HomeMy WebLinkAboutCounty of Santa Clara HHW (6)The Agreement for Countywide Household Hazardous Waste Collection Program (AGREEMENT) by and between the Town of Los Altos Hills (CITY) and the County of Santa Clara (COUNTY) previously entered into on July 1, 2012, is hereby amended as set forth below. The COUNTY and the CITY agree that: 1. Section 13. ADDITIONAL SERVICES UNDER THIS AGREEMENT is amended in full to read: 16. ADDITIONAL SERVICES UNDER THIS AGREEMENT CITY may elect to augment funding provided for in this Agreement with CITY funds. Additional services shall be made available upon written agreement between the CITY's authorized representative and the Director of the Department of Agriculture and Environmental Management. Additional services may include, but are not limited to, additional appointments (charged at the variable cost per car rate), door-to-door HHW collection, universal waste collection, and abandoned waste collection. CITY agrees to augment up to an additional $ 2 1, 0 CSO -0 0 to the Countywide HHW Program during Fiscal Year 2014 for the purpose of increased resident participation above the 4% service level at the scheduled collection dates listed in Attachment C. Augmentation will be calculated at the Variable Cost per Car rate which is $62.00 per car. Other services will be charged based on a cost recovery basis. CITY authorizes the COUNTY to use CITY'S Available Discretionary Funding portion of the AS939 HHW Fee, if available, to pay for the above agreed additional augmentation amount. At the end of each fiscal year, a final annual cost statement shall be prepared by COUNTY and issued to CITY by November 30th. The annual cost statement will take into consideration costs incurred on behalf of CITY for additional services and all payments made by CITY to COUNTY. If any balance is owed to COUNTY, it will be due within 30 days following receipt of the annual cost statement. If any credit is owed to CITY, COUNTY will refund that amount to CITY within 30 days following delivery of the annual cost statement. 2. Attachment C to the AGREEMENT is replaced in full by the Exhibit C "HHW Schedule For Collection Events for Fiscal Year 2013/2014" attached hereto and incorporated herein by this reference. Except as provided herein, all terms and conditions of the AGREEMENT shall remain in full force and effect. On July 1, 2012 the County and cities entered into a three year agreement to provide household hazardous waste collection services. Before we begin the second year, we must amend the Agreement with a new operating schedule and city budget augmentation amounts for service levels above what's funded through the AB 939 Implementation Fee, our primary funding mechanism. I have enclosed two original Amendments, including the FY 2013/14 Operating Schedule and a projection of revenue for each city with a recommended city augmentation amount. PLEASE MAKE CERTAIN THAT YOU FILL IN YOUR AUGMENTATION AMOUNT ON THE FIRST LINE OF THE SECOND PARAGRAPH OF SECTION 18.
