HomeMy WebLinkAbout03/08/1971PLANNING COMMISSION TOWN OF LOS ALTOS HILLS MINUTES OF A REGULAR MEETING March 8, 1971 Chairman Priscilla R. Weisbart called the Regular Meeting of the Planning Commission of the Town of Los Altos Hills to order at 7:46 A. M. at the Town Rall, 26379 Fremont Road, Los Altos Rills, California. The following members answered roll call: Present: Commissioners Lachenbruch, Magruder, Perkins, Spencer and Chairman Wefsbart. Absent: Commissioner McReynolds. APPROVAL OF MINUTES: February 22, 1971 Commissioner Perkins moved, seconded by Spencer and carried unanimously that the minutes of February 22, 1971 be approved with the following correction on Page 2: revise last sentence of the last paragraph under Lands of Wheeler, Tentative Map. to read: "Commission concurred that since the appendage off Central Drive is not a part of Central Drive that it should require a road maintenance agreement separate from that requested for Central Drive. DIVISIONS OF LAND: Tentative Maps or 1. Steers, J. D. (373-70), 7 lots, 13.52 acres, located between Central Drive and Buena Vista Drive. Engineer Saudis & Associates. Mr. T. W. Vian, attorney for the applicant, requested that consideration of this subdivision be continued to allow a proper review and analysis of the soils problems posed by the Town retained geologist, Mr. Arvid Johnson, in order to determine whether re-engineering of this subdivision will be required. The Commission discussion that ensued noted that in addition to the soils problem, the map submitted did not contain the previously requested items (see minutes of 2-22-71) and that as currently submitted, it was inadequate and incorrect. Mr. Mader suggested that Mr. Johnson be contacted to ascertain his suggestions as to what the soils report should contain. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Spencer and carried unanimously that the Tentative Map of J. D. Steers (373-70) be continued until April 12, 1971, providing that the revised map is submitted by March 29, 1971 so that it may adequately be reviewed by Staff and be forwarded to the Commission no later than April 5 for the Commission's review. Commission discussion noted that they desired more time to allow for their "homework" and meeting preparation. MOTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Perkins and carried unanimously that whenever any item is continued to a future agenda, that the applicant must submit the required supporting data for this subject 14 days L prior to the date agended in order that Staff may adequately review and have it in the mail to the Commissioners on the Monday preceding the meeting. (This motion in effect entails an automatic minimum 30 days for any continuance.) -1- 40. OLD BUSINESS: 1, Recommendations re: Williamson Act Staff noted that the Commissions recommendations regarding the Williamson Act as it pertained to modification of the Portola Valley's resolution had been reviewed by the City Attorney. Mr. Faisant's comments were reviewed by the Commission. MOTION. SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Magruder and carried unanimously that it be recommended to the Council that one method of providing term open space is to invoke the Williamson Act with the concept of embracing all of the Town of Los Altos Hills under this Act; that the recommended revisions and amendments to the Portola Valley resolution as proposed by the Planning Commission and modified by the City Attorney be incorporated into an appropriate resolution of the Town to further this intent; and that the criteria for eligibility under the Act, allow inclusion only of those parcels yet sub - dividable or yet unimproved in accordance with current Town zoning ordinances. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Spencer and carried unanimously that it be recommended to the Council that the City Attorney be requested to draft the desired terminology that would serve as an appropriate instrument to execute the Town's intended contractual requirements with those wishing to contract their lands under the Williamson Act, Additional Commission discussion evolved around an alternative method of obtaining temporary open space through the use of an "open space easement". This vehicle entailed a minimum term of 20 years, but it was noted that the abandonment guide- lines could perhaps be more enticing to prospective applicants since the "buy out" terms were more lenient than those under the Williamson Act. MOTION, SECONDED AND CARRIED: Chairman Weisbart moved, seconded by Magruder and carried unanimously that the Council be requested to direct the City Attorney to provide an interpretation of Chapter 6.5 of the Government Code as it pertains to open space easements to enable the Planning Commission to proceed with their study of this additional means of retaining temporary open space and an alternative approach'to the Williamson Act. OTHER BUSINESS: 1. Referring to the Stanford Land Use recommendations, Mr. Mader suggested that the Commission carefully review this material to apprise the Council of its implications, especially in view of its impact upon Arastradero Road. He noted the cover letter from Mr. Cuthbertson solicited responses within 90 days and that it would be appropriate for the Town to reaffirm its previously declared unwilling- ness to participate in, much less support, any widening of Arastradero Road. ADJOURNMENT There being no further business, Chairman Weisbart adjourned the meeting to a study session for review of Zoning Ordinance No. 78 at 10:35 P. M.
