HomeMy WebLinkAbout523 ORDINANCE NO. 5 2 3 ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS AMENDING TITLE II, CHAPTER 6, OF THE LOS ALTOS HILLS MUNICIPAL CODE,INCLUDING SECTIONS 2-6.03, 2-6.10,AND DELETING THE APPENDIX WHEREAS, the Political Reform Act requires every local government agency to review its conflict-of-interest code to determine if it is accurate or, alternatively, that the code must be amended; and, WHEREAS, following review of the code and code appendix, it was determined that the amendments contained in this Ordinance were appropriate. NOW,. THEREFORE, the City Council of the Town of Los Altos Hills does hereby ORDAIN as follows: SECTION I. AMENDMENTS The following sections of Title II, Chapter 6 ("Conflicts of Interest") of the Los Altos Hills Municipal Code shall be amended as indicated (additions in double-underline; deletions in strilethfou-1-): (1) Section 2-6.03 Designated Employees. Persons holding positions listed in the AppendiH, leeated at the end of this 61, haptler-a resolution adopted by the City Council, are designated employees. It has been determined that these persons make or participate in the making of decisions which may foreseeably have a material effect on financial interests. (2) Section 2-6.10 Prohibitions. (a) No designated employee shall accept any honorarium. (b) No designated employee shall accept any gifts with a total value of more than threefour hundred twenty dollars ($3420.00) in a calendar year from any single source. (c) Loans described in Title 2, Division 6 of the California Code of Regulations Section 18730 (8.2-8.4) are prohibited unless otherwise permitted therein. (3) The Appendix to Title II, Chapter 6 of the Los Altos Hills Municipal Code ("Designated Employees and Disclosure Obligations") shall be deleted. SECTION II. SEVERABILITY If any section, subsection, subdivision,paragraph, sentence, clause or phrase of the Ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause phrase of the Ordinance irrespective of the fact that one or more of them would be declared unconstitutional or invalid. To this end, the provisions of the Ordinance are declared to be severable. SECTION III. EFFECTIVE DATE AND PUBLICATION This ordinance shall become effective thirty (30) days from the date of its passage. Within 15 days after its passage, this ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the Los Altos Town Crier, a newspaper of general circulation in the Town of Los Altos Hills, as required by law.
