October 9, 1967
Chairman ✓d. F. Hinckley called the meeting to order at 7:46 P. M, at the
Town Hall, 26379 Bremont Road, Los Altos Hills, California. The following
members answered Roll Call: Present: Commissioners Bowler, Dawson, Hibner,
Perkins, Sherlock, Chairman Minckley. Absent: Commissioner Lachenbruch.
Council was represented by Councilman 'Halter A. Benson.
APPROVAL OF MLYUTBS: September 25, 1967.
Commissioner Dawson stated that because he was not present at the last
Planning Conaaission meeting, the Amended Motion was not clear regarding the
building site approval of Rudi Ligtelyn (BSA -35-67), P. 3, Para. 3.
Commissioner Hibner was of the opinion the Motion should be ariended to in-
clude that tae private road be brought up to maximum road standards of 16',
since he was sure he had stated this Motion in accordance with the Fire Chief's
recommendation and that the Motion had passed. However, Commissioner Bowler
stated that at the time he voted he lid not understand the Motion to call for
above the minimum width and if this were the intent of the 14otion, he would
06 withdraw his vote of approval on the Ligtelyn building site approval. Com-
nissioner Bowler questioned the basis on which the higher width would be
called for on service of two lots and stated the Town has a standard and
wanted it known whether the standards were being challenged.
City Manager pointed out that during the September 25th meeting, the Amended
Motion was made without a Second to require a 16' width but in discussion was
changed to read "in accordance with the recommendations of the City engineer"
and so published and approved by the City Council.
Commissioner Bowler stated he objects to the requirements of the Fir,_ Chief
in that there are other considerations besides fire safety. Commissioner
Hibner pointed out the standard specifications call for a paved width of 1^-
16' on a private road with 24' to 32' rights of way.
Tire City Engineer stated the determination of a 14' or 16' width is dependent
upon whether aspu:alt berms are required on the driveway. If none, then the
14' width, if berms are constructed, then 161. If a drainage problem, it
would necessitate a berm and the 16' width required.
Cormissioner Hibner said he would accept the recormendat ions of the City
angineer, and the Motions remained uncorrected as published; however, a
correction was made to the format correcting "Amended Motion" to 'Amendment
to the kotion'.
MOTION, SBCONDED & CARRIED: Commissioner Perkins moved; seconded by
Commissioner Sherlock, and unanimwsly carried by voice vote, that the
Minutas of September 25, 1967 be approved as corrected.
1) City Manager announced the Adjourned Regular Meeting of the City Council
on Tuesday, October 10, 1967 at 7:45 P. iM., at the Town Hall, which will be
adjourned to a Study Session to review with the Sewer Committee the Progress
Draft of the Metcalf & Eddy Report on alternate methods of sewage disposal.
2) Chairman Minckley announced a meeting of the Santa Clara County Planning
Policy Committee relative to Parks and Open Spaces, who are looking forward
to a schedule of completion by December 15th.
COUACIL REFERRAL:
1. MAPS COIHNITTEB REPORT.
Mr. James K. Bell, 27421 Sherlock Road, Chairman of the IMPS Committee, was
present and stated his readiness to speak to any questions on the subject
report.
Chairman Minckley, on behalf of the Planning Commission, expressed their
appreciation to Mr. Bell and his Committee for an excellent planning tool
and that when this neighborhood is studied in the future the Planning Com-
mission will have a full public hearing. Chairman Minckley expressed the
hope that each of the areas studied in the near future will so be treated and
stated that he will submit a neighborhood plan at the October 23rd meeting.
40 Mr. D, Spencer,.27490 Sherlock Road, spoke in regard to neighborhood studies
and raised the point that a tremendous amount of work has gone into the IMPS
Committee Report and has yet to hear any discussion from the Planning Commission
or Council.
It was discussed and agreed by the Commission that the MAPS Report certainly
deserved and will have full discussion, Co:znissioner Dawson pointing out that
the A.rtinelli Subdivision on the Agenda this meeting lay within the area of
the MAPS Cormiittee report; however, Commissioner Bowler was of the opinion
that the report should be discussed in the context of pending action,
change of zoning, and it was noted the slope density report from +1m. Spangle
& Associates would be heard in the very near future.
Mr. Bell stated there would be a greater satisfaction to the people of the
area and to the Committee if in the near future the Commission were to review
the specific recoamendations at the end of the report so that Vie people feel
their thoughts have been considered and a response received.
Chairman Minckley instructed the City Manager to schedule a Public Hearing
on the MAPS Committee Report for Foven:ber 13, 1467.
VARIANCES•
1. Helgesson, Alan (V-288-67) - Request for reduction of setback requirement
to 22' of property line for addition to existing residence at 26860 Elena Road.
Staff stated the application is for an eight foot variance to 22' at the
proposed northwest corner of subject residence and a four foot varianca to
26' at Vi-- southwest corner. Staff reported that due to topography, location

of major tre^<s and of the existing residence, any addition is difficult. To
date, no objections have been received from any neighbor.
Property was inspected by the Map Committee, Commissioners Dawson and Sherlock,
who agreed the planning has been well thought out in order to avoid excessive
cuts ane renoval of treas and would in no way impair the enjoyment of viy of
the neighbor:ing.. properties. Commissioner Sherlock pointed out this tome was
built before present ordinances were in effect, and if now built differently
as a new residence, would need no v=riance.
Mr. Donald Phillips, 27860 Black Aountain Road, owner of adjacent property,
stated he has no objections to the plan as proposed and in fact preserves
and enhances the view.
Mr. Joseph Parise, 26875 Elena Road, owner of the property in roar of the
Helgesson property, stated the two story addition would obstruct his view and
asked the heigat of the second story.
Mr. A. Helgesson was present and referred to the House profile on the plan,
explaining there is an 11' rise between the house level and the back of the
property so that the first level is nestled down below the property in back
4W and therefore the second story will not be much higher than a ons -story home.
Mr. Parise reitarat-d his objections, however, it was pointed out to Mr. Parise
that the variance requested was purely longitudinal and that according to
the Town's ordinances Mr. Helgesson could build to a height of 30' without
any variance on the present house.
D:r. Parise contended there will be constant heavy construction traffic and
wished to put the Council on notice a hazard does exist in that school

Commissioner Hibner stated he visited tae Helgesson home and inspected the
site and in his opinion the view of Ar. Parise will not be nipinged upon.
Commissioner Dawson stated his inspection also proved this point.
MOTION. SECONDED AND CARRIED: Commissioner Dawson moved, seconded by
Con:.:issioner Hibner, and unanimously carried by voice vote, that the request
of Alan Helgesson (V-288-67) for variance to twenty-two feet (22') at the
proposed northwest corner of residence and variance to twenty-six feet (261)
at the southwest corner for residence addition at 26860 Elena Road, be approved

DIVISIONS O: LAND: TENTATIVE MAP:
1, Piartinelli, Frank Sr. (334-67) h lots, Moody Road - Engr. Chas. L. Coburn.
Staff reported that the application for subject subdivision on Moody Road,
across from Adobe Creek Lodge, had terrain which is partially wooded and
steep in some areas.

DIVISI0NS OF LAND: Martinelli, (Tent. :lip.) 335-67 continued:
LV Staff read the following letters from the ;approving .agencies:
1) Fire District letter dated August 30, 1967, objecting to excassiv.,
grades on driveways, access to lots, and problem of water supply;
2) County Health Department letter daw:d. September 3, 1967, disapproving
the use of individual sewage disposal systems within the subject subd.;
3) City 3n9ineer's letter dated October 9, 1967, approving, with 13 conditions.
However, Staff reported that a further letter from the Fire District dated
October 9, 1967, had been received, indicating approval with 7 conditions.
There was an inspection of the property by the Map Committee, Comidssioner
Sherloc: noting the area was divided into over one acre lots and that the
subdivider had taken advantage of the best location for the propose&. house
locations, using considerable imagination for traffic circulation; however,
in pointing out that while the area is o:ttremely steep, no slope density
ordinance Sas been worked out and that there would appear to be no basis for
a delay.
Commissioner Dawson added that strong retaining walls or cantilever design
would be necessary for the construction of the horses, since in his view, this
ground would not stand much grading.
Chairiaan 14inckley asked for comments from the Floor.
Mr. Donald H. Carr, representing Mr. Martinelli, Sr., stated them, had been
a great dual of study to take advantage of the topography in order to obtain
lots greater than one acre, realizing the land is steep, and requested the
Planning Commission to consider the tentative map from a planning point of
view as being in conformity with all ordinances.
.r. Carr further stated Or. Martinelli has requested the Health Dapartnent to
appeal their requirement relating to non -approval of individual sewage systems,
and,in support of this appeal, had performed private percolation test holes
which appear that the land is feasible for septic tanks by virtue of the
results of the tests. In this appeal Mr. Martinelli also indicated his
earnest desire to connect to sanitary sewers when and if available. L;r.
+lartinelli's letter of appeal dated September 20, 1967 was read by Staff.
Drainage easements were discussed and it was agreed by all that the use of
drainage pip^_s was more in keeping with the rural atmosphere than concrete
lined channels.
The proposed dedication for a new road along the bottom of lots '_, 2, and 3
with access into moody Road was thoroughly discussed. Co"Ussionar Hibner
was of We opinion a complete neighborhoo< study was needed in this arca since
it would appear proper to have a public road from Moody Roarto fie and of
Lot 41 established at this point, because in the future there will be consider-
able develop.aent of the adjacent lands.
idr. Bell pointed out it would be well to see where this property fits into
the overall plan of the r"PS area and to consider whether any approval would
result in its berg an exc-2ption or a precedent,

Chairman Hinckley stated it was his personal feeling this matter shoul:9 be
studied in content with the rest of the area, however, Mr. Maxtinelli stated
that tune was of the essence for hin and re..ouested action at this mooting,
Conliissioner Bowler was of the opinion that if there are reservations in the
minds of some Commissioners, that in all fairness to the sub<'ivider, that tSae
specific area of reservation be spelled out.
It was discussed that the point in question was the width of the paved: road
ant right of way width in relation to Vi:_ type of road, __ a „ local, collector,
etc., and imminence of future developi.iant and needs. Commissioner Bowler
stated that perhaps the Council will want to review the increasing amount
of cut andimpervious run-off fron a large asphalt jungle. A Check List
was prepared to seek agreement and resulted in the following conditions:
1) Lan�scaping required along any sloue and fill per fire prevention official,
as well as providing erosion control per City Engineer;
2) In tract and off tract roads as required by City 3ngineer (it was
discussed by Comuaission that a public road with 60' right of way and
201 meted width would be satisfactory, rather than 22', but that this
should be determined by tt:e City 3ngineer and reviewed by thr_ Planning
Cora.:ission after further study of the MAPS area.
3) In tract and off tract drainage by piping.
E) Paths installed along north side of new road and along the northerly side
of Moody :Road to easterly boundary.
5) Stop sign, No Thru Street sign, street name sign, and path sign were
recuired.
6) Dedications to 30' from existing centerline along north side of n'ioody
Roa' and 60' for the new road (name to be agreed upon by Fire Chief,
City Bianager and developer.)
7) Approval of Town Agencies.
8) In lieu payment for Parks and Open Spaces per Ordinance No, 117.
MOTION, SECOMED AND CARRIED: Commissioner Bowler moved, seconded by
Commissioner Dawson, and unanieously carried by voice vote, that the
tentative map of Frank Hartinelli, Sr. (336-67) 4 lots, i+ioody Road, dated
August 17, 1467, be approved, subject to the conditions of t:x_ Check List,
There being no further business, the meeting was adjourned at 9:50 P, H.
