1. ROLL CALL AND PLEDGE OF ALLEGIANCE
Present: Commissioner Basiji, Commissioner Mandle, Commissioner Partridge,
Commissioner Tankha, Chair Couperus

Chair Couperus noted a re-order to the agenda, moving Items 4.1 and 4.2 to the end of
the agenda.
2. RECOGNITION OF OUTGOING COMMISSIONER JIM ABRAHAM
The Commission thanked Commissioner Abraham for his service and presented him
with a gift. Commissioner Abraham provided closing remarks.
3. SWEARING IN CEREMONY
City Clerk Deborah Padovan administered the Oath of Office to Susan Mandle, Jitze
Couperus, and Jim Basiji.
5. PRESENTATIONS FROM THE FLOOR
There were no presentations from the floor.
6. PUBLIC HEARINGS
Chair Couperus noted that a request had been made by the antenna subcommittee to
postpone Item 6.5 as new information was still coming in from the City Attorney's office.
Commission discussion ensued.
MOTION MADE AND SECONDED: Commissioner Tankha moved to postpone the
consideration of the antenna ordinance amendment to a date uncertain, and to be re-
advertised by the City. The motion was seconded by Commissioner Basiji.

6.1 LANDS OF ADL 5 LLC; 10800 Magdalena Road, File #55-16-ZP-SD-GD; A
request for a Site Development Permit to demolish an existing cottage and
construct a new 5,000 square foot residence (Maximum height 27') with a
relocated driveway and related hardscape improvements. CEQA review:
Categorical Exemption per Section 15303(a) (Staff- S. Padovan).
Ex Parte Disclosures: Commissioners Tankha, Mandle, and Chair Couperus
said they had spoken with the applicant, Navneet Aron. There were no other
disclosures.
Consultant Planner Steve Padovan presented the staff report.
Commission asked questions of staff.
Commissioner Partridge asked Mr. Padovan to explain what the implications are
with this property being a part of the Williamson Act. Mr. Padovan said
that Williamson act properties receive a reduced tax on the agricultural portion of
the lot. The Town’s Williamson Act rules allow for a residence on the property.
Once the home is constructed, the County Tax Assessor allocates one acre of land
to the residence and that area will be assessed at full market value. Therefore, being
that that property is only one acre, there will be no tax benefit on the property or the
residence.
Chair Couperus asked about a letter sent by Jerry Crowley, stating residences
uphill would like an easement for sewer connection. He asked if this was
something that was being considered or was part of the approval. Mr. Padovan
deferred to the applicant.
Commissioner Mandle asked if this property would have gone through the Fast
Track process had it not been for the number of oak trees to be removed. Mr.
Padovan confirmed this was correct.
Chair Couperus opened the PUBLIC HEARING.

Peter Carlino, Lea and Braze, explained the changes made to the grading plan to
reduce the number of trees proposed for removal.
Michael Young, Urban Tree Management, arborist, spoke to the state of the
trees proposed for removal.
Commission asked questions of the applicant.
Commissioner Tankha inquired about a tree near the proposed driveway and how
this tree would be protected as it was not marked for removal. She did not think it
would survive. Mr. Carlino said the driveway had been shifted and will not be as
close to the tree as originally proposed, but there will be concrete poured within the
dripline.
Chair Couperus asked again about Mr. Crowley's letter. Mr. Aron said that he
has spoken with the neighbors about this request, and as each neighbor has a
different outlook on the need for the easement, he will be meeting with each
neighbor individually to find a solution that works best for all involved. Director
Avila said this was not required and could not be conditioned as this was not a
subdivision, but Mr. Aron was welcome to attempt an agreement with his
neighbors.
Ralph Brunner, Los Altos Hills, offered his support of the project.
Chair Couperus closed the PUBLIC HEARING.
Commissioner Partridge said this sounded like a good proposal but expressed
concern about reflectivity, urged the applicant to not plant a lot of grass, and due to
the removal of heritage oak trees, he requested the landscape screening plan be seen
by the Commission.
Commissioner Tankha appreciated that the project met all the requirements except
for the tree removal, she shared Commissioner Partridge's concerns and agreed
the project should come back to them during landscape screening.
Commissioner Mandle agreed with the other Commissioners and thanked the
applicant for bringing the project before the Commission, as oak trees and their
removal are important to the Town.
Commissioner Basiji said that he too agreed with the other Commissioners and
that he appreciated the replacement ratio for the trees that the applicant has
proposed.
Chair Couperus thanked the applicant for revising their plans in an attempt to
be more compliant.

MOTION MADE AND SECONDED: Commissioner Partridge moved to
approve the Site Development Permit subject to the recommended conditions of
approval in Attachment 1, with the added condition that the landscape screening
plan come back to the Planning Commission. The motion was seconded by
Commissioner Mandle.

6.2 LANDS OF EESPRD, LLC; 13638 Old Altos Road, File #136-16-ZP-SD; A
request for a Site Development Permit for a landscape screening and lighting plan
for a previously approved new residence, second unit, pool and tennis court.
CEQA review: Categorical Exemption per Section 15304(b) (Staff- S. Avila).
Ex Parte Disclosures: Commissioner Mandle said that she had spoken with
neighbors John and Cathy Lerch. Chair Couperus said that he had spoken with
neighbor Chris Vargas. There were no other disclosures.
Planning Director Suzanne Avila presented the staff report.
Commission asked questions of staff.
Commissioner Partridge expressed concern that the proposed trees would not be
tall enough to screen the large home, and asked that the landscape screening plan be
elaborated. Commission Mandle noted there are existing trees that will remain
that are not as pronounced on the plan as the new plantings.
Dustin Moore, landscape architect, spoke to Commissioner Partridge's
concerns about plant size.
Gregory Badros, applicant, spoke to the concerns the Commission had about the
lack of screening of the fence from the street, as there is a public utility easement
they were trying to avoid, and addressed the preservation of the remaining oaks on
the property. Director Avila said they could request permission for the Town's
Public Works Department to plant in the easement and screen the fence, but there
was no guarantee this request would be approved.

Chair Couperus expressed concern over the closeness of the tennis court to the
oak, and Mr. Badros ensured the Commission that this oak was important to him
and his neighbors, and they were doing everything in their power to preserve it.
Michael Young, Urban Tree Management, spoke to the status of the oak near the
tennis court, how they were caring for it, and its relation to the screening plan.
Pat Ley, Co-Chair Environmental Design and Protection Committee, said that
she had not seen this application prior to this meeting, but agreed that all the
proposed plants are native and protecting the trees was important.
Chris Vargas, Los Altos Hills, stated his support of the fence screening, and
requested that any flood lights not be triggered by a passerby on the path.
A resident expressed concern that the trees would lose their leaves in the winter and
suggested toyons for near the oak.
Cathy Lerch, Los Altos Hills, stated her support of the project, and shared her
sentiments and concerns about the oak tree previously discussed, and requested that
the tennis court be screened.
Ken Li, Los Altos Hills, expressed concern with the bulk of the home, and that he
hoped they could find a scenario that would make it more natural looking,
and keeping with the feel of Los Altos Hills.
Mr. Badros responded to comments made by the public and answered questions
further posed by the Commission.
Chair Couperus closed the PUBLIC HEARING.
Commissioner Mandle complimented the applicant for their selection of plants,
but requested they relocate the plantings to the tennis court side of the oak, and
requested taller trees along the Old Altos side of the property. The fence should be
screened but she will leave the specifics to the applicant and City Engineer. She
requested the lighting be addressed in the conditions of approval.
Commissioner Tankha expressed concern with the Old Altos side of the property,
and while there is tall foliage, it is important visually for the screening to be
continuous. She said the coffee berry may not be sufficient.
Commissioner Partridge acknowledged that while it may not be the best solution
for the applicant, the plants that need water should be moved to the same side as the
tennis court, as it will have a better outcome in the long term. He expressed
concern with the height of the plants, and that the Old Altos side should have tall,
evergreen, and dense foliage.

Chair Couperus said that he agreed with his fellow Commissioners, and shared his
own experiences with an oak tree dying on his property.
MOTION MADE AND SECONDED: Commissioner Mandle moved to continue
the landscape screening plan with the instructions that the applicant come back with
the planting under the oak tree moved to the tennis court, with additional screening
vegetation planted near the garage that is evergreen, tall enough to screen windows,
and dense enough to screen the building, and that the proposed perimeter fence be
screened. The motion was seconded by Commissioner Tankha.

Commissioner Partridge inquired about the Town's lighting policy. Director
Avila said that additional lighting could be approved per the Municipal Code for
safety as needed.
Gregory Badros, applicant, spoke to his application and the concerns raised by the
Commission.
Dustin Moore, Landscape Architect, also spoke to the concerns raised by the
Commission.
Chair Couperus opened the PUBLIC HEARING.

Commissioner Mandle said her only issue with this application were the lights in
the setback, but would be agreeable to allowing two. If a fence is proposed it would
need to be screened.
Commissioner Tankha agreed with Commissioner Mandle's lighting
suggestions.
Commissioner Basiji agreed with his fellow Commissioners that any new fencing
should be screened and that exterior lighting should be minimized.
MOTION MADE AND SECONDED: Commissioner Mandle moved to approve
the requested Site Development Permit for a landscape screening plan, subject to
the conditions of approval in Attachment 1, with the added condition there are a
maximum of two lights in the setback and that any approved fence will be screened.
The motion was seconded by Commissioner Partridge.

6.4 LANDS OF ZEISLER AND BAILEY; 25975 Alicante Lane, File #94-16-ZP-SD-
GD and 221-16-MISC; Appeal of the Planning Director's decision (Fast Track
hearing) approving a Site Development Permit for a new 5,975 square foot two-
story residence including a second unit and garage space (maximum height 26'6"),
a 2,815 square foot basement, 480 square foot detached pool house and a
swimming pool. A CEQA review: Categorical Exemption per Section 15303(a)
and (e) (Staff-S. Avila).
Ex Parte Disclosures: Commissioner Mandle said that she had spoken with
appellant Jo Crosby. There were no other disclosures.
Planning Director Suzanne Avila presented the staff report.

Appellant Jo K. Crosby spoke as to why she appealed the project.

Commission asked questions of the appellant.
John Zeisler, applicant of proposed house, addressed the Commission and the
comments made by Ms. Crosby.
Eric Petersen, Architect, Pacific Peninsula Group, spoke to the house design.
Commissioner Partridge noted that it looked as if the driveway was being pushed
into the Crosby's property and could be brought in closer to the Zeisler/Bailey
residence. Director Avila said that the driveway had the minimum required back
up from the garages.
Ms. Crosby responded to comments made by Mr. Zeisler and Mr. Peterson.
Commission discussion ensued.
Commissioner Partridge said these difficult cases come when the communication
between neighbors has not been at its best. With some effort, a new solution could
be created, but he did not feel this was best layout for the proposed new residence.
Commissioner Tankha said that it is the hope that neighbors are able to find
solutions together, but that opportunity did not lend itself to this situation. Privacy
and space are important, and while a homeowner deserves the right to build a house
to the maximum, ideally it is not to the cost of a neighbor.
Commissioner Mandle said that she sympathizes with the appellant for not
understanding the site development process, and to the neighbor who has followed
all the rules and should be able to build their home the way they want it. The
neighbor dynamic is an important part of the approval process in Town. She said
she did not have a solution, but would like the neighbors to be able to work
something out.
Commissioner Basiji said that he had a similar situation on his property. He was
able to find relief in noise and light mitigation through hedging. He stated that he
saw two options to resolve the situation; either a redesign of the house, which he
felt was a little late to propose, or try using a method such as hedging.
Chair Couperus said the Commission was supposed to mitigate problems,
proposing taking a few inches here and there, or flipping the house design, but they
cannot do that here. He said he could not find enough cause to request the applicant
redesign the house.
Commissioner Partridge asked Commissioner Basiji to elaborate on the hedge
solution he used on his property. Would the redwood trees on the property kill the
plants? Commissioner Basiji said they tried different plants and some made it and
some did not. Eventually, they were able to fully mitigate the sight of the cars and

the headlights coming through from the neighbors. He said he was not bothered by
the noise as one might think, and he felt the situation would be the same in this
instance.
Commissioner Tankha agreed screening would handle the light and visual impact,
but the noise would be an issue. How wide would a hedge need to be to have a
mitigating affect? Could they ask the applicant to reduce the structure by five (5)
feet on the side of the house facing the Crosbys? Commissioner Basiji did not
think this would be necessary as the driveway didn't reach all the way to the
property line and would not have to be brought in to plant a hedge. Mr. Zeisler said
there is approximately five or six feet of shrubs surround the entire property, and
using that footprint, they could easily add thicker, faster growing hedges.
Commissioner Tankha suggested the applicant return to the Commission with the
landscape screening plan.
MOTION MADE AND SECONDED: Commission Mandle moved to uphold the
Fast Track approval of the Site Development Permit for the new residence with a
basement, second unit, pool house and pool subject to the conditions in Attachment
1, with added condition that the landscape screening plan return to the Planning
Commission. The motion was seconded by Chair Couperus.

REVIEW: CATEGORICAL EXEMPTION PER SECTION 15061(B)(3) (Staff- S.

Duncan MacMillan, Los Altos Hills, said that ham radio operators need to be
good neighbors, and if he could not find a way to make a decent antenna then he
would not do it because it is a hobby.
Adler Yu, Los Altos Hills, stated his opposition to the update.
Anna, Los Altos Hills, stated her opposition to a flat fee for ham radio antenna
permits, as every situation is not the same and the Town should not have to "eat"
the costs should issues and legal fees come into play.
Scott Overstreet, Los Altos Hills, in favor of ensuring the new document is in
compliance with federal and state laws.
Dru Anderson, Los Altos Hills, agreed there are some inconsistencies in the
ordinance, and supported the opportunity to "get things in the right spot" and clean
up the ordinance.
Gary Waldeck, Los Altos Hills, assisting the subcommittee, the proposed
ordinance is virtually the same as the current ordinance, sans the antenna height
language.
Chair Couperus closed the PUBLIC HEARING.
Commission discussion ensued.
Commissioner Partridge said that the current ordinance appeared to be working,
and while he was not opposed to some clarification, he did not seeing a strong need
to update the ordinance.
Commissioner Tankha said the subcommittee wanted feedback from the
Commission on having guy wires in the setback, and retractable and fully extended
antennas.
Commissioner Mandle said that she had started out as a supporter of modifications
to clarify and make the process easier for antenna users, but the fear growing in the
community is that the Commission will allow a change in the ordinance that will
allow someone to obstruct a neighbor's view, and the only way to override this fear
is to not change the approval process. She would be willing to put a cap on the
fees, but the Town should leave the ordinance as it is.
Commissioner Basiji asked if there were state and federal compliance
issues? Were there aesthetic issues? He said that he did not want to do anything
that would jeopardize the Town’s emergency services programs, but were they
creating an issue where there is no issue?
Chair Couperus said he did not have an issue with guy wires as long as they were
on the user’s own property. As far as retractable antennas are concerned, he said

that if it fully extends to 65 feet then it should be considered a 65 foot antenna. He
then expressed concern that this ordinance would limit the use of TV antennas for
the residents who still use them in Town.
MOTION MADE AND SECONDED: Commissioner Partridge moved to table
consideration of the ordinance amendment regarding amateur radio antennas and
recommend to the City Council that they impose a cap on the fees required for
permitting an amateur radio antenna. The motion was seconded by Commissioner
Mandle.
