RESOLUTION OF THE CITY COUNCIL
OF THE TOWN OF LOS ALTOS HILLS
SUMMARILY VACATING A PUBLIC UTILITY
EASEMENT OVER THE LANDS OF CLEARY
WHEREAS, in 1991 the Town of Los Altos Hills acquired a public utility
easement(the "Subject Easement") over a portion of that certain property hereinafter
more particularly described in Exhibit A and commonly known as the Lands of Cleary;
and
WHEREAS,the City Council of the Town of Los Altos Hills believes the
Subject Easement should be vacated and abandoned for the reason that it is unnecessary
for present or prospective use, and that the best interests of the citizens of the Town of
Los Altos Hills will be served by such vacation and abandonment; and
WHEREAS,the City Council of the Town of Los Altos Hills is authorized by
Section 8333 of the California Streets and Highways Code to summarily vacate a public
service easement if the easement has not been used for the purpose for which it was
dedicated or acquired for five consecutive years immediately preceding the proposed
vacation; and
WHEREAS, the City Council of the Town of Los Altos Hills has reviewed letters
of consent and authorization for the vacation of the Subject Easement from various public
utilities; and
WHEREAS, the City Council of the Town of Los Altos Hills finds that the
Subject Easement has not been used for any public service or public utility purpose for
the previous five consecutive years;
NOW THEREFORE,the City Council of the Town of Los Altos Hills does
RESOLVE as follows:
Section 1. The Town of Los Altos Hills hereby vacates and abandons the
Subject Easement described in Exhibit A, and depicted in Exhibit B,pursuant to the
authority contained in Section 8335 of the California Streets and Highways Code.
BE IT FURTHER RESOLVED,that the City Clerk is hereby authorized and
directed to cause a certified copy of this resolution to be recorded by the Santa Clara
County Recorder's Office;
BE IT FURTHER RESOLVED,that from and after the date this resolution is
recorded pursuant to Section 8336 of the California Streets and Highways Code, the
Subject Easement shall no longer constitute a public service easement.

LEGAL DESCRIPTION OF A PORTION OF
A PUBLIC UTILITY EASEMENT (PUE) TO BE
ABANDONED OVER THE LANDS OF CLEARY
(APN 182-23-27)
All that real property situate in the Town of Los Altos Hills, County of Santa Clara, State of
California more particularly described as follows:
All that portion of that certain ten foot wide Public Utility Easement that extends into Parcel 3
northerly of Silent Hills Lane as granted and accepted for dedication on that certain Parcel Map
recorded in Book 625 of Maps at Page 4, Records of Santa Clara County.
Commencing at the most southwest corner of said Parcel.3 lying on the northerly line of Parcel 1
at the common corner of Parcel 3 and the Designated Remainder as shown on said map;
Thence from said Point of Commencement North 74° 00' 00" East 15.23 feet to a point on the
westerly line of Silent Hills Lane, said point being the True Point of Beginning of this description;
Thence from said Point of Beginning along the common line of said Parcel 3 and Silent Hills Lane
through a curve to the left with a radius of 25 feet with a central angle of 116°35'20"an arc length
of 50.87 feet;
Thence.continuing along Silent Hills Lane, North 47°24'40"East 32.00 feet and South 42°35'20"
East 56.49 feet to the southerly line of said Parcel 3;
Thence along said southerly line of Parcel 3 North 74° 00'00"East 11.18 feet to a point on the ten
foot Public Utility Easement line as shown on said map;
Thence along the ten foot Public Utility Easement line North 42° 35' 20"West 71.49 feet;
Thence continuing along said Public Utility Easement line South 47° 24'40"West 52.00 feet and
South 42° 35' 20" East 10.00 feet:
Thence continuing along said Public Utility Easement line through a tangent curve to the right with
a radius of 15 feet with a central angle of 116° 35' 20"an arc length of 30.52 feet;
Thence continuing along said Public Utility Easement line South 74° 00' 00"West 10.00 feet;
Thence continuing along said Public Utility Easement line South 16° 00'00"East 10.00 feet to the
southerly line of said Parcel 3;
