HomeMy WebLinkAbout96-23RESOLUTION 96-23 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS APPROVING THE REQUEST TO REMOVE THE FRANCIS AVIDANO HOME FROM APPENDIX 4A OF THE GENERAL PLAN, THE INVENTORY OF HISTORIC SITES AND STRUCTURES WHEREAS, The Town of Los Altos Hills received a request to remove the Francis Avidano Home from the Town's Inventory of Historic Sites and Structures in Appendix 4a of the General Plan; and WHEREAS, 12871 Atherton Court has been determined to be the correct address for the Francis Avidano Home, which has been listed in the Inventory of Historic Sites and Structures since the Inventory's initial inclusion in the Town's General Plan in 1976 due to the fact that the home was constructed in 1910 and maintains a unique hexagonal architectural style; and WHEREAS, the property owner of 12871 Atherton Court has stated that the inclusion of his property in the Inventory of Historic Sites and Structures has adversely affected his ability to sell the property; and WHEREAS, based on the record presented before it, the Project is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Sections 15061(b)(3) because there is no possibility for this Project to result in a significant environmental impact; and WHEREAS, the Project application was processed in accordance with the applicable provisions of the California Government Code and the Los Altos Hills Municipal Code; and WHEREAS, the History Committee and Planning Commission held a duly noticed joint Special Meeting on the project on October 12, 2023, and considered all evidence, testimony, written documentation, and public comments; and WHEREAS, the Planning Commission passed a motion recommending that the City Council approve the request to remove the Francis Avidano Home from the Inventory; and WHEREAS, the History Committee further considered the request at their regular meeting on October 17, 2023, and three members recommended that the City Council deny the request to remove the Francis Avidano House from the Inventory, one member voted against the recommendation, and two abstained; and WHEREAS, the property owner/applicant agreed to provide to the Town the records the -property owner has obtained and possesses regarding the historical features of the current house; and WHEREAS, the City Council authorized a refund of the general plan amendment fee paid by the property owner; and Resolution 96-23 Page 1 WHEREAS, on October 19, 2023, the City Council held a duly noticed public hearing to consider the appeal and considered all evidence, testimony, written documentation, and public comments; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills hereby APPROVES the request to remove the Francis Avidano Home aka 12871 Atherton Court from General Plan Appendix 4a — Inventory of Historic Sites and Structures. The above and foregoing Resolution was passed and adopted by the City Council of the Town of Los Altos Hills at a regular meeting held on this 19t1i day of October 2023 by the following vote: AYES: Swan, Mok, Schmidt, Tankha, Tyson NOES: None ABSTAIN: None ABSENT: None ATTEST: Deborah Padovan, City Clerk By: MY4 Stanley ok, Vice Mayor Resolution 96-23 Page 2
