A RESOLUTION ACCEPTING THE 2023 PAVEMENT REHABLITATION AND
DRAINAGE IMPROVEMENT PROJECT AS COMPLETE, AUTHORIZING FINAL
RETENTION PAYMENT TO THE CONTRACTOR, AND DIRECTING THE CITY
CLERK TO FILE NOTICE OF COMPLETION
WHEREAS, on June 15, 2023, the City Council approved the Plans and Specifications for the
2023 Pavement Rehabilitation and Drainage Improvement Project, authorized staff to readvertise
the project for formal bid, and authorized the City Manager to award a construction agreement for
the project to the lowest responsible bidder in an amount not to exceed $1,390,000, which includes
contingency fund; and
WHEREAS, on August 15, 2023, the City Manager executed a construction agreement with
O'Grady Paving, Inc. for said project with a contract amount of $991,596; and
WHEREAS, the project was substantially completed in conformance with the Plans and
Specifications for said project on November 1, 2023; and
WHEREAS, staff recommends that the City Council accept the Pavement Rehabilitation and
Drainage Improvement Project by O'Grady Paving, Inc. as completed and allow the remittance of
the five percent retention to the contractor 35 days following the project acceptance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills
that:
Section 1. The above-described work as recommended by staff is hereby accepted as
complete, and the appropriate officer of the Town is authorized to make final payment concerning
the above-described work.
Section 2. The City Clerk is hereby authorized and directed to file with the County
Recorder of the County of Santa Clara, notice of the completion of said project within ten (10)
days from the date of this Resolution.
The above and foregoing resolution was passed and adopted by the City Council of the Town of
Los Altos Hills at a special meeting held on the 14th day of December 2023 by the following vote:
AYES: Swan, Mok, Schmidt, Tankha, Tyson
