MINUTES OF A RFGULAR MEETING
November 13, 1967
Chairman 4. 7. Hinckley called the meeting to order at 7:46 P. M. at the
Town Hall, 26379 Fremont Road, Los Altos Hills, California. The following
members answered Roll Call: .Present: Commissioners Bowler, Dawson, Hibner,
Lachenbruch, Perkins, Sherlock and Chairman Minckley.
Council was represented by Councilman Mary C. Davey.
APPROVAL OF iii LiUTES: October 239 1967,
Amendments: 1) P. 1, Approval of Minutes, 3rd para., add to end of sent.,
°except for spocial items"; 2) P. 5, Other Business by Commissioners, 2nd
para., Ist line, following 7th word, add "official' and capitalize 'plan
line,.
MOTION, SECONDED AND CARRIED: Commissioner Hibner moved, seconded by
Commissioner Perkins, and carried unanimously by voice vote, that the Minutes
of October 23, 1967 be approved as amended.
COMMUNICATION'-:
1) LeLter da Le November 1, 1967 from the Board of Supervisors, County of
Santa Clara, requesting comments by November 22, 1967 on the enclosed proposed
County Zoning Policy Resolution relating to County zoning policy of territory
in close proxiuity to incorporated cities. Proposed resolution was read by
Staff and TAn Cnairman directed this business be taken up under Other Business.
2) Latter da'ied :November 10, 1967 from Pair. J. H. Whitman, owner of acreage in
Los Altos hills, opposing any slope density controls requiring in excess of
the ono acre minimum, was read by Staff.
3) Letter dated November 10, 1967, addressed to the Mayor and read by Chairman
Hinckley, -Crow Mrs. Betty Byrne delahara, 3322 P Street, Washington, D. C.,
relating to the slope density discussion agendaed for this meeting and
suggescinn a study should be made and made public as to what extent a slope
density ordinance will reduce property values if adopted.

1. JOhn SMI, uugene R. (V-291-67) - Reduction of setback requirement to 15' on
both sides of property line for new residence at 27765 Via Ventana (Lot #17,
Tract n659).
Staff Report was read, as well as the following communications relating to the
variance:
1) letter dated November 7, 1967 from Jack A. Hundeford, 27789 Via Ventana,
opposing the granting of the requeste6 variance.

2) Letter dated October 25, 1967 from J. B. Scurry, P. O. Box 1001, Palo
Alto, opposing the granting of the requested variance.
3) Letter dated November 3, 1967, from Mr. Frank W. Saul, Chairman of tr-
Watadero Hills Architectural Committee, supporting Mr. Johnsen's request for
variance in view of the Committee's firm policy to forbid the dsst'ruciion or
removal of any mature tree in the subdivision.
Mrs. Johnsen was present and stated that they had worked with an architect
on many designs but all required a variance or it was necessary to r.,wove a
mature oak tree, in order to build a house of the same calibre within the
neighborhood.
Commissioner Hibner reported for the Map Committee, concluding that these
variances would be objectionable, that the matter was one of planning, and
does not accept the fact that an oak tree has to be destroyed. Commissioner
Hibncr was of the opinion the house could be roved back 15' or 20' ani', the
steepness of the driveway compensated by fill.
Chairuan r=jinckley asked for comments from the Floor. Messrs. Rod ft s12 and
J. B. Scurry (neighbors within 300') spoke in opposition to the granting of
the variances.
Cor"issionar Lachenbruch reviewed Section XIII, 13:60 of Ordinance No. 78,
and stated th-,se conditions do not exist.
MOTION AND 53COHD: Cocnaissioner Lachenbruch moved, seconded by Coruiissioner
Dawson, that the request of dugenc R. Johnsen for two variances at 27755 Via
Ventana be deniod.
Commissioner Hibncr, while in favor of tine Acting, requested the Glover to allow
the Joi.nsen's to .submit a revised plan since the matter was one of planning.
Comnission discussion indicated a small variance would be consid2rrae.

accapted by the Seconder, Commissioner Dawson, that the request be denied

motion and Acrendrient were carried unanimously by voice vote.
2) Hugnes, Rita A. (V-292-67) - Reduction of rear setback requirement to 15'
,for pool ac 25635 Snell Lane.
Staff Report was read and no objections received to date.
Commissioner Hibncr, Map Committee, reported that if a pool is desired, this
is rhe only possible place to build it due to the leaching lines and driveway
surfaces, but was concerned about the reaction of the nearest neighbor Q52
Smith property).
Pit. Hugh -,s i'✓as pr:sent and presented photographs of the area.
Mr. A. V. Smith, 26430 Weston Road, an adjacent neighbor, spoke in opposition
to the granting of this variance.

VARIANCES: Hughes cont'd.:
Cheirman Minekley pointed out that, since Mr. Smith's house is PS' fron the
Hughes' property line and the pool is 15' from this line, the original concept
of the satbaek raquircments to maintain a 60' separation between structures
existed; howevar, Commissioner Sherlock felt that a person building with extra
margin should net nave to take up 'the slack !or another person's variance, to
which Co„nissionar Lachenbruch agreed.
Commissionar Perkins believed the pool site, off the kitchen, was the natural
location.
Comtiissioner Dawson indicated the nap lacked the proper slopes and future
leaching lines, but on the basis of neighborhood objection and the riscussion,
could not vote approval.
MOTIO19, 53CONDED AND CARRIdD: Com issioner Bowler moved, s-conded by
Commissioner Dawson, that too application of Rita A. HugSas (V -2S2-67) for
variance for pool be denied, was carried by a .rajority voice vet_, Commissioner
Perkins opposed.
3) Appel,', i4. C. (V-243-67) - Reduction of side setback requirement to 20'
for carport with deck above at 2W5 Laur_l Lane.
Staff report was read, and no objections received to data.
Concaissionar Hibner, Map Conmittee, reported that an on-site insp_Ction re-
vealed no irpingocient upon the neighbors' views, and that there was no other
logical place for the carport and deck..
Commission noted the lack of numbering of the contour lines on this rap.
Chairrian ✓onckley requ_sted convents from moor. Thar- were none.

proper under Ordinanca do. 102, the 'record of Survey submitted omits pertinent
infornation to caul o a judgement on this roquest since the procedure for
processing .and approval is the same as for tentative subdivision maps (Section
I -I, IV, Ordinance AD. 102).
Commissioner Bowler pointed out the reason for inquiring only a Record of Survey
is to ost o resp no !entity of the property and this leap accomplishes that.
