Recorded at the request of 12: 17 PM City When Recorded, Mail to: City Clerk Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, CA 94022 RESOLUTION NO. 7-98 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS TO VACATE SUMMARILY THE STORM DRAIN EASEMENT ON LANDS OF HUGHES WHEREAS, for the benefit of the general public, a storm drain easement ("Original Easement") was placed on Lot 1 of Tract 6400 ("Property") as shown on that certain parcel map, which was filed forrecord in the Santa Clara County Recorder' s Office on October 3 , 1978, in Book 427 of Maps, Pages 19, 20, 21 and 22 . WHEREAS, HAROLD E. HUGHES, JR. , and NANCY L. HUGHES, the current owners of the Property ("Owners") , have requested that the Original Easement be vacated because it will be superseded by relocation; and WHEREAS, concurrently herewith, the Owners will dedicate to the Town a new storm drain easement over the Property ("New Easement") , which offer will be accepted by the Town at this time; and WHEREAS, the City Council of the Town now desires summarily to vacate the Original Easement . 1 3\lah\res\hugh-sv.res • i • • NOW, THEREFORE, the City Council of the Town does RESOLVE as follows : 1 . The City Council of the Town, pursuant to California Streets and Highways Code, Division 9, Chapter 4, Section 8333 , et seq. , hereby vacates the Original Easement and finds that the Original Easement has been superseded by relocation and no other public facilities are located within the easement . 2 . The Parcel Map showing the location of the Original Easement was filed on October 3, 1978, and is on file in the Santa Clara County Recorder' s Office in Book 427 of Maps at Pages 19, 20, 21 and 22 . A copy of that portion of the Map indicating the Original Easement is attached hereto as Exhibit A. 3 . From and after the date this resolution is recorded in the Santa Clara County Recorder' s Office, the Original Easement shall no longer constitute a public easement . PASSED AND ADOPTED this 4th day of February , 1997.
