ROLL CALL AND PLEDGE OF ALLEGIANCE Via teleconference according to the Governor’s Executive Order N-29-20, Chair Patel called the Planning Commission meeting to order at 6:00 p.m. Present: Commissioner Smith, Commissioner Couperus, Commissioner Waschura, Vice- Chair Indaco, Chair Patel, Staff: Planning Director Dahl, Principal Planner Padovan, Management Analyst Einfalt, Planning Technician Brunner 2. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Commission on any subject not on the agenda are invited to do so now. Please note, however, that the Commission is not able to undertake extended discussion or take action tonight on non-agendized items. Such items will be referred to staff or placed on the agenda for a future meeting. Clark Patteson, representing St. Luke’s Chapel at 26140 Duval Way, inquired about work occurring at a T-Mobile wireless facility near their property. Chair Patel closed presentations from the floor. 3. APPROVAL OF MINUTES 3.1 Approval of October 1, 2020 Regular Meeting Minutes MOTION MADE AND SECONDED: Commissioner Smith moved to approve the October 1, 2020 Regular Meeting Minutes as presented. The motion was seconded by Commissioner Couperus. AYES: Commissioner Couperus, Commissioner Smith, Commissioner Waschura, Vice-Chair Indaco, Chair Patel NOES: None ABSENT: None ABSTAIN: None MOTION: Carried 5-0 Approved December 10, 2020 2 Planning Commission Regular Meeting November 5, 2020 Minutes 4. PUBLIC HEARINGS Planning Commission Ex Parte Commissioners Couperus, Smith, and Waschura, and Chair Patel did not have any ex parte communications. Vice-Chair Indaco had communications with Vijay Chawla and Carol Gottlieb of the Environmental Design & Protection Committee (EDPC) about item 4.1. 4.1 14554 De Bell Road – File #CDP20-0002 and VAR20-0006 – Lands of Setlur Request for a Conditional Development Permit for an 898 square-foot addition to the rear of an existing 2,946 square-foot, one-story single-family dwelling with nonconforming 14-foot side yard setbacks where 30 feet is required, and a Variance to allow for the addition to maintain the existing 14-foot side yard setback. CEQA review: Categorical Exemption per Sections 15303(e) and 15305(a) Project Planner: Steve Padovan Chair Patel opened the PUBLIC HEARING. Principal Planner Padovan presented the staff report. The Commissioners asked staff questions regarding the property and presentation details. Mike Amini, applicant, presented the project, noting that the goal was to add on to the house without adding a second story and that he had reached out to the adjacent property owners prior to the meeting but not received any response. Public Comment None. Chair Patel closed the PUBLIC HEARING. Discussion Vice-Chair Indaco expressed concerns about the variance request, noting that there was available space for an addition within the building envelope. Commissioner Waschura expressed general support. Commissioner Smith expressed general support for the project, noting that the design was integrated with the existing house and would be of minimal impact to the neighbors. Commissioner Couperus expressed general support for the project, noting that the addition design blended in with the current neighborhood, even though it was requesting a setback variance. Chair Patel spoke about a different project on Manuella and how it compared to this one. He felt the two projects had very similar issues and was in favor of allowing the variance for this project based on the Planning Commission's decision on the earlier project. Approved December 10, 2020 3 Planning Commission Regular Meeting November 5, 2020 Minutes MOTION MADE AND SECONDED: Motion by Commissioner Waschura to adopt a resolution to approve the Conditional Development Permit and Variance requests, subject to the listed findings and conditions of approval, with an additional condition to require the Landscape Screening plan, if required, to come back to the Planning Commission for review and approval. The motion was seconded by Commissioner Smith. AYES: Commissioner Couperus, Commissioner Smith, Commissioner Waschura, Chair Patel NOES: Vice-Chair Indaco ABSENT: None ABSTAIN: None MOTION: Carried 4-1 5. OLD BUSINESS 5.1 10728 Mora Drive - File #CDP19-0001, SD19-0019 and VAR19-0005 – Lands of Linebarger Adopt a Resolution to Deny the Conditional Development Permit and Site Development Permit for a new 2,483 square-foot, two-story single-family residence with a 1,447 square-foot basement; and Variance requests for a reduced side yard building setback along the south property line and uncovered parking, patios and basement lightwells within the side yard setbacks, pursuant to the action taken by the Planning Commission on October 1, 2020. CEQA review: Categorical Exemption per Section 15303(a) Staff: Steve Padovan Chair Patel opened the PUBLIC HEARING. Principal Planner Padovan presented the resolution with findings to deny the project. Chair Patel noted that there would be a 23-day appeal period. Chair Patel closed the PUBLIC HEARING. MOTION MADE AND SECONDED: Motion by Commissioner Waschura to adopt the resolution to deny the Conditional Development Permit, Site Development Permit and Variance requests for 10728 Mora Drive subject to the listed findings, pursuant to the action taken on October 1, 2020. The motion was seconded by Vice- Chair Indaco. Planning Director Dahl provided a brief summary of the past Site Development / Fast Track Public Hearings. 8. PLANNING DIRECTOR REPORT Planning Director Dahl provided an update on the draft Reginal Housing Needs Allocation (RHNA) methodology that had been published for public review and comment by ABAG’s Housing Methodology Committee.
