RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS
APPROVING A TEMPORARY DRIVEWAY THROUGH AN OPEN SPACE EASEMENT
(LANDS OF IMAM-SATTAR)
WHEREAS, Mubarik Imam and Talha Sattar ("Owner") own the property commonly known as
12815 Deer Creek Lane, Los Altos Hills, California (APN 175-43-054); and
WHEREAS, on August 21, 2019, the City Council of the Town of Los Altos Hills approved a two -
lot subdivision on Deer Creek Lane and accepted an Open Space Easement to preserve the natural
and scenic character of the land;
WHEREAS, the Agreement for Open Space Easement contains the appropriate restrictions and
covenants to preserve the natural and scenic character of the land; and
WHEREAS, on August 27, 2024, the Interim Community Development Director approved File No.
SD24-0015 for a new accessory building/workshop, ADU, swimming pool, and recreation court;
WHEREAS, on the August 26, 2024, the property owner submitted a request to construct a temporary
driveway within the Open Space Easement at the subject property;
WHEREAS, on September 11, 2024, the Open Space Committee of the Town of Los Altos Hills
considered the request and forwarded a recommendation of approval to the City Council, subject to
conditions of approval.
NOW, THEREFORE, BE IT RESOLVED the City Council of the Town of Los Altos Hills does
hereby approve construction of a temporary driveway through an open space easement at 12815 Deer
Creek Lane, subject to the conditions attached to this Resolution as Attachment A.
The above and foregoing Resolution passed and adopted by the City Council of the Town of Los
Altos Hills at a regular meeting held on the 22nd day of October, 2024, by the following vote:

CONDITIONS OF APPROVAL
Mubarik Imam and Talha Sattar —12815 Deer Creek Lane — File# SD21-0048/ER24-0002
GENERAL:
1. No other modifications to the approved plans submitted on August 26, 2024, are allowed except
as otherwise first reviewed and approved by the Community Development Director.
2. All outstanding conditions of File No. SD21-0048 (new residence) and SD24-0015 (swimming
pool, recreation court, workshop, ADU) shall apply.
3. As an ongoing condition of approval, the temporary driveway shall be constructed of on-site
material (earth, dirt). No imported gravel, dirt, or other material is permitted.
4. As an ongoing condition of approval, the temporary driveway shall include a rumble plate /
track out grate at the construction site entrance to reduce debris into the public right-of-way.
5. Prior to grading, construction, or land disturbance, two copies of an Erosion and Sediment
Control Plan shall be submitted for review and approval by the Engineering Department. The
contractor and the property owner shall comply with all appropriate requirements of the Town's
NPDES permit relative to grading and erosion/sediment control.
6. Prior to grading, construction, or land disturbance, two copies of a Construction Best
Management Practices Plan (BMPs) shall be submitted for review and approval by the
Engineering Department.
7. Prior to grading, construction, or land disturbance, the property owner shall apply and obtain
approval for an exception to the Grading Moratorium. The property owner shall coordinate with
Engineering Department staff for submittal requirements including a fee (per Engineering Fee
Schedule in effect at time of review request).
8. Prior to grading, construction, or land disturbance, the property owner shall apply and obtain
an encroachment permit for all work proposed in the public right-of-way. No work within the
public right-of-way shall commence without an encroachment permit.
9. Prior to requesting the final inspection, the property owner shall return the affected open space
easement area to its natural state by removing driveway materials and replanting native
vegetation for Community Development Department staff review and approval.
