CALL TO ORDER AND ROLL CALL Mayor Dauber called the Special Meeting of the City Council to order at 4:10 p.m. in the Council Chambers at Town Hall. Present: Mayor Dauber and Councilmembers Casey, Finn(arrived at 5:10 p.m.), Johnson and Siegel Absent: None Staff: City Manager William Norton, Assistant City Attorney Dan Siegel, Public Works Manager Jim Rasp and City Clerk Pat Dowd Press: None 2. PUBLIC HEARINGS: DECISIONS ON REPORT OF DELINQUENT • LOS ALTOS GARBAGE COMPANY CHARGES Bill Jones and Kathleen Gonzales were present from the Los Altos Garbage Company to answer any questions. Council agreed to open the public hearing and receive comments and then decide on each delinquent account separately. Section 6-3.17 et seq. of the Los Altos Hills Municipal Code provided that delinquencies in payment for solid waste and recyclable collection could be assigned to the Town through the initiation of a lien and special assessment proceedings. Fred Barez, owner of property at 10300 Magdalena, (service level: 2 cans; amount due $427.50) stated that his renter had moved out without paying. LAGCO agreed that this bill could be reduced by the months the house was actually vacant. Donna Prudence, 13452 South Fork Lane(service level: universal; amount due$709.05) stated that they were not using the garbage service. They had to take their cans down to Three Forks in their car anyway so they just took it to their business in Palo Alto. They also recycled in Palo Alto. Ed Turney, owner of property at 23690 Ravensbury, (service level: 1 can; amount due $936.07)had sent a letter to the Council. He said that he stopped paying his bill when he was not allowed to participate in the Town's clean up day at Magdalena and 280. Since then he had not used the services of the garbage company. Instead he has taken his trash to his office. July 15, 1999 Special City Council Meeting 1 Mrs. Kaizuka, 25750 La Lanne Court, (service level: universal; amount due $1,044.00) stated that she does not use the garbage service. Instead she takes her garbage to her son's home. Mr. Mak, 11614 Dawson Drive, (service level: universal; amount due $852.60) stated that he did not use the garbage services and therefore did not think he should have to pay. Mark Jensen, 26225 Purissima Road, (service level: universal; amount due$1,042.05) referred to a letter from his attorney, Kristen Thall Peters from the law firm of Cooper, White and Cooper. In this letter several cases were referred to which Mr. Jensen believed supported his belief that these charges were unfair. He did not use the garbage services, had never asked for them and believed they were an unfair taxation. Mr. and Mrs. Jenkins, 13053 Cumbra Vista Court, (service level: 1 can; amount due $204.94)had sent a letter to the Council explaining that they had not paid because their home had been unoccupied for certain periods of time. Stephanie Munoz, 13460 Robleda Road, (service level: universal; amount due $1,028.05) distributed a letter to Council as well as copies of previous correspondence. She did not agree that these were fair charges. It was a service she had never used nor asked for. Mrs. Munoz believed the Town had arbitrarily signed her up for garbage services without her authority or permission. Mr. Munoz, 13460 Robleda Road, concurred with his wife's comments. They lived in a wonderful,relaxed country community. However,he did not think that the Council had • facilitated a common solution to this garbage problem. He too did not think it was right to be charged for services they never asked for, did not use and did not think were appropriate. In his opinion it was taxation without representation. Council had received no communication from the following: Dwight Miller, 2210 Gerth Lane (service level: universal; amount due$756.90),Mr. and Mrs. Tan, 12903 LaBarranca(service level: 1 can; amount due $1,504.56) and Robert Clifford, 25240 Cantata Way(service level: 1 can; amount due $1,270.23). Since Finn had arrived after the public comment, he was unable to vote on the issue. Casey stated that she had voted to eliminate mandatory garbage in 1995 but not recycling. At this time she believed she had to uphold this ordinance in good faith. Dauber concurred with Casey stating that the Town had to enforce the ordinance to satisfy State mandates. MOTION SECONDED AND CARRIED: Moved by Casey, seconded by Siegel and passed by the following roll call vote to put the following universal delinquent Los Altos Garbage Company accounts on the next tax roll with an administrative charge: Prudence ($709.05), Miller ($756.90), Kaizuka($1,044.00), Mak($852.60), Jensen($1,042.05), Stephanie Munoz($1,028.05). AYES: Mayor Dauber and Councilmembers Casey, Johnson and Siegel NOES None ABSTAIN: Mayor Pro Tem Finn July 15, 1999 Special City Council Meeting 2 MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Johnson and passed by the following roll call vote to put the following delinquent Los Altos Garbage Company accounts on the next tax roll with an administrative charge: Tan($1,504.56) and Clifford($1,270.23). AYES: Mayor Dauber and Councilmembers Casey, Johnson and Siegel NOES None ABSTAIN: Mayor Pro Tem Finn MOTION SECONDED AND CARRIED: Moved by Dauber, seconded by Siegel and passed by the following roll call vote to put the following delinquent Los Altos Garbage Company account on the next tax roll with an administrative charge: Barez($237.00). AYES: Mayor Dauber and Councilmembers Casey, Johnson and Siegel NOES None ABSTAIN: Mayor Pro Tem Finn MOTION SECONDED AND CARRIED: Moved by Casey, seconded by Siegel and passed by the following roll call vote to to put the following delinquent Los Altos Garbage Company accounts on the next tax roll with an administrative charge: Jenkins ($204.94). AYES: Mayor Dauber and Councilmembers Casey, Johnson and Siegel NOES None ABSTAIN: Mayor Pro Tem Finn • Casey noted that the clean up site at 280 and Magdalena had only been closed to Town residents one time. At that time the Town had worked out with the garbage company that this location should not just be for county residents. MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Dauber and passed by the following roll call vote to to put the following delinquent Los Altos Garbage Company accounts on the next tax roll with an administrative charge: Turney ($936.07). AYES: Mayor Dauber and Councilmembers Casey, Johnson and Siegel NOES None ABSTAIN: Mayor Pro Tem Finn MOTION SECONDED AND CARRIED: Moved by Dauber, seconded by Siegel and passed by the following roll call vote to agree that any delinquent accounts paid by 5:00 p.m. on July 30'h would not have to pay the $76.36 administrative fee. AYES: Mayor Dauber and Councilmembers Casey, Johnson and Siegel NOES None ABSTAIN: Mayor Pro Tem Finn 3. PRESENTATIONS FROM THE FLOOR: July 15, 1999 Special City Council Meeting 3 4.
