FISCAL IMPLICATIONS The Santa Clara County Office of the Sheriff will realize an estimated $7,537,609 in FY1997-98 revenue reimbursement for law enforcement services to the contract cities. In subsequent fiscal years the contract allows increases based on the urban wage earners consumer price index plus 2%. If costs exceed this amount annually the agreement contains a reopener clause. This language represents a method of obtaining full cost recovery for the law enforcement services provided by the Office of the Sheriff to the contract cities. Board Of Supervisors: Donald F. Joseph Simitian County Executive: Richard Wittenberg 2006 Page t June 10, 1997 LAW ENFORCEMENT CONTRACT - CONTRACT CITIES BACKGROUND AND REASONS FOR RECOMMENDATION The proposed contract for law enforcement services represents a five year agreement for police protection through the Office of the Sheriff within the city limits of Cupertino, Saratoga and Los Altos Hills. This agreement replaces the five year contract scheduled to conclude on June 30, 1997. In its negotiations for the replacement contract, the Office of the County Executive, and the Office of the Sheriff, worked with County GSA Communications to incorporate the concepts of "one contract service price" and "full cost recovery" in any contract language presented to the contract cities. Both concepts have been successfully included in this agreement. Contract language allows for one price to be estimated for police protection. This one price contains all necessary support costs, including emergency communication. This amount is shown on Exhibit A page A-4 as $7,537,609 in projected costs for FY 1997-1998. The agreement also replaces the "cap on costs" language with "full cost recivery" wording which allows annual adjustments to the cost of providing service. This is accomplished by referencing the March to March Consumer Price Index for San Francisco, Oakland, San Jose - for the Urban Wage Earners. The language acknowledges the County need to obtain full cost recovery as appropriate. CONSEQUENCES OF NEGATIVE ACTION The law enforcement contract would not be approved and payment for police protection services would terminate on June 30, 1997.
