RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS
TO VACATE SUMMARILY THE SANITARY SEWER EASEMENT
ON LANDS OF SISSU,L.P., a CALIFORNIA LIMITED PARTNERSHIP
WHEREAS, for the benefit of the general public, a sanitary sewer easement
("Original Easement")was dedicated and accepted by the Town on Lots No. 1, 2 and 5 of
Tract No. 8721 ("Property")per Parcel Map 4526 and E522 or 436; and
WHEREAS, SISSU, L.P., a California Limited Partnership, the current owner of
the Property ("Owner"), has requested that a portion of the Original Easement as shown
on said Tract No. 8721 as "portion of 10' sanitary sewer easement per PM 4526 and E522
or 436 to be abandoned by Town upon relocation of sewer main" ("Portion of Easement")
be vacated because it has been superseded by relocation;'and
WHEREAS, 'previously, the Owners granted to the Town a new sanitary'sewer
easement over the Property ("New Easement") per Tract No: 8721 which was recorded in
Santa Clara County in Book 682 at Pages 8, 9 and 10 on September 24, 1996, which offer
was accepted by the Town at that time; and
WHEREAS, subdivision improvements for said Tract, including the relocation of
the sewer main, were accepted by the City Council on August 21, 1996, as complete; and
WHEREAS, the City Council of the Town now desires summarily to vacate the
Portion of Easement;
NOW, THEREFORE, the City Council of the Town does RESOLVE as
follows:
1. The City Council of the Town, pursuant to California Streets and Highways
Code, Division 9, Chapter 4, Section 8333, et seq., hereby vacates the Portion
of Easement and finds that the Portion of Easement has been superseded by
relocation and no public facilities are located within the easement.
2. The Portion of Easement to be vacated is shown on Tract No. 8721 as "portion
of 10' sanitary sewer easement per PM 4526'and'E522 or 436 to be-abandoned
by Town upon relocation of sewer main". A copy of that portion of the Map
indicating the Portion ofEasenient is attached hereto as Exhibit A.

3. From and after the date this resolution is recorded in the Santa Clara County
Recorder's Office, the Portion of Easement shall no longer constitute a public
easement.
PASSED AND ADOPTED this 5th day of February , 1997.
