HomeMy WebLinkAbout40-11 • • RESOLUTION NO. 40-11 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS VACATING PORTIONS OF A PUBLIC USE EASEMENT (Chaparral Way) WHEREAS, in 1978 the Town of Los Altos Hills ("Town") was offered, and the Town accepted dedication for public use across Chaparral Way as offered and accepted on Los Altos Hills Tract Map 6355 ("Public Use Easement"); and WHEREAS, the Public Use Easement accepted by the Town in 1978 meets the definition of a "public service easement" as defined by the Streets and Highways Code Section 8306; and WHEREAS, pursuant to the provisions of Section 8300 et seq., including Section 8340, of the Streets and Highways Code, the City Council of the Town of Los Altos Hills seeks to vacate the Public Use Easement and reserve a public utility easement of equal dimensions and a seven (7) to ten (10) foot pathway easement within the Public Use Easement for the reasons and as described in this resolution; and WHEREAS, upon vacation and reservation, the Town will retain an easement for public utility purposes along the same dimensions as the vacated Public Use Easement ("Public Utility Easement"), and the Town will also retain an easement for pathway purposes more particularly described in the legal description, attached as Exhibit A and identified in accompanying plat map, attached as Exhibit B as the "Public Service Easement (Pathway)" [hereafter "Pathway Easement"]; and WHEREAS, the City Council has determined that vacation of the Public Use Easement serves an important public purpose and, except for the reserved portions, is unnecessary for present or prospective public use; and WHEREAS, pursuant .to Section 65402 of the Government Code the Planning Commission has determined that vacation and reservation of the Public Use Easement is in conformity with the Town General Plan; and NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: 1. The foregoing recitals are true, correct, and incorporated herein by reference. 2. The Public Use Easement described in Exhibit A and Exhibit B is hereby vacated pursuant to Chapter 3 of Division 9, Part 3 of the California Streets and Highways Code, concerning vacation of easements, except that the Town shall reserve and except from vacation, the portions of the Public Use Easement described as follows: Resolution No.40-11 Page 1 • A. The permanent "Public Utility Easement" of the same dimensions, and right at any time, or from time to time, to use for pedestrian or vehicular access and to construct, maintain, operate, replace, remove and renew water pipe lines, sanitary sewers and storm drains or other public utilities and appurtenant structures in, upon, over and across the Public Utility Easement, and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures in, upon, over and across the portion of the Public Use Easement for the operation of gas pipe lines, telegraphic and telephone lines, and for the distribution of electric energy, water and incidental purposes, including access and the right to protect such works from all hazards in, upon and over the Public Utility Easement. B. The permanent Pathway Easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew pathway trails for use by the public in, upon, over, and across portion of the Pathway Easement, as identified in Exhibit B. 3. The City Clerk is directed to cause a certified copy of this resolution, attested by the Clerk under seal, to be recorded in the office of the County Recorder of the County of Santa Clara. 4. From and after the date of this resolution is recorded, the Public Use Easement, except as reserved by this resolution, shall no longer constitute a public service easement.
