and public comments and continued the Project to a date uncertain; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on January 13, 2022 and considered all written documentation and public comments and continued the Project to a date uncertain; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on March 3, 2022 and considered all written documentation and public comments. NOW, THEREFORE, the Planning Commission of the Town of Los Altos Hills hereby APPROVES the Zoning Permit (ZP21-0047) subject to the conditions contained in Exhibit "A" and incorporated herein by reference. Any further changes or modifications to the approved plans dated February 8, 2022 shall be first reviewed and approved by the Planning Director, prior to commencement of work. 2. All wire fencing with metal posts shall be welded wire with wood posts to match the rural/agricultural character of the property. 3. The fencing along Elena Road shall be set back a minimum of 45 feet from the centerline of the road right-of-way. 4. All location, height and materials of the fence shall be constructed according to the approved plans as modified by conditions of approval. Any changes to the location, height, or construction of any proposed fence shall first be approved by the Planning Department. The new fencing and gates shall not obstruct or encroach within any easements on the property. Specifically, no fencing is allowed within pedestrian/equestrian easements, emergency access easements, driveway or ingress and egress easements, and water district easements, and swales. 6. Any installed nonpermitted fencing, existing barbed wire fencing, and electrified fencing shall be removed prior to installation of new fencing. 7. The fencing and gates shall have no points, spikes, or sharpened edges per LAHMC Section 10-1.507. Replace spikes with a smooth top rail. No new lighting is approved. Any additional outdoor lighting requires approval by the Planning Department prior to installation. 9. The applicant shall be responsible for confirming all property line locations, easements, and private access easements and verifying that the new fencing is located within the property lines and not encroaching into easements. 10. A nonrefundable filing fee and a deposit for services shall accompany each appeal. Please refer to the Conditions of Project Approval set forth herein. If you believe that these Conditions impose any fees, dedications, reservation or other exactions under the California Government Code Section 66000, you are hereby notified that these Conditions constitute written notice of a statement of the amount of such fees, and/or a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90 -day approval period in which you may protest such fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90 -day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Upon completion of the construction, a final inspection shall be required to be set with the Planning and Engineering Departments two weeps prior to final building inspection approval. NOTE: The Zoning Permit is valid for one year from the approval date. All required building permits must be obtained within that year and work on items not requiring a building permit shall be commenced within one year and completed within two years.
