RESOLUTION NO. 13-00
RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS APPROVING AND AUTHORIZING
EXECUTION OF A CONSERVATION AGREEMENT BETWEEN THE
TOWN OF LOS ALTOS HILLS AND STEPHEN A. FINN
WHEREAS,the City Council of the Town of Los Altos Hills has read and considered
that certain Agreement ("Agreement") between the Town and Stephen A. Finn.
NOW, THEREFORE, the City Council of the Town does RESOLVE as follows:
1. Public interest and convenience require the Town of Los Altos Hills to enter
into the Agreement described above.
2. The Town of Los Altos Hills hereby approves the Agreement and the Mayor
is hereby authorized on behalf of the Town to execute the Agreement between the Town
of Los Altos Hills and Stephen A. Finn.

CONSERVATION AGREEMENT
This Agreement is made and entered into this day of ,
2000, by and between Stephen A. Finn ("Owner") an the Town of Los Altos H' a
municipal corporation, ("Town").
RECITALS
A. Owner is the owner of certain real property in the Town of Los Altos Hills
commonly known as 12000 Finn Lane and more particularly described in Exhibit A
attached hereto.
B. Owner and Town desire to limit the use of a portion of the property
("Property") described above by conserving the Property in order to reduce potential
adverse impacts on such land including grading, vegetation removal, and erosion,
recognizing that such Property if retained and planted with native vegetation has
substantial scenic value to the public and that the preservation of such land constitutes
an important physical, social, aesthetic and economic asset to the Town and the Owner.
NOW, THEREFORE, the parties, in consideration of the mutual covenants and
conditions set forth herein and the substantial public benefits to be derived therefrom, do
hereby agree as follows:
1. Conservation Agreement. In exchange for the Town a granting variance and site
development approval, Owner hereby agrees to maintain and conserve the Property which
comprises the terracebetween the upper and lower retaining walls along the Prospect
Avenue,frontage in proximity to and extending 160 feet west of the "school house"
structure, for the term and for the purposes and subject to the conditions and covenants
described herein.

2. Restrictions. During the term of this Agreement, the native plantings on the
Property shall be maintained and no additional grading shall be permitted. Stepping stones
or other forms of walkways made of natural material maybe placed among the native
plantings. Owner, for the direct benefit of the Property described herein and the Town's
adjoining right-of-way, hereby declares that the Property shall be subject to these
restrictions and they shall run with the land which shall be binding upon all subsequent
owners.
3. Term of Agreement. This Agreement shall be effective on the date of
recordation of this Agreement and shall remain in effect in perpetuity, unless amended or
terminated by Owner or the Town.
4. Successor: in Interest. This Agreement shall run with the Property and
shall be binding upon-an inure to the benefitof tile heirs, successors and.ass&gns - -
of the parties hereto.
IN WITNESS WHEREOF, the parties hereto have executed this agreement.

All of that certain Real Property in the City of the Town of Los Altos
Hills, County of Santa Clara, State of California, described as follows:
Lot 1, as shown on that certain Map entitled Tract No. 8310, Finn Estates,
which map was filed for record in the Office of the Recorder of the
County of Santa Clara, State of California, on June 28, 1990 in Book 615
of Maps, Pages 26 and 27.
