/W MINUTES OF A REGULAR ADJOURNED MEETING
` November 12, 1968
Chairman W. F. Minckley called the meeting to order at 7:47 P. M. at the Town
Hall, 26379 Fremont Road, Los Altos Hills, California. The following members
answered Roll Call: Commissioners Dawson, Magleby, Perkins, Chairman
Minckley. Absent: Commissioners Hibner, Lachenbruch, Weisbart.
COUNCIL REPRESENTATIVE: Deoutv Mavor Benson.
APPROVAL OF MINUTES: October 28, 1968.
Commissioner Dawson moved, seconded by Perkins and carried unanimously,
that the Minutes of October 28, 1968 be approved as submitted.
COMMITTEE REPORTS:
1. Commissioner Perkins, Chairman of the Private Road Committee, presented
a summary of the Committee's first meeting and noted the next meeting is
scheduled for November 19th.
USE PERMITS AND VARIANCES:
1. FLOYD W. GOATES (UP -306-68 and V-306-68) - Request for a Use Permit for
Secondary Dwelling at 13730 Burke Road AND request for the following variances:
a) Request to allow secondary dwelling on parcel less than one (1) acre in
net area;
b) Request to allow kitchen facilities in secondary dwelling on parcel less
than 1.99 acres in net area;
c) Request for setback reduction of 14111" in side setback to 1511" for
existing caretaker's cottage.
Staff report was presented reviewing the application and noting the City
Council had requested Planning Commission review upon resub::ission of the
application to include variance requests. City Manager stated that Staff
was unable to recommend approval of this request on the basis of conditions
of hardship and special circumstances required by Section 13:60 of Ordinance
No. 78, as amended by Ordinance No. 149.
Commissioner Perkins presented Map Committee report, noting map deficiencies
and that only a small portion of the property is contiguous with Shoup Park
boundaries.
Mr. James C. Hoffman, attorney representing Colonel Goates, presented the
following correspondence to the Commission: 1) Letter from Los Altos City
Manager stating Las Altos was not responsible for offensive conduct outside
park limits; 2) Letter from Los Altos Glass Company attesting to $267.28
glass replacement within the past six months; 3) Petition for approval of
the Goates' application, including variances, signed by all adjacent property
owners; and 4) Title Company map of the Goates property and surrounding area.

USE PERMIT AND VARIANCES: Goates cont'd.:
Mrs. Hugh E. Russell, 886 Sutter Street, San Francisco, and Mr. and Mrs.
LGeorge Cummings, 13651 Burke Road, expressed support for the application and
emphasized the vandalism problem in the area.
Commission discussion ensued concerning law enforcement problems in the area,
characteristics of the property, and Section 13:60 of Ordinance No. 78,and
Ordinance No. 149, with Floor participation by Mr. Hoffman and Colonel Goates.
Mr. Hoffman stated the applicant would be willing to execute a deed restric-
tion, covenant, or other legal document to limit the allowance of a care-
taker's cottage to this particular owner of the property.
MOTION, SECONDED AND CARRIED: Commissioner Dawson moved, seconded by Perkins
and carried unanimously, that the Planning Commission recommends denial of
UP -306-68 and variances on the grounds that the necessary conditions pre-
requisite to the granting of a variance or use permit (Section 13:60 of
Ordinance No. 78, and Ordinance No. 149) are not present; further, this
Commission urges that the Council communicate the apparent police problems
emanating from Shoup Park to the appropriate law enforcement agencies, with
the hope that the inter -jurisdictional problems between the Santa Clara
County Sheriff's Department and the Los Altos Police Department can be
examined and a solution found immediately.
DIVISIONS OF LAND: Tentative Maps.
1. Dr. H. J. Beaver (349-68) - Change of access to Arastradero Road for
Lots #5, 7, 8, Tract #2093.

report was presented noting all Commissioners had visited the site and
reviewed all possible alternatives for providing access to Lots 5, 7, 8.
Staff recommended denial of the Tentative Map for the following reasons:
1) The proposed encroachment of private i_,provc:,cnts in the public right of
way.
2) The widening of Arastradero Road in the future will be jeopardized.
3) Excessive amount of asphalt and cuts on Arastradero Road.
4) Poor sight clearance unless excessive grading occurs.
5) Compliance with setback requirements would place structures on the steep
portion of the lots and would not alleviate difficult access grades.
Staff recommended the following:
a) Lot #5 be served from the private drive serving the Beaver residence
and that the lot line of Lot #6 be changed to allow a larger building
area for Lot #5.
b) Access to Lot #7 be obtained from the end of Horsehoe Lane via an easement
across Lot #6.
c) Divide Lot #8 by assigning a portion to Lot #7 and a portion to Lot #10.
Staff noted it might be possible to build upon Lot #8, if a variance to set-
back requirements from Horseshoe Lane were granted.
Commission discussion ensued concerning sight distance criteria, possible
future widening of Arastradero Road, and general plan guidelines, with Floor
participation by Dr. Beaver and J. Riley, applicant's engineer.

DIVISIONS OF LAND: Tentative Map of Beaver cont'd.:
Dr. Beaver stated that the development of Stanford Lands on the other side of
Arastradero Road will create numerous exits and that a change of access for
his property would not, by comparison, increase traffic problems on
Arastradero.
MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by
Magleby, that the Planning Commission not recommend approval of the request
of Dr. H. J. Beaver (349-68) for change of access to Arastradero Road for
Lots #5, 7, 8, Tract #2093, was carried by a majority voice vote, Chairman
Minckley abstaining due to personal reasons.
2. Page Mill Estates (350-68) - Convey .078 acres from lot #19 to lot #22,
and relocate lot line between lots #44 and #45, Tract #3306, Liddicoat Drive.
Staff report was presented noting the Planning Commission had previously
reviewed this proposal and recommended approval, subject to the recordation
of an easement across lot #20 for access to lot #19.
Commission discussion ensued concerning the lot line changes, with Floor
participation by Frank W. Saul.
A Check List was prepared, with the singular additional condition that an
ingress/egress easement be reserved along Amherst Court frontage of lot #20
for the benefit of lot #19.
MOTION, SECONDED AND CARRIED: Commissioner Magleby moved, seconded by
Dawson and carried unanimously, that the Page Mill Estates' Tentative Map
(350-68) be recommended for approval, subject to the conditions of the
Check List.
OTHER BUSINESS: Parkside Subdivision.
1. City Manager presented Tentative Map for the Parkside Subdivision
(351-68), 92 acres, 48 lots, located between Altamont Road and Moody Road
(adjacent to Byrne Park), and requested the Commission adjourn to a Regular
Adjourned meeting on November 25, 1968 to allow action on the Parkside
Tentative Map.
City Manager noted the following:
1) The proposed 22 acre park donation would provide a corridor between
Byrne Park and the proposed County Park on the Duveneck Lands.
2) City Council has authorized $6,500.00 expenditure for survey of the parcel.
3) To allow utilization of a tax write-off for the park donation, the appli-
cant needs final approval prior to December 31, 1968.
Commissioner Dawson moved, seconded by Perkins and carried unanimously, that
the Planning Commission express their appreciation to the City Manager and
Staff for their accomplishments in regard to the proposed park donation.
There being no further business, Chairman Minckley adjourned the meeting at
10:09 P. M. TO:
