HomeMy WebLinkAbout09/14/1970C19 PLANNING COMMISSION TOWN OF LOS ALTOS HILLS MINUTES OF A REGULAR MEETING September 14, 1970 Chairman Weisbart called the Regular Meeting of the Planning Commission of the Town of Los Altos Hills to order at 7:52 P. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. The following members answered roll call: Present: Commissioners Corbett, Hibner, Lachenbruch, Perkins, Spencer and Chairman Weisbart. Absent: Commissioner McReynolds. COUNCIL REPRESENTATIVE: Councilman Mary Davey. APPROVAL OF MINUTES: August 10, 1970 Commissioner Perkins moved, seconded by Lachenbruch and carried unanimously that the minutes of August 10, 1970, be approved as written. APPROVAL OF MINUTES: August 24, 1970 Commissioner Perkins moved, seconded by Corbett and carried unanimously that the minutes of August 24, 1970 be approved with the following amendment: Page 2, Old Business, Item $2, Paragraph 6, first sentence should read: The question was posed as to how the amount of in -lieu path fees could now be determined since the cost varied with the quality of paths desired and'bhe consensus was that the payment be 100% of the estimate for the path specified". 1. Staff advised of a letter from Mr. Alan Lambert to the Council which they had referred to the Planning Commission. Mr. Lambert requested changes to the Final Map for Monte Lucero Unit H3. The Commission agreed to agenda this matter later in the meeting. OLD BUSINESS: 1. MUNOZ. 80I RT M. (V-343-70) Variance request for reduction of front setback from 40' to 16'.6 for garage addition at 13460 Robleda Road. Continued. Staff reviewed the variance application of Mr. Munoz who had applied for a variance to allow him to locate his garage within 1611' of a public easement line. This matter was considered on June B, 1970 by the Planning Commission and the action taken was to reschedule this matter for further consideration within three months due to pending litigation on abandonment of an easement. The litigation to determine the status of the S' right-of-way easement between his property and Burke Road was still in process and Mr. Munoz stated that this may not be solved for some time. He, therefore, asked the Planning Commission to take action on his request for a variance for his garage. He further stated that he preferred his garage set as originally requested, but he would be willing to move it back even with the front of his house, if absolutely necessary. OLD BUSINESS: Munoz, Robert M. (V-343-10) Cont'd. Staff recommended that the garage be allowed to be built even with the front of his house, thus granting Mr. Munoz a reduction in setback from 40' to 33'1'. Floor participation included Mrs. J. Holly, 13454 Robleda Road, Mrs. D. Everingham, 25620 Burke Lane, Mrs. H. Williams, 25611 Burke Lane, and Mr. A. McDonald, 25621 Burke Lane. All opposed locating the garage 16V.' from the easement. Commission consensus was to favor a slight variance rather than deny Mr. Munoz a garage. MOTION, SECONDED AND CARRIED: Commissioner Hibner moved, seconded by Perkins and carried unanimously that the proposed variance for R. M. Munoz (V-343-70) from 40' to 16V be denied but that the alternate proposed variance to allow a 33Vi setback from the easement line (whereby the front of the garage would be flush with the house) be approved in accordance with the six criteria of Section 13:60 of Ordinance No. 78 as amended. DIVISIONS OF LAND: Tentative Maps: 1. RHOS RIDGE RANCHOS UNITS 112 and 113 (357-69) Revised Tentative Map from 12 to 8 lots, 23.8 acres, with access from Summitwood Road. Engr. Geo. S. Nolte. Staff stated the applicant wished to amend his approved Tentative Map, dated July 11, 1968, by reducing the number of lots and making certain other changes. Also, approximately seven acres along Adobe Creek was offered to the Town of Los Altos Hills for open space. Mr. Mader noted the revised Tentative Map was significantly different from that originally approved. In addition to the open space offer, the number of lots was reduced from 12 to 8 and those lots served e by Peck and Rhus Ridge Roads were reduced from 12 to 2. The proposed private road r to serve six lots of this subdivision (Bassett Road) would connect to Summitwood (also a private road) rather than Rhus Ridge as originally proposed. No objections were noted to the amendments proposed to the original Pathway recommendations. Speaking from the Floor for the applicants, Bassett Associates, Mr. Dan Dana noted that he had been pursuing the improvement and dedication of that and of Summitwood Road from Taps Way to Bassett Road with the intent that that portion of this private road be upgraded to a public road. He stated he could probably accomplish this and thus provide a public road (at his expense) up to Bassett Road. It was noted that a conditional exception to Section 6:20D of Ordinance No. 69 would be required to allow Bassett Road to serve those six lots of the proposed subdivision. This would not be required if Summitwood Road were extended and a turnaround installed that would provide access to lots #1 and V. However, this possibility was questioned, since the turnaround would have to be located either in a natural drainage channel or on a steep hillside. Another conditional exception to Ordinance No. 69 would be to allow lots #4 and #8 to be served from Peck/Rhus Ridge Roads, since these private roads would be in excess of 850' (Section 6:20C) and would be serving more than 5 lots (Section 6:20D). Residents on Summitwood Road (but living above that section proposed to be improved) voiced opposition to improving half of this private road to a public road. Since they maintained the upper portion of this private road, they felt this would increase their maintenance costs. Those neighbors voicing objection included Mrs. F. Hoecke, 11499 Summitwood Road, Mrs. R. Whitmer, 11275 Summitwood Road and Mr. J. Heitel, 11523 Summitwood Road. Mr. Dana noted the traffic generated onto and off Bassett Road would traverse over Summitwood Road to Tepa Way over that section of the road he proposed to improve at his own expense. Commission discussion ensued and it was proposed that the City Engineer determine the coat to improve the balance of Summitwood Road (above that section proposed to be improved by the applicant) to public road standards. The applicant's generous offer of open space proposed was commended by the Commission and felt to warrant this cost study. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Hibner and carried unanimously that the revised Tentative Map for Rhus Ridge Ranchos Units 112 and 113 (357-69) be continued to September 28 to allow further study of improving Summitwood Road in entirety. OTHER BUSINES BY PLANNING COMMISSIONERS: 1. Request for a change in Tentative Map for Monte Lucero, Unit 113. Staff stated this request to the Council had been referred to the Planning Commission for their recommendation. Mr. Lambert asked approval of the Final Map for Monte Lucero, Unit 43 (five lot subdivision off Natoma Road): 4W a. With the cul-de-sac name changed from Murietta Lane to Lucero Lane. b. Changing the status of this public road to a private road. Commission discussion noted no objection to the street name change but favored a 40' right-of-way. MOTION, SECONDED AND CARRIED: Commissioner Hibner moved, seconded by Corbett and carried unanimously to recommend the approval of the proposed name change to Lucero Lane, subject to the conditions of the Fire Department's memorandum dated September 3, 1970. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Hibner and carried unanimously to recommend that approval of this Final Map be conditioned upon dedication of the path easement shown on the Tentative Map for Monte Lucero Unit 02 between lots 83 and 114 (but omitted from the Final Map of Monte Lucero Unit #2), so that path continuity will result from Monte Lucero Unit #3 through Unit 112 and connect to Rosehill Estates R2.
