A RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS ORDERING AND CALLING FOR THE HOLDING OF
A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8,
2022, FOR THE ELECTION OF TWO CITY COUNCIL MEMBERS AS REQUIRED BY
THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO
GENERAL LAW CITIES; REQUESTING THE BOARD OF SUPERVISORS OF THE
COUNTY OF SANTA CLARA CONSOLIDATE THE GENERAL MUNICIPAL
ELECTION PURSUANT TO SECTION 10403 OF THE ELECTIONS CODE;
PROVIDING FOR NOTICE OF THE ELECTION; AND ADOPTING UNIFORM
POLICIES PERTAINING TO CANDIDATE STATEMENTS AND FEES
WHEREAS, under the provisions of the laws relating to general law cities in the State of
California, a General Municipal Election shall be held on November 8, 2022, for the election of
municipal officers; and
WHEREAS, the term of two (2) members of the Town of Los Altos Hills ("Town") City Council
are due to expire in November 2022 and the positions must be filled; and
WHEREAS, it is in the best interest of the public that the general municipal election be
consolidated with the statewide general election to be held on the same date and that within the
Town precincts, polling places and election officers of the two (2) elections be the same, and that
the county election department of the County of Santa Clara canvass the returns of the general
municipal election and that the election be held in all respect as if there were only one (1) election;
and
WHEREAS, pursuant to Section 10403 of the California Elections Code, in order to consolidate
a local election with the statewide election, the Town must adopt a resolution requesting that the
Board of Supervisors consolidate the Town General Municipal Election with the statewide
election; and
WHEREAS, the consolidated election will be held and conducted in the manner prescribed in
California Elections Code Section 10418; and
WHEREAS, Elections Code Section 10002 requires the Town to reimburse the County in full for
the services performed upon presentation of a bill to the Town by the County Elections Official;
and
WHEREAS, Section 12109 of the California Elections Code provides that the elections official
conducting the election shall give notice of the designation of a central counting place for the voted
ballots of the Town General Municipal Election.
NOW, THEREFORE, THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS
DOES HEREBY RESOLVE AS FOLLOWS:

1. That the foregoing recitals are true and correct and are hereby adopted.
2. That pursuant to the requirements of the Elections Code of the State of California relating
to General Law Cities, there is called and ordered to be held in the Town of Los Altos Hills,
California on Tuesday, November 8, 2022, a General Municipal Election for the purpose
of electing two (2) Members of the City Council, each for a full term of four (4) years.
Pursuant to Sections 10400, 10402, and 10403 of the California Elections Code, it is in the
best interest of the public to consolidate the Los Altos Hills General Municipal Election
with the Statewide General Election to be held on November 8, 2022. The consolidated
election will be held and conducted in accordance with the provisions of law regulating the
statewide election.
NOW THEREFORE, IT IS FURTHER RESOLVED:
1. That pursuant to the requirements of Section 10403 of the Elections Code, the Board of
Supervisors of the County of Santa Clara ("Board of Supervisors") is hereby requested to
consent and agree to the consolidation with the Town of Los Altos Hills of a General
Municipal Election with the Statewide Election on November 8, 2022, for two (2) Los
Altos Hills City Council seats for a full term of four (4) years, and to take any and all
steps necessary for the holding of the consolidated election.
2. That the Board of Supervisors is requested to make available the services of the Registrar
of Voters of the County of Santa Clara ("Registrar of Voters") for the purpose of providing
the usual services necessary in conducting said election, including, but not limited to, the
provision of election supplies, voter pamphlets, ballots, notices, printed materials and all
supplies, equipment and paraphernalia that may be necessary in order to properly and
lawfully conduct the election.
3. That the Registrar of Voters is authorized to specify the location for the tally of ballots,
canvass the results of the two City Council seats and certify the results to the City Clerk of
the Town of Los Altos Hills. The election shall be held in all respects as if there were only
one (1) election, and only one (1) form of ballot shall be used.
4. That the City Cleric shall file a certified copy of this Resolution with both the Santa Clara
County Board of Supervisors and the Santa Clara County Registrar of Voters.
5. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it
into the book of original resolutions.
6. That the Town of Los Altos Hills recognizes that costs will be incurred by the County by
reason of this consolidation and agrees to reimburse the County for such costs, and that the
City Manager is authorized and directed to compensate Santa Clara County for the cost of
conducting the General Municipal Election for the Town.

7. That the City Cleric is hereby authorized and directed to publish a Notice of General
Municipal Election within the time and manner specified in Section 12101 of the California
Elections Code.
8. That in all particulars not recited in this Resolution, the election shall be held and conducted
as provided by law for holding municipal elections.
9. Pursuant to Sections 10228 and 13307 of the California Elections Code, the City Council
approves and adopts the following uniform policies and procedures concerning the General
Municipal Election to be held on November 8, 2022:
a) Each candidate for elective office to be voted for at an election to be held in the
Town of Los Altos Hills on November 8, 2022 may prepare a candidate statement
on an appropriate form provided by the City Cleric. The statement may include the
name, age and occupation of the candidate and brief description of no more than
200 words of the candidate's education and qualifications expressed by the
candidate himself or herself.
b) The statement shall not include party affiliation of the candidate, nor membership
or activity in partisan political organizations.
C) The statement shall be filed in typewritten form in the office of the City Cleric at
the time the candidate's nomination papers are filed. The statement may be
withdrawn, but not changed, during the period of filing nomination papers and until
5:00 p.m. on the next working day after the close of the nomination period.
d) Candidates shall be exempt from charges for the cost of translations mandated by
the Federal Voting Rights Act and the preparation and mailing of said Candidate's
Statements.
C) Candidates shall be exempt from payment of any filing fee.
f) That in the event of a tie vote (if any two or more persons receive an equal and the
highest number of votes for an office) as certified by the Santa Clara County
Registrar of Voters office, the City Council, in accordance with Elections Code
Section 15651(a), shall set a date and time and place and summon the candidates
who have received the tie votes to appear and will determine the tie by lot.
g) Pursuant to the Federal Voting Rights Act, candidates' statements will be translated
into all languages required by the County of Santa Clara. The County is required
to translate candidate statements into the following languages: English, Chinese,
Spanish, Tagalog, and Vietnamese.
The above and foregoing resolution was passed and adopted by the City Council of the Town of
Los Altos Hills at a special meeting held on the 25th day of May 2022 by the following vote:
