HomeMy WebLinkAbout01/24/1972f� PLANNING COMMISSION TOWN OF LOS ALTOS HILLS MINUTES OF A REGULAR MEETING January 24, 1972 REEL PC 6 Side 2 Track 1 130-1320 Vice Chairman Weisbart called the Regular Meeting of the Planning Commission of the Town of Los Altos Hills to order at 7:46 P. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. The following members an- swered roll call: Commissioners Lachenbruch, Magruder, Perkins, Spencer, and Weisbart. Absents Chairman McReynolds and Commissioner Mueller. CITY COUNCIL REPRESENTATIVE: Councilman Helgesson. APPROVAL OF MINUTES% Minutes of November S, 1971. Commissioner Lachenbruch moved, seconded by Spencer and carried unanimously that the minutes of Nov- ember B, 1971 be approved as written. COMMUNICATIONS: 1. City Attorney suggested responsibility of "preserving open space" be added to "chargee of the Planning Commission. 2. Palo Alto Planning Commission will consider rezoning of certain Stanford lands on January 26, 1972 and a rezoning for an eight lot subdivision near Old Trace Road and Arastradero. 4 ADJOURN TO STUDY SESSION: 8:00 - 9:00 P.M. - STUDY SESSION: SPHERES OF INFLUENCE. RECONVENE TO REGULAR SESSION: 1. Review Check List for Building Site Approval for B. S. Shaw (BSA 72-71) - Re-agended at the request of the City Council. Staff reviewed that the Council had returned this application to the Commission for clarification of the requirements for Mr. Shaw to rebuild the private road which currently serves two existing residences and could serve his lots 1 and 4. It was noted that Mr. Shaw objected to the Council that he be re- quired to rebuild this private road which he had constructed to Town Standards in 1961. Mr. Shaw also contended that the maintenance agreement for the road should be the responsibility of its users. Commission discussion included floor participation from Mr. Shaw, and his attorney, Mr. J. Moore and a neighbor, Mr. J. Roberts. Discussion noted that Mr. Roberts' shrubs actually encroached substantially into the road easement which contrasted to his suspicion that the existing road was not properly placed within the easement. Commission discussion concurred that a maintenance agreement be required for lots 1 & 4and if either lot uses the existing private road for driveway access that they be required to widen the paved section of the road to 16' per Town Standards. itwe MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Spencer and carried unanimously that building site approval for the two lots of B. S. Shaw (BSA 72-71) be recommended to the Council for approval in accord- ance with the check list as amended January 24, 1972. 2. Building Site Approval for Thomas W. Spain (BSA 59-70) 1 lot, 1.178 acres, frontage on both Fremont Road and Cicerone Lane. Engr. J. W. Riley. (Continued from last meeting.) Staff reviewed that this item had been continued to allow additional study on the access problem for the driveway off Cicerone Lane. Mr. T. Spain indicated that he had approached neighbors on either side and neither was receptive to granting an easement to facilitate access to Cicerone Lane. Commission discussion ensued and the majority consensus was that they had no choice but to proceed with access off Fremont Road and therefore moved to the check list. The driveway was limited to the easterly 40' of the Fremont front- age. MOTION, SECONDED AND CARRIED: Commissimer Spencer moved, seconded by Magruder and carried by majority vote (Weisbart voting no) that building site approval for T. Spain (BSA 59-70) be recommended to the Council in accordance with the check list as amended January 24, 1972. 3. Tentative Map for Dennis J. Archibald (381-71) Magdalena Road and Hill- view drive, 3 lots, 4.27 acres. Engr. J. W. Riley. (Cont. from last meet - Commission concurred with applicants request to continue this item to 2/28,!72. 4. Review Landscaping Plan for Fremont Hills Country Club. Staff reviewed that at the time the Use Permit for two additional tennis courts was issued to Fremont Hills Country Club, the Commission had asked the Club to prepare and submit these plans for review. Pathway Committee Chair - d, man Saviano suggested that her sub -committee on trees review them from an aesthetic point of view and present their comments. MDTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Lach- enbruch and carried unanimously that the landscape plans for Fremont Hills Country Club be approved and suggested that the Club avail themselves of the Pathway Sub -Committee's expertise. 5. Variance Request of Dr. Allen D. Calvin (V-362-72) for Reduction of Both Side Yard Setbacks from 30' to 26' for a Tennis Court at 14160 Miranda Rd. Town Planner George Mader stated that the applicant wished to construct a regulation siae tennis court on the rear portion of his property which re- quires removal of an existing horse barn and corral. He noted that the court necessitated a variance in side setback since it will come to within 26' of each side property line and that since the property drops off at an approximate 20% slope from the house to the rear property line, considerable grading will be required. Staff recommended approval, conditional upon connection of the residence to a sanitary sewer and approval by the Site Development Committee of the drainage, grading and landscape plans. Commission discussion noted concurrence with the Staff's recommendation but they added approval of the Site Development Committee of outdoor lighting plan. to assure they would not be objectionable to the neighbors. MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Spencer and carried unanimously that the variance request of A. D. Calvin (V-362-72) as recommended by the Town Planner in his memorandum of Jan. 18, 1972, and amended by the Commission on Jan. 24G3 1972 to allow a 4' reduction in both side setbacks for construction of a tennis court be recommended to the Council for approval in accordance with the six criteria of section 13:60 of Ordinance No. 78, as amended. -2- L 6. Building Site Approval for Hugh L. Monahan (BSA -73-71) 2 lots, 1.007 acres and 1.044 acres, end of Bast Sunset Drive. Engr. Geo. S. Nolte and Assoc. Commission concurred with the applicant's request that this application be withdrawn until further notice. 7. Review Paper Entitled: "LOS ALTOS HILLS - OPEN SPACE AND YOU". Staff reported that this paper prepared by Councilman Corbett was referred by the Council for comments from the Planning Commission, as well as the City Attorney, Staff and the Town's Open Space Committee for recommendations back to the Council. Staff stated after final approval by the Council, that it would then be made available to all property owners interested in maintaining open space. The Commission concurred to have their individual comments for discussion ready at the Feb. 14, 1972 meeting to allow Staff to prepare their recommendation back to the Council. 8, Review Request for "INTERIM DEVELOPMENT REGULATIONS FOR THE MONTEBELLO RIDGE MOUNTIIN STUDY AREA" Referred from City Countil. Staff presented this material referred from the Council for study and re- commendation in which the County was asking each involved City to adopt em- ergency regulations to prevent premature developments in the Montebello Ridge 040 Mountain study area until after the study has been completed by the Hillside Sub -Committee. Tmn Planner George Mader noted the requested interim Ord- inance would prevent subdivision of parcels within the Montebello Ridge area into less than 5 acres without special approval. The area encompassed within Los Altos Hills would affect primarily the Adobe Creek Lodge parcel and some areas around the Duveneck property within the sphere of influence. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Lach- enbruch and carried unanimously to recommend to the Council, that the County - recommended ordinance as modified by Staff's suggestions be adopted. 9.Approval of Recommended Changes in the Town's "STANDARD SPECIFICATIONS FOR SUBDIVISIONS" - Continued from 1/14/72. DAe to the late hour, the Commission concurred to defer discussion of this item to Feb. 14, 1972. 10. Other Business by Planning Commissioners: Staff stated that the Site Development Committee had referred the plans of J. P. Ratza for site development of lot 10 of Tract 4657 to the Commission since the Committee was unable to reach agreement on the grading requested. The Town Engineer noted that instead of developing the property in stages as is more commonly done, the applicant wished in addition to clearing for his house and drive, to allow for placement of his swimming pool and in effect koe would be grading less than if it were accomplished in stages. Staff noted that the applicant had modified the plans somewhat since their meeting. -3- V MOTION, SECMED AND CARRIED: Commissioner Perkins moved, seconded by Ma- gruder and carried unanimously to refer the modified and improved plan of J. P. Ratza back to the Site Development Committee for resolution. w_% s There being no further business, Vice Chairman Weisbart adjourned the meeting at 11:45 P.M. to NEXT REGULAR MEETING: Monday, Feb. 142 1972s at Town Hall.
