HomeMy WebLinkAbout78-24RESOLUTION 78-24 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS APPROVING A TREATED SEWER EFFLUENT TRANSFER AGREEMENT BETWEEN THE TOWN OF LOS ALTOS HILLS AND THE CITY OF PALO ALTO WHEREAS, sewer effluent generated in and from the Town has long been treated at RWQCP owned and operated by the City of Palo Alto pursuant to the terms and conditions of the Sewage Transportation, Treatment, and Disposal Agreement made and entered on March 18, 1968, by and between the City of Palo Alto and the Town, as amended; and WHEREAS, in late 2019, the cities of Palo Alto and Mountain View and the Santa Clara Valley Water District (Valley Water) entered into a long-term agreement that would annually transfer nine (9) million gallons per day of treated sewer effluent to Valley Water for regional recycled water projects as part of an effort to develop locally reliable water supply sources; and WHEREAS, under the Valley Water Agreement, when and if Valley Water exercises its option to receive the treated sewer effluent from RWQCP, it would pay to Palo Alto one million dollars per year (in 2019 dollars, subject to annual adjustment based on CPI) for up to nine (9) MGD of sewer effluent to be divided proportionally among RWQCP Partner Agencies that commit to a long-term transfer of effluent to Valley Water for 13 years; and WHEREAS, one million dollars would be divided proportionally among the RWQCP Partner Agencies based on the percentage share of the sewer effluent provided; and WHEREAS, if the amount of effluent provided to Valley Water falls below 9 MGD in any year, the amount of the effluent purchase payment would be reduced in proportion; and WHEREAS, this sewer effluent transfer agreement with Palo Alto would benefit the Town, Palo Alto, and the County -wide effort to achieve cost effective, environmentally beneficial utilization of treated wastewater and to establish a more resilient water supply, especially during drought conditions; and WHEREAS, the City of Palo Alto would pay or credit the Town for the proportional amount of Town sewer effluent transferred to Valley Water starting Fiscal Year 2025-26 and potentially for prior years of effluent transfer. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills that: 1. The Effluent Transfer Agreement with the City of Palo Alto in form is approved, and the City Manager is authorized to make nonsignificant and minor edits to the agreement for approval by the City of Palo Alto City Council; and 2. The payments or credits related to the agreement are authorized to be received for the Town's Sewer Fund.
