1. ROLL CALL AND PLEDGE OF ALLEGIANCE
Present: Commissioner Abraham, Commissioner Couperus, Commissioner Mandle, Chair

3. PUBLIC HEARINGS
3.1 LANDS OF HAHN & TRANG; 24597 Voorhees Drive, File #31-13-ZP-SD-GD.
A request for a Grading Policy exception for portions of a second story supported
deck that projects up to 14' from the building where 6' is the maximum allowed.
CEQA review: exempt per 15303 (a) (Staff-Nicole Horvitz).
Assistant Planner Nicole Horvitz presented the staff report.
Chair Partridge opened the PUBLIC HEARING.
Applicant Doug Hahn spoke on behalf of his project.
The Commission asked questions of the applicant.
Bill Silver, Los Altos Hills, spoke in opposition of the project.
Helena Liu, Los Altos Hills, spoke in opposition of the project.
Contractor Abbie Bourgan, GreenTek Construction, spoke on behalf of the
project.
The Commission asked questions of the contractor.
Chair Partridge closed the PUBLIC HEARING.

Commission discussion ensued.
MOTION SECONDED AND CARRIED: Moved by Commissioner Abraham,
seconded by Commissioner Couperus and passed unanimously to deny a request
for a Grading Policy exception for portions of a second story supported deck that
projects up to 14' from the building where 6' is the maximum allowed.

3.2 LANDS OF TAVASSOLI & EMAMI; 13761 La Paloma Road, File #278-12-ZP-
SD-GD. A request for a Site Development permit for a new 5,999 square foot two
story residence with an attached secondary dwelling unit, and a setback exception
for eave encroachment. CEQA review: exempt per 15303 (a) (Staff-Nicole
Horvitz).
Assistant Planner Nicole Horvitz presented the staff report.
The Commission asked questions of staff.
Chair Partridge opened the PUBLIC HEARING.
Architect Robert Symons answered questions from the Commission.
Yu Ling Wang, Los Altos Hills, spoke in opposition to the project. She stated she
was told she could not build a two story house on this street and that it is not fair for
the applicant to be able to. She presented the Commissioners with a picture of the
applicant’s story poles as seen from her backyard.
Lisa Mooring, Los Altos Hills, spoke in opposition of the project. In the 1990’s
she was told she could not build a two story house.
Dave Mooring, Los Altos Hills, spoke in opposition of the project.
Applicant Abbas Emami gave a closing statement.
Applicant Malahat Tavassoli also gave a closing statement.

Chair Partridge closed PUBLIC HEARING.
Commission discussion ensued.
MOTION SECONDED AND CARRIED: Moved by Commissioner Mandle,
seconded by Commissioner Couperus and passed unanimously to approve a
request for a Site Development permit for a new 5,999 square foot two story
residence with an attached secondary dwelling unit, and a setback exception for
eave encroachment, with the added conditions that no portion of the new residence
shall exceed a height of 23’6” measured as the vertical distance at any point from
(1) the natural grade which existed prior to grading for the proposed structure, (2)
existing grade indicated on approved grading plan, if different from the natural
grade, or (3) the proposed building pad if excavated below natural grade, whichever
elevation is lowest, to the highest part of the roof directly above, and that the
applicant shall test all AC units and noise producing devices and provide a letter
from a qualified acoustical consultant documenting that the AC units comply with
Section 5-2.02 of the LAHMC (noise ordinance). This letter shall note the
methods of testing, the results, and any attenuation measures that were needed to
attain compliance.

4. OLD BUSINESS
4.1 Discussion of Amendments to Setback Ordinance (Section 10-1.505 of the
LAHMC) (Staff- Brian Froelich).
Associate Planner Brian Froelich presented the staff report.
The Commission asked questions of staff.
Commissioner Couperus presented research he had conducted on Setbacks, and
suggestions for changing the ordinance.

Richard Nuzzo, Los Altos Hills, spoke in support of his shed in the setback, but
will tear it down if he is required to.
Chair Partridge closed the PUBLIC HEARING.
Commission discussion ensued.
Commissioner Abraham thinks that the ordinance should be amended to allow
utility structures. Commissioners Couperus, Mandle, Partridge, and Tankha
recommended no change to the setback ordinance and suggested having staff
generate an educational piece on setbacks for the Town newsletter. The
Commission’s recommendation will be forwarded to the City Council.

6.1 Planning Commission Representative for May 20 - Commissioner Abraham
6.2 Planning Commission Representative for June 20 - Commissioner Tankha
Planning Director Debbie Pedro noted that Commissioner Couperus will attend
the June 20, 2013 Council Meeting, and Commissioner Tankha will attend the
July 15, 2013 meeting.

7. APPROVAL OF MINUTES
7.1 Approval of May 9, 2013 minutes.
Chair Partridge noted an amendment to the minutes.
MOTION SECONDED AND CARRIED: Moved by Commissioner Abraham,
seconded by Commissioner Couperus and passed unanimously to approve the May
9, 2013 minutes with amendments.

(Staff- Nicole Horvitz).
