HomeMy WebLinkAbout07/13/1970PLANNING COMMISSION TOWN OF LOS ALTOS HILLS 06 MINUTES OF A REGULAR MEETING July 13, 1970 Vice -Chairman Wm. A. Perkins called the Regular Meeting of the Planning Commission of the Town of LOS Altos Hills to order at 7:48 P. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. The following members answered roll call: Present: Commissioners Corbet, Hibner, Lachenbruch, McReynolds, Perkins, and Spencer. Absent: Chairman Weisbart. COUNCIL REPRESENTATIVE: Councilman Mary C. Davey. APPROVAL OF MINUTES: June 22, 1970. Commissioner Spencer moved, seconded by Corbett and carried unanimously, that the Minutes of June 22, 1970 be approved as written. COMMUNICATIONS: 1. Letter from Mrs. E. Dana requesting action be taken to prevent cutting of larger trees. City Manager reported the City Council had requested the Tree Committee to review the request, but they in turn referred it to the Planning Commission for study and recommendation. Johnson of the Purissima Hills County Water 40 District advised the City Council that action to alleviate the erosion problem above Moody Court would be resolved within sixty days. COMMITTEE REPORTS: 1. Commissioner Perkins reported on Livingston & Blaney presentation at Palo Alto. 2. Commissioner Spencer stated Palo Alto had prepared a report, which proposed a cooperative Foothill Area Fire District. DIVISIONS OF LAND: TENTATIVE MAPS: 1. LANDS OF SMARR (372-70) 1 lot (elimination of lot line) 1.85 acres, located at 12581 Miraloma Way. Staff stated Mr. Snaxr was requesting the removal of the lot line between his two parcels so that it could be considered a single building site. The applicant anticipated no change in the use of his property, which is a single family residence with a guest house. It was noted that the present rental of the guest house would have to be abandoned in January 1976 as a non -conforming use per Ordinance No. 78. MOTION, SECONDED AND CARRIED: Commissioner Lachenbruch moved, seconded by Spencer and carried unanimously, that the Tentative Map of Lands of Snarr (372-70) 1 lot, Mixaloma Way, be recommended for approval subject to the conditions of the Check List dated July 13, 1970. 2. LANDS OF ESHNER (369-70) 15 lots, Altamont Road, Tentative Map. Engr. M. W. Wolff. Commissioner Corbett moved consideration of the Tentative Map for Lands of Eshner be denied on the basis of not meeting the intent of a 1968 covenant. (This pertained to an agreement, wherein the Eshners had expressed their agreement to not subdivide the approximate 35 acres contained in Parcel #1 and #2 into more than sixteen building sites "and neither said sites nor any portion of the subject properties shall be divided further into additional building sites" except by written approval of the Town.) Commissioner Corbett noted that he had researched the tapes of the Minutes when Sewer Assessment District No. 2 assessments were being drawn up and found that Eshner did not want to be taxed for a potential 22 sites, but rather only 16, as that was all he intended to create. Speaking from the Floor, Mr. J. Eshner stated he never intended to subdivide beyond this section nor does he ever intend to come before the Commission and request the present status be changed. Other speakers from the Floor included Messrs. G. Ferrari and R. C. Cheney. Commission discussion ensued and it was noted that the Town legal counsel stated the proposed Tentative Map of Mr. Eshner would not violate this covenant. The Motion by Commissioner Corbett and seconded by McReynolds to deny consideration of this Tentative Map died for lack of a majority vote when called to the question. Commissioners Corbett, McReynolds and Spencer voting yes; Commissioners Hibner, Lachenbruch and Perkins voting No. (Chairman Weisbart was absent.) Staff reviewed that this item had been continued from the May 11, 1970 meeting and presented the following new information: (1) Revised slope density calculations from the City Engineer. (2) Re -arrangement of the first five lots near Altamont Road, changing the lot designs and ending up with four lots, was proposed. Staff presented a sketch which illustrated this proposed change would make the remaining four lots more desirable, as well as place the existing water easement along lot lines, rather than transversing two of the building sites. Commission discussion questioned the proposed realignment of the lots, which would narrow lot #1 to the point it could not contain a 160, diameter circle. Mr. Eshner then proposed the Commission reconsider the original 15 lot map and proposed the high and lav pressure water lines crossing lots #1 and #2 be relocated within the new street. Commissioner Lachenbruch suggested a consideration on the alternate proposal, whereby one lot was eliminated, that the road could be relocated to allow the water easements to fall within the required 40' setback. Speaking from the Floor were Messrs. A. M. Laws and S. French expressing their desire that a path be provided along Altamont. Staff noted that this could be incorporated when Altamont is resurfaced to Natoma. Mr. Eshner stated the location of Altamont Road transgressed his property line in some areas and he would not be receptive to further dedication of pathway land nor removal of his chain link fence. -2- 4 SUBDIVISION OF LAND: Eshner cont'd.: MOTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Hibner and carried unanimously by voice vote, that the Tentative Map for Lands of Eshner be returned to the applicant without prejudice to allow re- submittal of a revised Tentative Map and that the matter be continued to the July 21, 1970 meeting. RECESS: 9:50 - 10:00 P. M. 3. Mr. HELEN TENTATIVE MAP (366-69) and USE PERMIT OF DAUGHTERS OF CHARITY (UP -340-70) ALTAMONT ROAD. ENGR. RILEY & CUFFE. A. USE PERMIT - City Manager stated the Daughters of Charity were requesting a change to their Use Permit to allow 16 instead of 10 resident Staff. The Commission concurred this request was reasonable. MOTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Hibner and carried by unanimous voice vote to recommend that Paragraph 2 of the Use Permit for Daughtexs of Charity (UP -340-70) show the resident Staff will be limited to 16 persons. Commission discussion centered around retention of open space. The Commission agreed to incorporate into the Use Permit that it's recommendation fox approval was conditioned on retention of essentially the open space shown on the plot plan dated February 13, 1970. 40 hDTION, SECONDED AND CARRIED: Commissioner Lachenbruch moved, seconded by Hibnex and carried unanimously to recommend approval of the Use Permit for Daughters of Charity of St. Vincent de Paul (UP -340-70) dated June 8, 1970, as amended July 13, 1970. B. TENTATIVE MAP - Mr. HELEN (366-69) - Discussion of the Check List had been continued from the June 8th meeting, because the location of pathways required additional study. Following discussion of the meandering trail along Altamont Road, the Commission concurred that the Site Development Committee with Pathway Committee representation could develop a meandering path, so that it would be located behind the first tree wherever possible. After various proposals were made for the location of the pathway from Moody to Altamont, it was agreed that it should extend along the borders of the Lands of Martinelli, Deckert and Benjamin to contour line 690 and then amble above the old quarry and south of the barn to the 40' right of way leading into Altamont. Both pathways were restricted to pedestrian and equestrian traffic only. MOTION, SECONDED AND CARRIED: Commissioner Lachenbruch moved, seconded by Hibner and carried unanimously, that the Tentative Map of Mt. Helen (Daughters of Charity of St. Vincent de Paul) (366-69) 2 lots, Altamont Road, be recommended for approval, subject to the conditions of the Check List dated July 13, 1970. -3- 4. PARKSIDE UNITS #2 and #3 (351-68) Engr. Sandia & Associates: 040 Due to the late hour, the Commission rescheduled this discussion to a Special Adjourned Meeting for July 21st at 7:45 P. M.
