M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. The following members answered Roll Call: Commissioners Dawson, Hibner, Lachenbruch, Perkins, Weisbart, and Chairman Minckley. Absent: Commissioner Magleby. APPROVAL OF MINUTES: November 12, 1968. Amendment: Page 3, 5th paragraph, insert 'single' in the place of "singular additional condition.....". MOTION, SECONDED AND CARRIED: Commissioner Dawson moved, seconded by Perkins and carried unanimously, that the Minutes of November 12, 1968 be approved as amended. COMMITTEE REPORTS: Commissioner Perkins, Chairman of the Private Road Committee, noted the Committee had been meeting with Town officials and would present an interim report to the Commission in the near future. DIVISIONS OF LAND: TENTATIVE MAP: 1. Parkside Subdivision (351-68) 44 lots, 68.85 acres, between Altamont and Moody Road. Engineer Sandis and Associates. Staff report was presented, noting the following: 1) The proposed subdivision has 44 lots, while 59 lots would be allowed under slope density requirements. 2) Anonymous donations by Town residents, totalling $30,000, had been pledged to purchase five lots along Moody Court for the purpose of preserving open space and increasing the proposed park corridor to 28.3 acres. 3) The beautiful spring on Byrne Park had been preserved by exchanging three lots on Nature Conservancy Land for two lots of the subdivision adjacent to the spring. City Manager read the following communications: a) George F. Solomon, 26871 Moody Road, dated November 21, 1968, opposing the creation of eight lots along Moody Court, which would have inadequate access and drainage facilities. b) Petition filed by eight property owners adjoining Moody Court, dated November 21, 1968, objecting to the use of Moody Court as a public thorough- fare for the Parkside Subdivision. 4W c) Merlyn D. Stubbs, 26811 Moody Court, dated November 24, 1968, objecting to the declaration of lots 36, 39 and 40 as building sites, due to severe drainage problems. d) M. G. Boissevain, 27181 Sherlock Road, dated November 25, 1968, objecting to the proposed subdivision and noting the drainage problems along Moody Court; the conflict with Town ordinances, since Moody Court is a private road already serving five houses; that the proposed park dedication area is too steep to be traversed; and that rural living should be preserved in the vicinity of Moody Court. fir - DIVISIONS OF LAND: Parkside Subdivision cont'd.: e) Florence M. Fava, 26691 Moody Road, dated November 222 1968, objecting to the proposed subdivision and noting significant drainage problems for lots #41 through 48, which are on the creek bed itself; that there is no alterna- tive access road; and that the proposed corridor is too steep for either foot or bicycle traffic. f) Wallace Stegner, 13456 South Fork Lane, dated November 24, 1968, support- ing the proposed subdivision and noting the value of open space and the large size of the proposed lots. g) Paul E. Nowack, Sandis and Associates, dated November 25, 1968, noting the gross acreage of the parcel being subdivided is 68.9 acres, while 28.3 acres lies within the proposed park donation. Mr. Nowack noted the actual average lot size of the 44 lots would be 1.46 net acres, which exceeds slope density requirements. City Manager reviewed fire access and noted the cul-de-sacs were longer than the maximum of 850' permitted by the Subdivision Ordinance, but that this excess length had been approved by the Fire Chief. Commissioner Hibner discussed the tremendous fire hazard problems in this area and requested a detailed study by the Fire Chief. City Manager noted the Check List would include approval of all agencies. 4 Mr. George Mader, Town Planner, reviewed the proposed subdivision recommending that the lot lines of lot #27 be changed to run with the contours in order to preserve integrity of the canyon; that the applicant be required to provide detailed plans to the City Engineer of the proposed intersection of the private road at Moody Road; and that a 32' right-of-way be required for all private roads. Mr. Mader also recommended that prior to filing the Final Map, the area between lots #37 through #44 should be surveyed and improvement plans should be submitted for the private roads, improvement of drainage channels, and demonstrating the feasibility of driveway access to all lots. At 8:42 P. M., Chairman Minckley delayed the Hearing to allow presentation of the HUD Award. NEW BUSINESS: 1. Presentation to Planning Commission of HUD Award to County Planning Policy Committee for Inter_goveznment Cooperation. Mr. Kurt Gross, Planning Commissioner of the City of San Jose, presented to the Planning Commission the U. S. Department of Housing and Urban Development Award to Santa Clara County Planning Policy Committee for Inter -governmental Cooperation. Mr. Gross noted Chairman Minckley's active participation on the County Planning Policy Committee. On behalf of the Commission, Chairman Minckley thanked Mr. Gross for his presentation. 4W MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Lachenbruch and carried unanimously, that the Planning Commission extend Gtheir thanks to Chairman Minckley for his arduous efforts in represent - W ing Los Altos Hills on the Planning Policy Committee. -2- DIVISIONS OF LAND: PARKSIDE SUBDIVISION cont'd.: At 8:46 P M., Chairman Hinckley opened Floor discussion on the proposed Parkside Subdivision. The following residents spoke in opposition to the proposed subdivision: L. W. Laws, 11210 Hooper Lane; Dr. George F. Solomon; Gene Smith, 56 Center Street, Apt. 2, Mountain View; Florence M. Fava; Jules Eshner; M. Boissevain, and Dale Stubbs. Support for the proposed subdivision was voiced by: Mr. Alan Lambert, developer of Parkside Subdivision; C. Stacey French, 11927 Rhus Ridge Road; David Jansson, and L. W. Laws. The following points were clarified during Floor participation: 1. Status of Moody Court is not clear at this time and the Check List will be conditioned upon the developer demonstrating legal access to a public or private road. 2. A complete plan of all proposed drainage facilities will be required prior to final approval by the Planning Commission. 3. Fire protection will be insured by compliance with all Fire Department requirements. Commission discussion ensued concerning access to Moody Court, off -tract drainage problems near Moody Court, possible reduction in the width of road pavement, possibility of shortening cul-de-sacs by serving the end five ` lots by private road, and path requirements. The following Check List was prepared and approved: A. LANDSCAPING: Landscaping to be in compliance with the plan to be approved by the Planning Commission, prior to acceptance of improvements. B. ROADS: 1. In -tract and off -tract roads as required by the City Engineer. 2. Private roads serving three (3) or more lots must have a 32' right-of-way. 3. All roads are approved, subject to the demonstration of a legal access to a public or private road being obtained by the applicant. 4. Fire roads to be constructed as follows: a) From Lower Park Way to Byrne Park along lots #29, 30, 27, and 36; b) From Upper Park Way to Myers property. C. DRAINAGE AND GRADING: 1. All drainage facilities shall be approved by the City Engineer and then submitted to the Planning Commission for final approval. 2. Cuts and fills must be contoured and a plan must be reviewed by both the City Engineer and the Planning Commission. This can be done concurrently with the presentation of the landscaping and drainage plans. -3- DIVISIONS OF LAND: PARKSIDE SUBDIVISION cont'd.: Check List continued: D. PATHS: I. The usual path built to Town Standards, wandering through the right- of-way, shall be substituted for the path adjacent to the road as shown in the typical sections for Byrne Park Lane and Upper and Lower Park Way. 2. A bicycle path shall be constructed along Altamont Road frontage. 3. The crossing from Lower Park Way to Upper Park Way and/or Byrne Park shall be provided at a place which is level and is visible for a safe distance. The side slopes on all paths must be such that the path is usable. Proper drainage and erosion control shall be provided for all paths within the subdivision. 4. A path paved to Town Standards and a standard pedestrian foot- bridge, if necessary, shall be provided from the easterly boundary at Moody Road to Moody Court; crossing the path corridor along the southerly boundary of the subdivision and continuing along the southerly property line of lots #37, 44, 43, 42, 41, 40 and into lot #39, if necessary. 5. If lots #40 and 39 are developed, the path should be placed between Adobe Creek and Moody Court. If Moody Court is improved, space should be provided for a path with adequate tread and clearance for horseback riders within the road and/or the drainage assessment from lot #41 to Byrne Park. 6. The following 10' path easements shall be deeded to the Town: a) Between lots #14 and 15; b) Between lots # 3 and 4; c) Between lots #13 and 11 on northerly side of driveway; d) Between lots #20 and 21; e) Between lots # 7 and 8 and thence southerly along the easterly boundary of lots #8 and 9; f) Between lots #17 and 18 and along the southerly boundary of lots #18 and 19. All path easements shall be brushed out and cleared for a path with a 4' tread, 10' height, 8-10' lateral clearance and shall not exceed a grade of 15%. E. TRAFFIC SIGNS: 1. Stop Signs - as required by City Engineer. 2. Stop Bar - as required by City Engineer. 3. Street Name Signs - as required by City Engineer. 4. Other signs - as required by City Engineer. F. UTILITIES: 1. All utilities are to be underground. (( G. DEDICATION: �/ 1. As indicated and approved on Tentative Map. H H. OTHER APPROVALS REQUIRED: 1. Town Engineer. 2. Fire District. 3. Santa Clara County Health Department. 4. Purissima Hills County Water District. S� 4 DIVISIONS OF LAND: PARKSIDE SUBDIVISION cont'd.: Check List continued: I. ADDITIONAL CONDITIONS: 1. Sanitary Sewer and Drainage Easements as required by City Engineer. 2. Planting on all cut and fill slopes for erosion control. 3. All grading and filling to be sculptured or contour graded, as well as planted. 4. Drive access on all panhandle lots must be graded at the time of construction of subdivision improvements. 5. A soil and geological report satisfactory to the Town Engineer is to be prepared, prior to filing of Final Map. 6. The lot line between lots #9 and 10 shall be straightened to allow improved access and the lot line of lot #27 shall be adjusted to more closely follow existing contours. 7. A Conditional Exception to Ordinance No. 69, Section 6:20 (C) is approved allowing the maximum.lepgth of the cul-de-sac to exceed 850'. 8. A Conditional Exception to Ordinance No. 69, Section 6:10 is approved allowing approval of the subdivision at this time without deeded and improved free access thereto from a public road. 9. The approval of lots #37 through 44 is based upon information supplied on the Tentative Map. Prior to filing the Final Map, the area shall be surveyed and improvement plans shall be sub- mitted for the private roads, improvement of drainage channels, and demonstrating the feasibility of driveway access to all lots. These plans shall be satisfactory to the Town Engineer. If the Planning Commission finds that the survey shows the terrain to be significantly different from the portrayal of the Tentative Map, the Commission may elect to reconsider the approval of the portion of the Tentative Map covering said lots.a In addition to the Check List, Commission concurred as follows: 1) The Path Committee recommendations for the proposed corridor should be incorporated into the Master Path Plan, even though they are not responsi- bilities of this subdivision. 2) The possibility of shortening the cul-de-sacs by using private roads for the last five lots to be served should be investigated. Mr. M. Boissevain, Mrs. Fava and Mr. Gene Smith commented on the completed Check List in regard to objections previously raised. Commission concurred that the primary objection remaining, the possibility of Moody Court becoming a through road, could not be resolved until the legal status of Moody Court was determined. MOTION, SECONDED AND CARRIED: Commissioner Hibner moved, seconded by Lachenbruch and carried unanimously, that the Alternate Tentative Map of Parkside Subdivision (351-68), 44 lots, dated November 22, 1968, be approved in accordance with the conditions of the Check List. 4WThere being no further business to come before the Planning Commission, Chairman Hinckley adjourned the meeting at 11:33 P.
