ORDINANCE NO. 516
AN ORDINANCE AMENDING TITLE 6,CHAPTER 4,SECTIONS
6-4.502 OF THE LOS ALTOS HILLS MUNICIPAL CODE,
EXTENDING THE TERM OF SEWER REIMBURSEMENT
AGREEMENTS
WHEREAS, Los Altos Hills Municipal Code ("LAHMC") Section 6-4.503, subd. (d)
currently limits the term of reimbursement agreements for sewer improvements to fifteen(15)years;
and
WHEREAS,on February 12,2009,the City Council directed staff to amend the term of the
Town's standard sewer reimbursement agreement from fifteen(15)years to twenty-five(25)years to
provide more time for developers and property owners that make sewer improvements to recover
their initial investments.
NOW THEREFORE,the City Council of the Town of Los Altos Hills does hereby ordain as
follows:
Section 1. TITLE 6, CHAPTER 4, SECTION 6-4.503 OF THE LOS ALTOS HILLS
MUNICIPAL CODE IS HEREBY AMENDED TO READ AS FOLLOWS:
Sec. 6-4.503. Reimbursement agreement.
Sec. 6-4.503, subsection(d) is hereby repealed and replaced with the following:
(d)In no event shall a reimbursement agreement extend beyond twenty-five(25)years and in
no event shall the Town be liable to a property owner for the failure to collect reimbursement costs.
Section 2. SEVERABILITY. If any section, subsection, subdivision, paragraph,
sentence,clause or phrase of the Ordinance is for any reason held to be unconstitutional,invalid,or
ineffective by any court of competent jurisdiction, such decision shall not affect the validity or
effectiveness of the remaining portions of this Ordinance or any part hereof. The City Council
hereby declares that it would have passed each section,subsection,subdivision,paragraph,sentence,
clause phrase of the Ordinance irrespective of the fact that one or more of them would be declared
unconstitutional or invalid. To this end,the provisions of the Ordinance are declared to be severable.
Section 3. EFFECTIVE DATE AND PUBLICATION. This ordinance shall become
effective thirty(3 0)days from the date of its passage.Within 15 days after its passage,this ordinance
shall be published once,with the names of those City Councilmembers voting for or against it,in the
Los Altos Town Crier,a newspaper of general circulation in the Town of Los Altos Hills,as required
by law.
