RESOLUTION NO. 61-00
RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS ADDING A FEE TO THE TOWN'S FEE SCHEDULE
FOR AN IN-LIEU PAYMENT WHEN PATHWAY CONSTRUCTION IS REQUIRED
WHEREAS, pursuant to Los Altos Hills Municipal Code Section 10-2.607
[Construction of Pathways] the Site Development Authority may require construction of
pathway improvements pursuant to a site development application for a main residence,
a secondary dwelling,or an addition to a structure of at least 900 square feet of "habitable"
floor area; and
WHEREAS, pursuant to Title 9 [Subdivisions and Plan Lines], the City Council
frequently requires that a subdivider install a pathway; and
WHEREAS, it is sometimes impractical for a subdivider or an applicant for a site
development permit to install a path, if the path does not connect on both sides to an
existing path; and
WHEREAS,the Town would like to provide applicants in those situations who prefer
not to install a path to be able to pay the Town an in-lieu fee to cover the cost of the Town's
installing the path.
NOW, THEREFORE, the City Council of the Town does RESOLVE that the
following fees are added to the Schedule of Fees, Deposits, Charges for Services and
Other Assessments (Fee Schedule) of the Town of Los Altos Hills:
1. Category 4 (Subdivision Applications):
Pathways: Where construction of a path is required pursuant to conditional
approval of a tentative map and where the pathway to be constructed does not connect on
both sides to an existing pathway and the subdivider prefers not to install the path, $33.00
per lineal foot of street frontage in-lieu of constructing the path.
2. Category 9 (Site Development):
Pathways:Where construction of a path is required by the Site Development
Authority pursuant to Municipal Code Section 10-2.607 and where the pathway to be
constructed does not connect on both sides to an existing pathway and the applicant
prefers not to install the path, $33.00 per lineal foot of street frontage in-lieu of constructing
the path.
