HomeMy WebLinkAbout47-02 • • RESOLUTION NO. 47-02 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS • DECLARING THE INTENTION NOT TO VACATE A PORTION OF .THE PUBLIC EASEMENT FOR RIGHT OF WAY WHEREAS, a public easement for right of way was dedicated to the Town of Los Altos Hills for public use ("Public Easement") on Stonebrook Drive, (APN 336-34-009) ("Property") in July 1993 (Book 648 of Maps at pages 37-38); and WHEREAS, the Town received a request to vacate a portion of the Public Easement; and WHEREAS, the Town desires not to vacate a twenty (20) foot portion of the Public Easement so that a twenty.(20) foot portion of the land subject to such Public Easement would revert to the Lands of Laura Court Associates (collectively, "Owners") pursuant to Streets and Highways Code Section 8351; and WHEREAS, the Planning Commission of the Town resolved pursuant to California Government Code Section 65402, that the proposed vacation of the Public Easement does not conform with the Town's General Plan in that the General Plan and Town right-of-way policy require a minimum sixty (60) foot right of way and that the existing right-of-way may be necessary for use as a local road in the event that an adjacent property is subdivided; and WHEREAS, the City Council of the Town of Los Altos Hills declares its intent not to vacate a twenty (20) foot portion of the Public Easement pursuant to Chapter 3 of Division 9 of the Streets and Highways Code. NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE that pursuant to California Streets and Highways Code, Division 9, Chapter 4, Section 8320, et seq., The Town hereby declares its intention not to vacate a twenty (20) foot portion of the Public Easement.
