The following members answered roll call: Present: Commissioners Magruder, McReynolds, 11jeller, Perkins, Spencer, h and Chairman Weisbart, Absent: None. APPROVAL OF MINUTES: April 12, 1971 Commissioner Spencer moved, seconded by Perkins and carried by majority (Lachenbruch abstaining) that the minutes of April 12, 1971 be approved with the following corrections: A. One Page 1 under "Committee Reports" delete the word "opposing" and insert "regarding'.' To the end of this sentence add "and noted that only a part of it was conditionally endorsed." B. Under Building Site Approval of Lee Thurlow delete the balance of the first sentence after the word i'Incorporation". C. On Page 5 after the first sentence of paragraph four under "Almond Estates" insert: Chairman Weisbart and Commissioner Perkins strenuously objected to inclusion of parcel "C" for elope density purposes". D. On Page 6 add to "motion" above "Adjournment": "but urged that the Town Council place the entire Town into the Preserve". COMMITTEE REPORTS: Commissioner Spencer reported on additional discussion by the Pathway Committee on the Bike Plan. VARIANCES: 1. Shea, John (V-353-71) - Request for reduction in side setback to 20 for new residence at the end of Aric Lane. USE PERMITS: 1. Bessenyey, Margit S. (DP -351-71) Request for Use Permit for riding schoolat 27240 Altamont Road (Westwind Farm). Buyer's Agent: Robert D. Mackinzie. Staff reported that the applicant wished to continue the general use of this property and thus required a use permit since the permit issued to Robert D. Clement expires when the property is sold. The proposed use permit conditions were revewed by AltamontiRoad and Mr. C- E E, Sporcletters k, 27241rom eAltamont Road, were MacLeod, 27350 ad. Floor participation included: Mrs. MacLeod; Mrs. J. D. Steers, 11641 Buena Vista; and representatives of the applicant, Mr. R. D. Mackinzie, Miss Linda Tellington and Mr. Earl Jones of Badger, California. The applicant's representatives indicated their willingness to comply with the neighbors and the Town's wishes. They outlined their intentions to improve the visual impression of the premises through additional landscaping and by removal of various existing equipment and structures. Road changes were planned to minimize dust problems. They also agreed to not utilize loudspeakers or floodlights on the premises for training purposes. Fawler, Lands of (376-71) 3 lots, Roble Alto Court, 5+ acres. Engt. J. Clegg. City Manager reviewed that this property, surrounded on three sides by Land Resources Coporation, is provided access through their pending subdivision, Matadero Oaks, and reviewed the proposed check list. Commission discussion noted that Lot C should not have direct access to Mirmirou and added this requirement to the check list. MOTION, SECONDED AND CARRIED: Commissioner Lachenbruch moved, seconded by Spencer and carried unanimously that the Tentative Map (376-71) Lands of Fowler, be recommended to the Council for approval in accordance with the check list dated May 10, 1971. PI 2. Inness, Lands of (379-71) 2 lots, 2.4 net acre, corner of Altamont and Page Mill Roads. Engr. M. W. Wolff. Staff noted that this property near Altamont and Page Mill Roads contains 2.4 net acres; that the applicant wished to subdivide into two building sites, and therefore a Conditional Exception was requested because slope density requires 2.5 acres and there are only 2.4 acres. Commission discussion amended the check list to clarify the conditional exception permitting the 1/10 acre variation in lot size required by slope density. It was noted that the variation of 1/10 acre is very small and that the 2.4 acre parcel was created in 1957 which predated the Slope Density Ordinances No. 149 and 150. Also, this parcel was a very small part of that transaction.
