HomeMy WebLinkAbout95-02 • 4110 RESOLUTION NO. 95-02 • A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS TO PLACE BEFORE THE VOTERS OF THE TOWN OF LOS ALTOS - HILLS AN ORDINANCE ADDING TITLE H, CHAPTER 7 TO THE LOS ALTOS BILLS MUNICIPAL CODE WHEREAS, the City Council desires to submit to the voters at the next general or special election occurring at least eighty-eight(88) days from October 3, 2002, whichever occurs first, an ordinance requiring voter approval for the sale,transfer, conveyance, abandonment or change in the General Plan land use designation for specified Town- owned properties; - NOW THEREFORE, the City Council of the-Town of Los Altos Hills does hereby resolve as follows: Section 1. That the City Council orders submitted to the voters at the next general or special election occurring at least eighty-eight(88) days after October 3, 2002, whichever occurs first, the following question and ordinance: YES Shall an Ordinance that requires voter approval prior to the sale, transfer, conveyance, or abandonment of.specified Town-owned real properties and that requires voter approval prior to an NO amendment to the General Plan land use designation for the j same specified Town-owned properties be adopted? Section 2. The ordinance to be enacted by the voters pursuant to Section 1 above shall be in the form set forth in Exhibit A, attached hereto. Section 3. Thismeasure is submitted to the voters pursuant to Elections Code § 9222. Section 4. The ballots used at the election shall be in the formand content as is required by law. Section 5. The adoption of this resolution and the submission of the attached ordinance to the voters are exempt from the requirements of the California Environmental Quality Act("CEQA"). Consistent with CEQA Guideline Section 15061(b)(3), the proposed voter approval requirements will not have a significant effect on the environment because it does not modify the current General Plan for the specified properties 208394-1 • • EXHIBIT A ORDINANCE NO. AN ORDINANCE OF THE TOWN OF LOS ALTOS BILLS ADDING TITLE II, CHAPTER 7 TO THE LOS ALTOS HILLS MUNICIPALCODE TO REQUIRE VOTER APPROVAL PRIOR TO CONVEYANCE OR CHANGE IN THE GENERAL PLAN LAND USE DESIGNATION OF SPECIFIED TOWN-OWNED REAL PROPERTY THE PEOPLE OF THE TOWN OF LOS ALTOS HILLS DO ORDAIN AS FOLLOWS: Section 1. Statement of Purpose and Findings. A. - The purpose of this ordinance is to ensure that specified Town-owned real property is not conveyed byany means to any other party without prior voter approval of such conveyance. In addition, this ordinance maintains the current General Plan land use designations for specified Town-owned properties and requires voter approval prior to adopting new General Plan land use designations for the specified Town-owned properties. B., This proposed ordinance is consistent with the Los Altos Hills General. Plan. The General Plan does not currently limit or otherwise condition the conveyance of Town-owned property. Section 2. Addition to Los Altos Hills Municipal Code. Title II, Chapter 7 of the Los Altos Hills Municipal Codeis hereby added to the Los Altos Hills Municipal Code toread as follows: Title II, Chapter 7 CONVEYANCE OF SPECIFIED TOWN-OWNED PROPERTY Section 2-07.01 The following Town-owned properties shall not be sold,transferred, conveyed, or abandoned without prior approval of a majority of the voters at either a regular or special election: APN Street Common Name 175-56-003 Fremont Town Hall 175-53-042 Fremont Heritage House 182-04-073 Purissima Little League Field, 208398-1 • • Corp.Yard 182-03-022 Purissima/Elena 182-07-026 Saddle Mt. Section 3. Voter Approval Required to Amend the General Plan Land Use Designation for Specified Town-owned Properties A. The General Plan Designations specified hereinabove in Section 3 shall not be amended without prior approval of a majority of the voters at either a regular or special election. 208398-1 • Section 4. State Conflict This ordinance shall not be construed in a manner that is inconsistent with the provisions governing the disposal of surplus city property found at California Government Code Section 54220 et seq. The voter approval provisions specified herein are in addition to those requirements. Section 5. Severability. In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. Section 6. Amendment or Repeal. The provisions of this ordinance may be amended or repealed only by a vote of the People of the Town of Los Altos Hills. 208398-1 . • • .
