January 8, 1968
Chairman ,7. F. Minckley called the meeting to order at 7147 P. M. at the Town
Hall, 26379' Fremont Road, Los Altos Hills, California. The following members
answered Roll Call: Present: Commissioners Bowler, Hibner, Lachenbruch,
Perkins, Sherlock and Chairman Minckley. Absent: Commissioner Dawson.
Council Representative: Councilman ',falter A. Benson.
APPROVAL OF r4INUTES: December 11, 1967.
MOTION, S'3CONDcD AND CARRIi.D: Commissioner Bowler moved, secondeC, by
Commissioner Perkins, and carried unanimously, that the Minutes of
December 11, 1967 be approved as submitted.
COP-fiIUNIC,'.TIONS:
1. Staff read letter dated January, 1968 from City Attorney advislmgthat,
in consideration of applications for variances, the Planning Commission
should be guided by the criteria now established by the State Planning Act,
rather than by those set forth in Section 13:60 of Ordinance No, 78. The
letter quoted the new criteria to be followed.
2. Letter dated January 6, 1968 from Frank B. Duveneck, Hidden Villa Ranch,
Los :,Itos, expressing support for proposals to regulate slope density, was
read by Staff.
3. Letter dated December 11, 1967 from George Heimendinger, 27150 Moody
Court, expressing opposition to the regulation of slope density, was read
by Staff.
4. Memorandum dated December G, 1967 from Commissioner Gordon E. Bowler to
the Planning Commission on the subject of "Luxury vs. Simplicity in the
Rural 3nvironment." Memo was referred to the Commission for study.
5. Staff read letter dated December 13, 1967 from Edward Harpoothian,
24300 Summerhill Avenue and Martin J. Nauer, 24290 SuMerhill 'venue,
stating their intent to proceed with a Quitclaim Deed in order to solve a
boundary encroachment involving their properties. Letter was referred to
City Attorney for recommendation to Commission.
6. Letter dated December 30, 1967 from Juanita L. Morgan, outgoing City Clerk,
expressing her appreciation and extending best wishes to the Co:maission.
AANOUNC3PLINTS:
1. Staff introduced Dennis R. Lairr, new City Clerk -Treasurer.
2. Chairman Minckley noted it was in order for the Commission to select a
neva Chairman. Commission agreecl to agenda the election of officers for the
next meeting, January 22, 19683 to coincide with the January 23rd expiration
date.
OLD BUSINWS :
IL1. S'ioolery, James N. (V-244-67) - Reduction of Front Setbac',.: to 2c' for
Pool at I 70 Cnrillo Lane.
Staff Report was read and submitted the following recomaanc-_'tions:
a) The Commission should not concern itself with the technical asnocts
of this variance request.
b) If Via only concern of the Co:n.aissien is the engineering feasibility
osthe placement of the pool, the application can be approved subject to
the approval of the City Engineer ._r receiving an engineering plan
(including soils report)preparec. by We applicant.
Mr. Ken `: 7hitford, P3esident of Lifotime Pools, requested that building permit
be issued nnd, in place of a soils test, permit a consulting engineer from
his fire: to inspect tan excavation nd certify the pool site.
Commission discussion ensued concerning clarification and. interpretation
of City .'.ttorney's letter daated. January .„ 1968 advising criteria in con-
sibzration of applications for vazianc:s.

pool be for the next meeting and that the Con.aission wave the
City Attorney present to assist in clarifying the criteriz new established

Discussion followed concerning the -oboe elenent of the deferral. sir.

VOT!: Question was called by Commissioner Perkins. The :"lotion to defer

2. Bellucci, D. (V-296-67) - Council Referral to Connission to consider
updating of f.acilitios at Adobe Creak Lodge as a variance.
Staff Report concerning Council Referrzl to Commission was rw,d. City
Manager stated that in accordano, with the previously noted letter fro,a.
City attorney dated January 4, 14602 City attorney now advised Co'Amission
that the appropriate procedure for Or. Bellucci would be to nsand the zoning
provisions of Ordinance No. 7£, Section 7:40 in particular, rather than
requesting a variance.
Co.udssion discussed the implications of Ordinance No. Ili, and the new advice
or the City Attorney.
At 0:35 P. n., Chairman Minckley oponed Public Hearing and asked for comments
from the Floor.
Az. D. Bellucci stated he had no objection to amending the ordinance as he
would like to see his facility classified a conforming use.

traffic problems created by Mr. Bellucci's facility-
