C.3 Side 2 Track 1 00 - 980 Chairman McReynolds called the Regular Meeting of the Planning Commission of the Town of Los Altos Hills to order at 7:51 P.M. at the Town Mall, 26379 Fremont Road, Los Altos Hills, California. The following members answered roll call: Commi.ssioner� Lachenbruch, Magruder, Mueller, Perkins, Spencer and Chairman McReynolds. Absent: Commissioner Weisbart. APPROVAL OF MINUTES: July 12, 1971 Commissioner Perkins moved, seconded by Spencer and carried unanimously that the minutes of July 12, 1971 be approved with the following addition on page 3, under "Other Business by Planning Commissioners" add to the second paragraph, "Mr. and Mrs. Don Spencer and Mrs. Millie Saviano." Committee Reports: Commissioner Spencer reported on the items discussed at the July 27, 1971 Pathway ` Committee meeting. �r NOTE: TO PROVIDE CONTINUITY WITH THE AGENDA, THESE MINUTES ARE NOT LISTED IN THE Miji ENCE DISCUSSED. USE PERMITS: LOND,' DONALD D. (UP -354-71) - Request for Use Permit for Boarding Stable at 25720 Altamont Road (Altamont Stables). This item was continued from the last meeting, due to the lack of a quorum after Chairman McReynolds had disqualified himself. Staff reviewed the previous dis- cussion and the letters of protest received and noted that since the City Council did not adopt the moratorium ordinance on commercial stables, the Commission could take whatever action deemed proper. In the absence of Vice Chairman Weisbart, Commissioner Spencer assumed the chair, since Chairman McReynolds abstained from participation in the discussion and voting. Floor comments were heard from Mr. Don Long, former owner of Altamont Stables, Mr. Burton Elias (new owner) and Mrs. June McIlimaith, 13431 Wildcrest Drive. Commission discussion evolved around the proposed conditions of the Use Permit. The Commission concurred to add that the aluminum roofed structures should be painted a non -reflective color, stabling of 27 horses was considered reasonable based upon the past history of this operation, installation of a Type I -A path along Altamont Road was required, and outdoor lighting will be shielded. The con- dition requiring annual review of the Use Permit was elaborated upon to assure clarity of intent. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Lachenbruch and carried by majority vote to approve the Use Permit (IIP 354-71) for Burton Elias (Altamont Stables) for a boarding stable at 25720 Altamont Road in accordance with the conditions of approval dated August 9, 1971, DMSIONS.. OF LAND: Tentative Maps: 1. ARCHIBALD, DENNIS J. (381-71) 3 lots, 4. 27 net acres, located at corner of Hillview Drive and Magdalena Road. Engr. J. W. Riley. This item was continued to the August 23, 1971 meeting at request of the applicant. 2. PROZINSKI, CLAUDE A. (110-2-71) - Lot line change, Rhoda Drive and Puris6ima Road. Due to the late hour, the Commission concurred to continue this item to the August 23, 1971 meeting. NEW BUSINESS: 1. Referral from City Council: Review of Ordinance #179 (Horse ordinance). 2. Referral from City Council: Consider change in Ordinance 078 (Zoning Ordinance). Because of the inter-relation of these two items which pertain to horses, discussion was combined. Staff reviewed that Ordinance #179 had been referred to the Commission by the Council for study and recommendations by October 18, 1971, since it had been suggested that a careful review and perhaps some amendments were warranted based upon citizen protests of recent applications for commercial stable Use Permits. It was noted that a proposed 90 day moratorium on the granting of Use Permits for Commercial stables had been tabled by the Council in lieu of this pending review of Ordinance #179 and consideration of proposed Ordinance #189, which would amend the Zoning Ordinance aY78 to make commercial stables, conditional uses and thus remove their operation from allowed uses under current zoning as an agricultural pursuit. Reference Subsection 2:10 (2) of Ordinance §78 as amended, under proposed Ordinance #189 would read: "2. 'Agriculture' includes animal husbandry, livestock farming, flower grow- ing, crop and tree farming, and viticulture, but not commercial stables." A new subsection 2:10 (24a) would be added that would read: 1124a 'StableCommercial'. Any establishment regularly providing services for the keeping and/or use of horses, otherthan for private use, including but not limited to bonrding st^bloe, riding schools, -cad ;tablet and corrals to 'accommodate horses belonging to clubs or organizations or members thereof." Letters were read from Mr. Wallace Stegner, 13456 South Fork lane; Ms. Grace H. Brill and Elizabeth B. Hill of 13351 Lenox Way; Mr. S. G; Whittelsey Jr., President of Los Altos Hills Horsemen's Association and Mrs. Marie Graver, 26351 Esperarza Drive opposing further restrictions upon horses by the Teem. Letter from Mr. M. J. Brown 12670 Dianne Drive, offered specific recommendations for amendment of Ordinances #78 and #179. -2- Floor comments were heard from Mrs. Millie Saviano, 12620 Corte Madera Lane; Mrs. Diana Miller, 13076 Vista del Valle Court; Mr. A. M. Laws, 11210 Hooper Lane; Mr. Maxfield Brown, 12670 Dianne Drive, and Mr. Don Long. Lengthy Commission discussion included a review of original draft preparation and finalization of Ordinance #179, possible areas of weakness that have arisen in its application and the desirability of proposed Ordinance #189. Staff was requested to obtain legal clarification as to the options available to the Commission in re- commending restraints upon the Applicant's Use Permit and to what degree these con- ditions can be amended at the end of each year. The Commission noted that since objective rules were not available for application to all situations, they were required, after an in-depth study of an applicant's request to use their best judg- ment within the framework of the Conditional Use Permit procedure as spelled out in Section 13:60 of Ordinance #78. Then after a year, when the Use Permit was up for annual review, changes may be found to be necessary. Thus the City Attorney was requested to define those conditions under which the Use Permit could be amended and the legal ramifications of "vested interest" as in the case of ownership change. Commissioner McReynolds appointed a sub committee composed of Commissioners Magruder and Spencer to meet with Staff and study this problem, draw upon citizens comments and report back to the Planning Commission with their findings in time for the Planning Commission to forward a recommendation to the Council by October 18, 1971, 3. Consider Rezoning Certain Public -owned Lands to OSR (Open Space Reserve) to Commission concurred to continue this item to the August 23, 1971 meeting. 4. Review proposed road work at Page Mill and Arastradero Roads. Commission concurred to continue this item to the August 23, 1971 meeting.
