PLANNING COMMISSION TCWN OF LOS ALTOS HILLS MINUTES OF A REGULAR MEETING November 8, 1971 REEL PC 5 Side 1 Track 1 00 -End Side 2 Track 1 00.350 Chairman McReynolds called the Regular Meeting of the Planning Commission of the Town of Los Alta Hills to order at 7:48 P.M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. The following members answered roll calls Commissioners Lachenbruch, Perkins, Spencer, Chairman McReynolds, Absent: Commissioners Magruder, Mueller and Weisbart. APPROVAL Cr,, Approval of the minutes of October 26, 1971 was con- t u to t e Nov er 220 1971 meeting, since of the four commissioners present, two were absent from the October 26th meeting. CONNUNICATIONS: lin -s arse of 10/28/71 meeting of PPC were, distributed. 2. Commissioner Perkins submitted written comments re: Proposed Antenna ordinance. i COMMITTEE REPORTS: Commissioner Spencer reported on the Pathway Committee meeting. 1. TENTATIVE MPP FOR CORBETTA, LOUIS P. (384-71), Altamont Road and Corbetts Lane (3 lots, 6.90 acres). Engr. J. W. Riley. Staff reviewed this request to subdivide 6.9 acres into three building sites and noted that two of the proposed lots will be on Altamont Road and the third lot will contain the existing residence at 12500 Corbetta Lane. The Commission expressed concern for the stability of the property since the existing residence had been built upon a dam and a soils and geologic report had not been submitted with this Tentative Map application. Floor comments were heard from the applicant, Mr. L. P. Corbett& and Pathway Committee Chairman M. Saviano. The Commission concurred with the applicant that credit be allowed for pre- vious path -in -lieu payment against path construction required for this sub- division and that as an additional condition, a report be submitted by a soils engineer or engineering geologist attesting to the design standards for the existing dam and adequacy thereof for expected seismic lading. j MOTIONS SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Lach- W enbruch and carried unanimously to recommend approval to the Council of the Tentative Map of Louis P. Corbetta (384-71) for 3 lot$ in accordance with the check list as amended November 8, 1971. Y 2. TENTATIVE PNP for ARCHIBALD, DENNIS J. (381-71) Magdalena Road and ,60 Hillview Drive (3 lots, 4.27 acres). Engr. J. W. Riley. Staff noted this subdivision had initially been before the Planning Commis- sion in July, 1971, but withdrawn without prejudice at the request of the applicant. This proposal would create three building sites out of 4.27 acres. Staff stated the main problem with this subdivision was that Hale Creek runs through all three building sites. The applicant had received tentative approval from the Santa Clara County Flood Control and Water District for the plan as shown on the revised map dated September 1971. Their approval was conditioned upon dedication of a 601 channel R.O.W. easement being dedicated to the district if the applicant chose to enclose the creek in a pipe as proposed on this map. Access for maintenance to the entrance and exit was required as well as fencing of the easement across lots 2 and 3. The district noted however that they preferred a 70' easement and that the channel be left in its natural state. Commission discussion ensued with floor participation from Mr. J. Riley, the applicants engineer. Reservations were expressed regarding the proposed piping, i.e., possibility of flooding resulting from a plugged culvert and the disruption of the natural terrain by enclosing Hale Creek. In addi- tion, there was an apparent difference in interpretation between the appli- cant and the commission of the Flood Control District's letter as well as a need to clarify the type, height, etc. of the referenced fencing. Due to the creek crossing each of the lots, the Commission also questioned whether SOBS lot line realignment might not improve the building site areas. MOTION, SECONDED AND CARRIBD, Commissioner Perkins moved, seconded by Lachenbruch and carried unanimously to continue the Tentative Map for D. J. Archibald (381-71) for four weeks to allow clarification of the Flood Control Districts$ letter. The applicant concurred. 3. BUILDING SITE APPROVAL FOR CROVL.EY, JERRY (BSA -69-71), Lot M3 Tract #2958, Olive Tree Lane. Engr. R. X. Connelly. Staff reported that this property, located on Northcrest [ane has access from the end of Olive Tree Lane over a 321 wide driveway easement. Since it was created over ten years ago (Olive Tree Hill Subdivision, Tr. M29S8), it requires building site approval. The Town Planner noted that the terrain was extremely steep and that grading would be a problem. He therefore re- commended that a geologic report be submitted for review by the Town Engineer to assure stability of the property prior to issuance of a building permit. The applicant, Mr. Crowley stated that he would obtain a copy of the report prepared by Crosby Associates on the neighboring lot to provide assurance of the site stability. MOTION, SECONDED AND CARRIBDs Commissioner Perkins moved, seconded by Spencer and carried unanimously that Building Site Approval for Mr. J. Crowle (BSA 69-71) be recommended to the Council in accordance with the check list as amended November 8, 1971. 4, BUILDING SITE APPROVAL FOR LOS ALTOS SCHOOL DISTRICT (BSA -70-71), Lots [ M2, 30 and 42 Tract #997, Purissina Hills, located at end of Crescent Lane, Hawley and Peterson, Architects. Staff reviewed this property located at the end of Crescent Lane arced by the Los Altos School District and noted that these three lots were created over ten years ago (Tract #997). Staff recommended that since both residents in the neighborhood and Foothill College students utilised trails traversing these lots that a 301 path easement be provided along lot #4 and that it be fenced along the west side of this path easement to prevent intrusion upon the privacy of the future residents. During the ensuing Commission discussion with floor participation from re- presentatives of the Los Altos School District it was requested that the path be posted at Crescent Lane restricting its use to pedestrians and bicycles only. MOTION, SECONDED AND CARRIED: Commissioner Spencer :roved, seconded by Laohm enbruch and carried unanimously that Buildnng Site Approval for three lots belonging to the Los Altos School District (BSA 70-71) be recommended to the Council in accordance with the check list as amended November 8, 1971. 5. PUBLIC HEARING ON PROPOSED AMENDMENT TO TCWN'S ZONING ORDINANM NO. 78 ret ANTENNA HEIGHTS. Dr. R.C. Smithwick, Chairman of the Antenna Committee reviewed the Committee t charge and prefaced his remarks by noting that in 1961 the zoning ordinance ` established antenna height by arbitrarily relating it to the building height. He noted that there was no consideration given to a technical evaluation of the signal reception. Mr. Winn Wegener reviewed the committeefs findings which had been presented to the Council (See City council minutes of 10/4/71) and stated that they had as requested by the Council added to their draft amendment to the Ordinance a limitation on the number of towers to two and also specified the bulk of the tower as it might appear. The ensuing Commission discussion noted that the proposed amendment enabled anyone desiring to erect a tower to do so merely by applying for a building permit, rather than requiring the applicant to request a variance. It was noted that the neighbors who might object could then be heard. The committee objected to any requirement for a variance since neighbors objections would be solely on aesthetics rather than on a technical evaluation. Floor comments were heard from Mr. & Mrs. E. J. Georgia, 12800 LaCresta Dr., Mrs. June McIlwraith, 13431 Wildcrest Dr., and Mr. N. Gcrdcn, 27933 Briones W; Due to the late hour, the controversial nature of this discussion and noting a prolonged discussion in the offing, Chairman McReynolds with Commission concurrence continued the public hearing to 8 P.M. on November 22, 1971. 6. ADOPT STATEMENT re: THE WILLIAMSON ACT/GENBRAL PLAN. Continued to 11/22/7:.
