HomeMy WebLinkAbout1/27/2007 • Meeting Minutes January 26, 2007 Town of Los Altos Hills City Council Special Meeting Friday, January 26, 2007 3:30 p.m. Council Chambers, 26379 Fremont Road CALL TO ORDER, ROLL CALL, PLEDGE OF ALLEGIANCE Mayor Warshawsky called the City Council Special Meeting to order at 3:35 p.m. in the Council Chambers at Town Hall. Present: Mayor Dean Warshawsky, Mayor Pro Tem Craig A.T. Jones, Councilmember Breene Kerr, Councilmember Jean Mordo and Councilmember Mike O'Malley Absent: None Staff: City Manager Carl Cahill, Public Works Director/City Engineer Henry Louie and City Clerk Karen Jost • NEW BUSINESS 1. Consideration of a Resolution of the City Council of the Town of Los Altos Hills Approving an Agreement between the City of Los Altos and the Town of Los Altos Hills for Transportation, Treatment and Disposal of Sewage. City Engineer/Public Works Director Henry Louie advised Council that the sewer agreement before them had been approved by the City of Los Altos City Council at their regular meeting of January 9, 2007 and the respective City Attorneys of each jurisdiction had reviewed and approved as to form the agreement. He outlined the highlights and responsibilities of the Town described in the agreement. The proposed sewer capacity would allow a total flow of 339,900 gallons per day from the Town into the sanitary sewer system owned by the City of Los Altos. The Town was obligated to stop issuing sewer connection permits to new users once notified by the City that they were approaching the allotted sewage flow. Louie explained that the partners of the Regional Treatment Plant had tentatively agreed to allocate addition capacity to the Town. The additional capacity would be amended and incorporated into the agreement after the receipt of the allocation confirmation. Louie reviewed the maintenance and liability features of the agreement. Effective July 1, 2007, the Town would assume responsibility for maintenance and operation of the Town's sewer collection system including all mains and two lift stations. The agreement . also called for the Town to fund the cost of design, construction, operation and maintenance of five flow metering stations and a new parallel sewer main at Eastbrook Avenue. The estimated cost for the improvements was approximately$280,000. Staff and the Council subcommittee recommended approval of the agreement. Councilmember O'Malley explained that the agreement allowed for a grace period for the Town to correct any problems if they exceeded the allotted flow. At such time, the Town could purchase additional capacity. He noted the importance of Council moving forward and approving the agreement at the Special Meeting. O'Malley commented that discussions relating to the sewer agreement had been ongoing for the past five years and it was very positive to see the efforts come to fruition. MOTION SECONDED AND CARRIED: Moved by Mordo, seconded by Kerr and passed unanimously to adopt Resolution 2-07 "Approving an Agreement between the City of Los Altos and the Town of Los Altos Hills for Transportation, Treatment and Disposal of Sewage". PRESENTATIONS FROM THE FLOOR None Council adjourned to Closed Session at 3:45 p.m. • CLOSED SESSION City Attorney Steve Mattas participated in the Closed Session via telephone conference. CLOSED SESSION: CONFERENCE WITH LEGAL COUNSEL (Pursuant to Government Code Section 54956.9(a)) Town of Los Altos Hills v. Town of Los Altos Hills et al. Council reconvened to Open Session at 4:15 p.m. Report out of Closed Session: The City Council by unanimous vote approved the settlement agreement in Town of Los Altos Hills v. Los Altos Hills et.al.
