RESOLUTION 22-13
RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS ACCEPTING
GRANT OF PUBLIC STORM DRAIN EASEMENT
(Lands of DJNH)
WHEREAS, DJNH, LLC ("Owners"), are the owners of the property commonly known as
26420 Eshner Court, Los Altos Hills, California; and
WHEREAS, Owners have offered to grant to the Town the easement for the construction,
operation and maintenance of existing and future storm drain facilities, for general public use
("Public Storm Drain Easement"); and
WHEREAS, the City Council has determined it is necessary and proper and in the public
interest to accept the grant of the Public Storm Drain Easement;
NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as
follows:
Section 1. The Town hereby accepts on behalf of the public, and for the purposes therein
described, the Grant of Public Storm Drain Easement attached to this Resolution as Attachment
1.
Section 2. The Town shall accept, and the Mayor is hereby authorized and directed to
execute, the Grant of Public Storm Drain Easement.
The above and foregoing resolution was passed and adopted by the City Council of the Town of
Los Altos Hills at a regular meeting held on the 18th day of April, 2013 by the following vote:
AYES: Waldeck, Corrigan, Harpootlian, Radford, Larsen

GRANT OF PUBLIC STORM DRAIN EASEMENT
TO THE TOWN OF LOS ALTOS HILLS
(Lands of DJNH, LLC)
THIS GRANT OF EASEMENT is made this flday of' /I / , 2013, by
DJNH, LLC, a California, limited liability company ("Owner"), owner of the property
commonly known as 26420 Eshner Court, Los Altos Hills, California(the "Property"), to and
for the benefit of the Town of Los Altos Hills,a municipal corporation ("Town").
Section 1. Owner hereby grants to Town a"nonexclusive easement for the
construction, operation, and maintenance of Town's existing and future storm drain system
serving existing and future streets within the vicinity of the Property, together with a right of
reasonable access thereto, on, under, over, along and through the portion of the Property
described and depicted in Exhibit A attached hereto and incorporated herein (the "Easement
Area").
Section 2. Owner shall not allow the placement or construction of any structures,
improvements, or landscaping on the Easement Area that would unreasonably interfere with
Town's rights hereunder. Owner must obtain consent from Town prior to placing any
structures, improvements, or landscaping on the Easement Area that could unreasonably (a)
interfere with or damage the storm drain system in the Easement Area or (b) interfere with
Town's access rights to the Easement Area as reasonablydetermined by the Town.
Section 3. Except in case of emergency, Town shall use reasonable efforts to give
reasonable prior notice to Owner as is practicable under the circumstances regarding any
proposed entry onto the Property to perform work in the Easement Area. All such work
(other than emergency repairs) shall be performed during ordinary working hours in a
professional manner, and so as to minimize inconvenience to Owner.
Section 4. The Town hereby accepts'this grant of easement on the terms herein
stated.

All that certain real property in the City of the Town of Los Altos Hills, County of Santa
Clara, State of California, described as follows:
Being a portion of Parcel 4, as shown on that certain Parcel Map, which was filed for
record on December 30, 1998, in Book 711 of Maps, at Pages 49 and 50, Santa Clara
County Records,which is more particularly described as follows:
Beginning at the most northerly corner of said Parcel 4, said angle point being at the
most.northerly terminus of the boundary-line described as North 17°5813" East, 276.23
feet, said point being on the southwesterly boundary of Altamont Road, thence, along
the northeasterly boundary of said Parcel 4, South 84°59'56" East, 20.52 feet to the
