HomeMy WebLinkAbout25-24RESOLUTION 25-24 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ACCEPTING DEDICATION OF RIGHT-OF-WAY EASEMENT (LANDS OF DCV ENTERPRISE PARTNERS LLC) WHEREAS, DCV Enterprise Partners, LLC ("Owner") owns the property commonly known as 26481 Purissima Road, Los Altos Hills, California (APN 175-47-003); and WHEREAS, site development permit (SD22-0087) for additions to an existing residence was approved at duly noticed Fast Track public hearing of the Site Development Committee on May 11, 2023 with reasonable conditions of approval, including the dedication of additional right-of-way to the Town; and WHEREAS, the Town has adopted a General Plan and, pursuant thereto, may require and accept right-of-way dedications on privately owned lands lying within the Town; and WHEREAS, the Owner has offered to dedicate additional rights-of-way to the Town attached to this Resolution as Attachment A ("Offer of Right -of -Way Easement Dedication") for street right-of-way purposes and incidents thereto; and WHEREAS, the Town finds the Offer of Right -of -Way Easement Dedication to be consistent with the Town's General Plan and in the best interests of the Town; WHEREAS, the Owner and the Town recognize that the land subject to the Offer of Right -of -Way Easement Dedication is adjacent to an existing public right-of-way and is necessary to create a 30 - foot half width for the 60 -foot right-of-way and is an asset to the Town and the Owner; and NOW, THEREFORE, based on the entirety of the record before it, the City Council of the Town of Los Altos Hills hereby finds that the Project qualifies for the common sense exemption outlined in CEQA Guidelines Section 15061(b)(3), and does hereby accepts on behalf of the public, and for the purposes herein described, the Offer of Right -of -Way Easement Dedication attached to this Resolution as Exhibit A. The above and foregoing Resolution passed and adopted by the City Council of the Town of Los Altos Hills at a regular meeting held on the 16th day of May 2024, by the following vote: AYES: Mok, Schmidt, Swan, Tankha, Tyson NOES: None ABSENT: None ABSTAIN: None BY: Stan .
