HomeMy WebLinkAbout11/27/1967PLANNING COMMISSION TOWN OF LOS ALTOS HILLS MINUTES OF A R3GULAR MEETING November 27, 1967 Chairman ':J. F. Minckley called the meeting to order at 7:53 P. M. at the Town hall, 26379 Fremont Road, Los Altos Hills, California. The following members answered Roll Call: Present: Commissioners Bowler, Dawson, Hibner, Lachenbruch, Perkins, Sherlock and Chairman Hinckley. Council was represented by Councilman John M. Fowle. APPROVAL OF MINUTES: November 13, 1967. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Commissioner Hibner, and carried unanimously by voice vote, that the winutes of 14ovember 13, 1967 be approved as submitted. CONDMUNICATIONS: 1. Letter dated November 13, 1967 from Commissioner Gordon E. Bowler on the subject of lot size in Los Altos Hills with reference to the Analyses by Commissioners Lachenbruch and Perkins. Chairman Minckley directed that this communication be discussed at the slope density study session. 2. Letter dated November 27, 1967 addressed to the Mayor, with copy to Chairman Minckley, regarding restrictions on land use in Los Altos Hills, was read by Staff. ANAOUNCFlF111T5: 1. Staff called to the Commission's attention that the fourth Monday in December falls on Christmas Day. Chairman Minckley directed the Staff to cancel the Planning Commission meeting on December 25th, but if necessary, a Special Meeting will be called. COMMITTEE REPORTS: 1. Commissioner Lachenbruch reported on the following Committees: a) Mid -Peninsula Planning Committee - Preparation of final report is now in process and will be submitted to the Foothill Communities sometime in January. b) Geological Hazards Committee - Final recommendations have been prepared, which Commissioner Lachenbruch will submit at a later date to the Commission, with one of the recommendations being that a group of Mid -Peninsula communities pool their resources 4 and retain a geologic consultant to prepare a hazards nap. OLD BUSINESS• 1. Shoolery, James N. (V-294-67) - Presentation of Revised Nap for Reduction of Setback Requirements for Pool and Equipment Housing. Mr. Shoolery submitted revised maps, showing front setback for pool to 26' (previously submitted at 24) and front setback reduction for equipment housing to 241 (previously 151); partial contour lines and patio area were added to the map. Commissioner Hibner confirmed his previous statement from last meeting that there is insufficient room for a pool site and his greatest concern is its location, which is at the edge of the steep slope. Chairman Hinckley asked for comments from the Floor. Mr. Shoolery explained he had obtained three bids from pool contractors and all three indicated that the proposed location was the most practical. He submitted a letter from a pool contractor, read by Commissioner Hibner, indicating that the pool would be located in solid undisturbed soil and should present no problem during or after construction. Mr. Shoolery further explained his reasons for this site in that there is a circular driveway in front of his residence and that the side location would destroy mature lawn and landscaping, as well as requiring a larger variance. Mr. 'd. Fenn, Sr., representing his son who could not be present, recuostod the variance be denied on the grounds the structures would be too close to the road and that a playground would be made out of the front yard. Staff reported that Mr, Fenn`s residence is off the driveway easement beyond the rise of the hill, the easement being directly across from the subject property. Mr. ;'!. D. Gustin had previously objected on the grounds the variance would impinge upon his view from his dining area and that the fence would present an unsightly scene. Commission noted thrre are no Town restrictions on a 6' fence as proposed by the applicant. Commission concurred that conditions "a" and °c" of Section 13:60, Ordinance No. 7E exist, but further discussion indicated that the issue revolved around point "b", relative to the validity of the protests. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Commissioner Dawson, that the request of James N. Shoolery (V-25%-67) for reduction of front setback requirement of 1511 to 24s' for pool be granted, was passed by a majority vote, Commissioners Hibner, Lachenbruch and Chairman oinckley opposed. In discussing the variance for the equipment housing, it was the opinion of the Commission this structure could be framed into the garage and the fence. MOTION, SECONDED AND CARRIED: Commissioner Dawson moved., seconded by Commissioner Sherlock, and carried unanimously, that the request of James N. Shoolery (V-294-67) for variance for equipment housing be disapproved.. -2- DIVISIONS OF LAND: 1. RO53HILL ESTATES NO. 2 (336-67) 6 lots, at Taaffe Road and Dezahara Way. Engr. G. Hagey. Staff reported that this subdivision is located on Taaffe Roan at Dezahara Way, opposite Rosehill Estates Unit 31, that the property is steep and wooded but that all lots are 1 acre+, Staff further reported tho.t Taaffe Road is being improved to fu11 w0t', by Unit No. 1 (in lieu of Ralf-streot inprov.:ments on Taaffe and Altamont) and recommendedan in -lieu payment for Taaffe Road by Unit #2. ConNissioner Hibner reported the property has a total acreage of 8.7,:6 acres, containing six lots varying from 1.55 acres to 1.01 acres, with the nature of the terrain indicating all access from Taaffe Road. Com- missioner Abner inspected each lot and reported there were reasonable building sites for all lots and woulC present no problem; however, Conmissioner Hibner did caution about tine drainage from Unit 41 onto Lot #4, which has a natural water course. City Engineer recommended that access to lots 41 and #2 not bu permitted within 100' of their common lot lines, and that individual Covelopment plans for each lot be submitted prior to the issuance of a building permit. Cocuaissioner Lachenbruch was of the opinion that all tentative nips 3roul1 indicate the house sites. Chairr:an tlincGcley asked for comments from the Floor. Mr. T. Gamboa, developer of Unit #2, explained that the brush ha6 been cleared in order to walk the property and locate the building sites, and setback lines. Commission noted a discrepancy of 1+ acre between the total acreage of the parcel and the total acreage of the lots, but it was determined thit the total acreage had been measured from the centerline of Taaffe Road. 11071014. SECONDED AND CARRIED: Commissioner Hibner moved, secon.'e: by COW Ssionzr Perkins, and carries' unanimously, that the Planning Co mission proceej with the Check List. A Chuck List was prepared with the following two additional conditions: 1) In -lieu payment for parks ane. open space per Ordinance No. 117; and 2) no access to Taaffe Roach for lots #1 and #2 for 1001 from common lot line of lots 01 and #2. M(JTION, SECONDED AND CARRIED: Coru:dssioner Hibner moved, szcondoel by Commissioner Sherlock, and carried unanimously, that the Tentative Map of Rosehill Estates Unit No. 2 (336-67), 6 lots, be approveP. in accordance with the Check List. -3- DIVISIONS OF 2. 51!:IARD, HENRY V. (337-67) 2 lots, Briones Way. Hngrs. Jones, Thenn & Tillson. Mr. H. Seward, developer, requested that the Tentative Map dated November 14, 1967 be withdrawn without prejudice and submitted a revised map dated November 27, 1567 for Commission consideration. Commission agreed to review the revised :.yap. The revised map divides the two acre parcel on Briones Way into two rectangular 1.00 acre lots, lot #1 containing two existing houses (previous nap showed a house on each lot with irregular lot lines). Ar. Seward requested approval, subject to tira smaller house having the kitchen facilities removed and re- maining as a guest cottage. Commissioner Bowler, Map Committee, inspected the property andd indicated that the revised nap was the more sensible approach to the subdivision. Commission concurred. 140TIO0, SECOIm3D AND CARRI O! Commissioner Hibner moved, seconded by Commissioner Bowler, and carried unanimously, that a Check List be prepared. Two additional conditions were a-dat to the Check List: 1) In -leu payment for parks and open space per Ordinance No. 117; and 2) removal of kitchen facilities in the secondary dwelling, to be designated a. non-confo ming use (structure). Seward (337-67) 2 lots, be approved subject to the conditions of the Check List. OTH3R 13USI14253 BY COMMISSION3P,S: 1. Core.:issioner Perkins was of tho opinion that Commissioner Lachenbruch's suggestion was excellent in that the Tentative Maps indicate the house site for each lot, and would be especially helpful to the Commission when con- sidering the subQvision of steep lands. Chairman Minckley instructed the City Manager to review Ordinance No. 69 with Lot City Attorney .and suggest such wording to meet the Commission's needs. 2. City Manager requested the Planning Connission to review the subdivision or`inanco for any changes prior to the publication of the codification of ordinances. Chairman Minckley requested the Commissioners to each prepare a list of questions to be taken up at the Study Session of the next regular meeting. ADJOURNMENT: 9:s'.O P.
