HomeMy WebLinkAbout69-14 RESOLUTION 69-14 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS SUMMARILY VACATING THE PUBLIC SERVICE EASEMENTS (LANDS OF WALLACE) WHEREAS, Chapter 4 of the Public Streets Highways s and Service Easements Vacation Law, commencing with Streets and Highways Code Section 8330, provides for summary vacation of streets and public service easements; and WHEREAS, the public service. easement on the map entitled MAP OF N.J. STONES SUBDISION OF LOTS 2 & 3 AND PART OF LOTS 7 & 8 OF THE SANBORN AND STONE PARTITION IN THE SAN ANTONIO RANCH" was recorded April 2, 1952 in the Book 2394 and Page 49 of the records at the Office of the Santa Clara County Recorder; and WHEREAS, Section 8333 of the Streets and Highways Code authorizes the City Council to summarily vacate public service utilities easement which is no longer necessary when the easement has been superseded by.relocation, or determined to be excess, and there are no other public facilities located within the easements; and WHEREAS, the City council intends to summarily vacate the public service easement for utilities as more particularly described herein in Exhibit"A",attached to this resolution; and NOW, THEREFORE, the City Council of the Town of Los Altos Hills does hereby RESOLVE as follows: 1. The foregoing recitals are true, correct, and incorporated herein by reference. 2. The Existing Easements described above and in Attachmentl are hereby summarily vacated pursuant to Chapter 4 of Division 9, Part 3 of the California Streets and Highways Code, concerning summary vacation of easements. 3. The City Clerk is directed to cause a certified copy of this resolution, attested by the Clerk under seal, to be recorded in the office of the County Recorder of the County of Santa Clara. 4. From and after the date of this resolution is recorded, the Existing Easements shall no longer constitute a public service easements. The above and foregoing resolution was passed and adopted.by the City Council of the Town of Los Altos Hills at a special meeting held on the 10th day of November, 2014 by the following vote: AYES: Radford, Corrigan, Harpootlian, Larsen, Waldeck NOES: None ABSTAIN: None ABSENT: None Resolution 69-14 Page 1 BY: ohn Radford, Mayor ATTEST: Deborah Padovan, City Clerk Resolution 69-14 Page 2 EXHIBIT "A" LEGAL DESCRIPTION 5 FOOT PUBLIC UTILITY EASEMENT (2394 O.R. 49) OVER PARCEL A (445 M 55) TO BE ABANDONED LANDS OF WALLACE STONEBROOK DRIVE LOS ALTOS HILLS, CALIFORNIA All that certain real property in the Town of Los Altos Hills, County of Santa Clara, State of California, described as follows: Being a portion of Parcel A_and all of that certain easement, which was recorded in Book 2394, at page 49, of Official Records of Santa Clara County, and is shown upon that certain Parcel Map, which was filed for record on July 18, 1978, in Book 445 of Maps, at Pages 55 & 56, in Santa Clara County records, and being more particularly described as follows; BEGINNING at an angle point in the southerly boundary of said Parcel A, which bears North 610 22' 11" East, 422.30 feet from the most southerly corner of said Parcel A; Thence, along the said southerly boundary of said Parcel A, South 610 22' 11" West, 5.00 feet; Thence, leaving the said southerly boundary of said Parcel A, North 280 42' 05" West, 225.19 feet to a point on the northerly boundary of said Parcel A, said boundary also being the southwesterly right-of-way of Junipero Serra Freeway (280) 1280, as shown on said map; Thence, along said northerly boundary and of said right-of-way, South 730 43' 30" East, 0.33 feet, to the beginning of a tangent curve to the right, having a radius of 400.00 feet: Thence, continuing along the said northerly boundary and of said right-of-way, along said curve, though a central angle of 000 57' 06", an arc length of 6.64 feet; Thence, parallel with the foregoing second course hereof and 5.00 northeasterly, right angle measure, South 280 42' 05" East, 220.33 feet, to the POINT OF BEGINNING.
