RESOLUTION NO. 31-00
RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS TO SUMMARILY VACATE
THE PATHWAY EASEMENT AND
THE PEDESTRIAN EQUESTRIAN EASEMENT ON LANDS OF LAUB
WHEREAS, for the benefit of the general public, a pathway easement ("Original
Pathway Easement") was originally dedicated over Parcel 1 as shown on that certain
parcel map, which was filed for record in the Santa Clara County Recorder's Office on
February 12, 1991, in Book 624 of Maps, Pages 8,9,10; and
WHEREAS,for the benefit of the general public, a pedestrian equestrian easement
(Pedestrian Equestrian Easement)was dedicated over Lot One, as shown on the certain
map entitled "Tract No. 6518", filed for record on August 27, 1979, in Book 441 of Maps,
at pages 35 through 39, Santa Clara County Records; and
WHEREAS, Donald R. Laub and Julia M. Laub, Trustees of the Laub Family Trust
Agreement dated May 16, 1997, the current owners ("Owners")of the property commonly
known as 28140 StoryHill Lane, Los Altos Hills, California ("Property"),), have requested
that a portion of the Original Pathway Easement be summarily vacated because it will be
superseded by relocation; and
WHEREAS, Owners have requested that the Pedestrian Equestrian Easement be
summarily vacated, because it will be superceded by relocation; and
WHEREAS, concurrently herewith, the Owners will dedicate to the Town a new
pathway easement over the Property ("New Pathway Easement"), which offer will be
accepted by the Town at this time; and

WHEREAS,the City Council of the Town now desires to summarily vacate a portion
of the Original Pathway Easement and the Pedestrian Equestrian Easement.
NOW, THEREFORE, the City Council of the Town does RESOLVE as follows:
1. The City Council of the Town, pursuant to California Streets and Highways
Code, Division 9, Chapter 4, Section 8333, et seq., hereby summarily vacates a portion
of the Original Pathway Easement and summarily vacates the Pedestrian Equestrian
Easement and finds that the Original Pathway Easement and the Pedestrian rian E uestrian
Easement have been superseded by relocation and no other public facilities are located
within the easements.
2. The Parcel Map showing the location of the Original Pathway Easement was
filed on February 12, 1991 , and is on file in the Santa Clara County Recorder's Office in
Book 624 of Maps at Pages 8,9,10. The Pedestrian Equestrian Easement located on Lot
One, as shown on the certain map entitled"Tract No. 6518",filed for record on August 27,
1979, in Book 441 of Maps, at pages 35 through 39, S.C. County Records. Descriptions
of the Original Pathway Easement and the Pedestrian Equestrian Easement to be vacated
are described and shown in Exhibit A, attached hereto.
3. From and after the date this resolution is recorded in the Santa Clara County
Recorder's Office, a portion of the Original Pathway Easement and the Pedestrian
Equestrian Easement shall no longer constitute public easements.
PASSED AND ADOPTED this 1st day of June ; 2000.

All that certain real property in the City of the Town of Los Altos Hills, County of Santa
Clara, State of California, described as follows:
Being a portion of that certain 10 foot wide strip of land, designated as "10' Pedestrian
Equestrian Easement", which was originally dedicated over Lot One, as shown on that
certain map entitled "Tract No. 6518", which was filed for record on August 27, 1979, in
Book 441 of Maps, at Pages 35 through 39, Santa Clara County Records, and being a
portion of that certain 10 foot wide strip of land, designated as " which was originally
dedicated over Parcel 1, as shown on that certain Parcel Map, which was filed for record
on February 12, 1991, in Book 624 of Maps, at Pages 8 through 9, Santa Clara County
Records, and being more particularly described as follows:
Beginning at a point on the westerly boundary of said "10' Pathway Easement", said point
being South 2°19'03" West, 44.82 feet, from an angle point in the westerly boundary of
said Parcel 1, said angle point also being the southwesterly corner of Parcel 2, as shown
on said Parcel Map;
Thence, continuing along the westerly boundary of said "10' Pathway Easement", South
2°19'03"West, 111.45 feet, to the southwesterly corner of said "10' Pathway Easement",
said point also being on the westerly boundary of said "10' Pedestrian Equestrian
Easement";
Thence, continuing along the westerly boundary of said "10' Pedestrian Equestrian
Easement", South 15°22'35"West, 123.85 feet, to an angle point on the westerly boundary
of said "10' Pedestrian Equestrian Easement";
Thence, continuing along the westerly boundary of said "10' Pedestrian Equestrian
Easement", South 16°00'56" West, 95.83 feet;
Thence, leaving the westerly boundary of said "10' Pedestrian Equestrian Easement",
South 18°16'10" East, 17.75 feet, to a point on the easterly boundary of said "10'
Pedestrian Equestrian Easement";
