RESOLUTION NO. 18-99
RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS TO VACATE SUMMARILY
THE PUBLIC UTILITY EASEMENT ON LANDS OF LAMBERT
WHEREAS, for the benefit of the general public, a public utility easement("Original
Easement")was placed on Lot 24 ("Property") as shown on that certain Parcel Map, filed
for record on May 2, 1961 in Book 132 of Maps, at pages 12 and 13, Santa Clara County
Records, as more particularly described in Exhibit A-1, attached hereto.
WHEREAS, Winston Lambert and Elaine Lambert, the current owners of the
Property ("Owners"), have requested that the Original Easement be vacated because of
non-use; and
WHEREAS,the City has determined that the Original Easement has not been used
for the purpose for which it was dedicated forfive consecutive years immediately preceding
the proposed vacation; and
WHEREAS, the City Council of the Town now desires summarily to vacate the
Original Easement.
NOW, THEREFORE, the City Council of the Town does RESOLVE as follows:
1. The City Council of the Town, pursuant to California Streets and Highways
Code, Division 9, Chapter 4, Section 8333, hereby vacates the Original Easement.
2. The Parcel Map ("Map") showing the location of the Original Easement was
filed on May 2,1961, and is on file in the Santa Clara County Recorder's Office in Book 132
of Maps at Pages 12 and 13. The legal description of the Original Easement and a copy
of that portion of the Map indicating the Original Easement are attached hereto as Exhibit
A-1 and A-2.

3. From and after the date this resolution is recorded in the Santa Clara County
Recorder's Office,the Original Easement is vacated and shall no longer constitute a public
utility easement.
PASSED AND ADOPTED this 15th day of April , 1999.

LEGAL DESCRIPTION:
Real property situated in the City of the Town of Los Altos Hills, County of
Santa Clara, State of California, described as follows:
All of Lot 24., as shown upon that certain Map entitled, "Tract No. 2958 Olive .
Tree Hill", which Map was filed for record in the office of the Recorder of the
County of Santa Clara, State of California on May 2, 1961 in Book 132 of Maps,
. at pages 12 and 13.
Excepting therefrom the underground water as granted in the Deed from Olive Tree
Hill, Inc. , a California corporation to California Water Service Company, a
California corporation, dated August 7, 1961 in Book. 5279 of Official Records,
page 333.
Together with a non-exclusive easement for purposes of ingress, egress and
underground public utilities over a strip of land, 24.00 feet in perpendicular
width, the center line of which is described as follows:
Beginning at the most Northerly corner of said Lot 23; thence along the
Northeasterly line of said Lot 23 South 56° 24' 53" East 10.55feet to the true
point of beginning, thence from said true point of beginning South 28° 38' 38"
West 43.21 feet; thence South 13° 06, 08" East 36.22 feet; thence South 25° 09'
14" East 116.31 feet; thence Southerly 60.69 feet along an arc of. 130.00 feet
radius tangent to the preceding course and curving to the right through a
central angle of 26° 44' .55" to a point on the.Northwesterly line of Lot 24 as
said Lot is shown upon said Map., said point bearing South 26° 15' 00" West.
171.92 feet along said Northwesterly line from the most Northerly corner of said
Lot 24.
As granted by Wallace Chang, and Jeanette Chang, h1§ wife. to Security National
Bank of Nevada, a national banking association, by Deed dated November 7, 1967
recorded March 13. 1968 in Book. 8054 of Official Records, page 327.
