MINUTES OF A REGULAR MEETING
May 8, 1972

Chairman McReynolds called the Regular Meeting of the Planning Commission of the
Town of Los Altos Hills to order at 7:50 P. M. at the Town Hall, 26379 Fremont Road,
Los Altos Hills, California. The following members answered roll call:
Commissioners Magruder, Mueller, Spencer, and Chairman McReynolds. Absent:
Commissioners Lachenbruch, Perkins, and Welsbart.
CITY COUNCIL REPRESENTATIVE: Councilman Mary C. Davey
APPROVAL OF MINUTES: April 24, 1972.
Commissioner Spencer moved, seconded by Mueller and carried by unanimous vote, that
the Minutes of April 24, 1972 be approved as submitted.
COMMUNICATIONS: None.
ANNOUNCEMENTS: None.
COMMITTEE REPORTS: None.

It was agreed that the Study Session for the May 22nd meeting will encompass budget
discussion of the 1972-73 Fiscal Year and review of Town goals.
RECONVENE TO REGULAR SESSION:
ORDER OF BUSINESS:
I. TENTATIVE MAP FOR DENNIS J. ARCHIBALD (381-71) 2 lots, 4.27 acres, Magdalena
Road and HIIlview Drive. Engineer J. W Riley.(PC-7• S1 T2-505)
Staff reviewed the history of this application, stating that It had been made In
June of 1971 and has been continued from time to time attempting to solve the
problem of Hale Creek cutting through the subdivision. The applicant originally
applied for a 3 -lot subdivision but has now changed his application to a 2 -lot
subdivision. Mr. Archibald Is requesting that he not be required to dedicate a
601 drainage easement to the Santa Clara County Flood Control and Water District,
but Instead is offering a 601 dedication to the Town of Los Altos Hills. He Is also
requesting that he not be required to do road work on Hillview Drive nor Install the
path along HIIlview Drive.
The Planning Comm lssion concurred they would not require the 601 dedication to the
Santa Clara County Flood Control and Water District but would ask the applicant to
offer this dedication to the Town of Los Altos Hills. Town Engineer Jerry Crabtree
stated that Hillview Drive Is presently a Town Standard road and would require no
additional work. The path along Hlllvl ew Drive, however, will be required.

MOTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Mueller and
carried unanimously, that the Check List be prepared.
MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Magruder and
carried unanimously, that the Planning Comm lsslon recommend to the City Council
that the Tentative Map of Dennis J. Archibald (381-71) 2 lots, 4.27 acres, be
approved In accordance with the conditions of the Approved Check List.
2. TENTATIVE MAP FOR JEROME H. BISHOP (385-72) 4 lots, 4.36 gr. acres, Purissima and
La Paloma Roads. Enqr. J. W. Rllev. (PC -7• S1 T2-820).
Staff presented a report on this subdivision, which had been continued from the
April 10th meeting to allow the applicant time to solve the drainage problem at the
end of the cul-de-sac, Calle del Sol,and to determine whether sanitary sewers would
be required.
It was reported that the drainage problem at the end of the cul-de-sac could be
handled by the installation of a catch basin, a pipe and adequate headwall and rip -
rap conducting the collected water Into a natural drainage swale. Mr. Bishop re-
ported that the percolation tests Indicated that septic tanks would be satisfactory
on his subdivision. The Santa Clara County Health Department Is still recommending
sanitary sewers. Lots #2, 3, and 4 would have to be pumped as there Is no gravity
line available.
The Planning Commission concurred that the requirement for pumping of sewage of
` Lots #2, 3, and 4 might be considered unreasonable and that the applicant and Health
Department should find a solution In conformance with Town Ordinance No. 136.
The Pathway Committee again recommended an easement from the end of Calle del Sol
to Alta Tierra Road and added a recommendation that a Type 2 path be constructed
along the La Paloma frontage of Lots #3 and A. The Commissioners again rejected
the request for the path easement connecting Calle del Sol to Alta Tierra Road.
MOTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Mueller and
carried unanimously, that the Check List be prepared.
MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Mueller and
carried unanimously, that the Planning Commission recommend to the City Council
that the Tentative Map of Jerome H. Bishop (385-72) 4 lots, 4.36 gross acres, be
approved in accordance with the conditions of the Approved Check List.
3. TENTATIVE MAP FOR HERMAN SPECTOR (386-72) 3 lots, 8.26+ acres, Black Mountain
Road Engr. J W Riley.(PC-7• Sip T2-1215)
Staff reported on this application stating that Mr. Spector wishes to resubdivide
Parcels A, B and C, separating his existing garage from his existing residence so
that the garage can be remodeled Into a small cottage. A portion of Parcel C Is to
be added to Parcel A to provide sufficient land for a legal building site. Parcel C
Is to be retained by Mr. Spector for future subdivision. Parcel C will not be a
building site at this time.
Town Planner George G. Mader raised several questions regarding the easements for
driveway purposes for Parcels A and B, especially where the existing driveway meets
AWO Black Mountain Road.

Spector (386-72) continued:
General discussion ensued regarding the setback for the garage and the Inherent
difficulty In adding onto this garage, due to its location and the steepness of the
terrain.
MOTION, SECONDED AND CARRIED: Cow issloner Mueller moved, seconded by Magruder and
carried by majority vote, that the Check List be prepared. Chairman McReynolds
voted "NO", stating that there were Inherent problems with the remodeling of the
garage due to Its location, and that the problems should be solved before the
subdivision Is approved.
After additional discussion by the Commissioners, It was agreed that more Information
was needed before action could be taken.
MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Mueller and
carried unanimously to continue this action for two weeks in order for the applicant
to provide the additional Information needed.
4. BUILDING SITE APPROVAL FOR HUGH L. MONAHAN (BSA -73-71) 2 lots, 1.007 a. and
1.044 a., end of E. Sunset Drive. Engr.: Geo. S. Nolte 8 Associates. (S2.T2-150)
The subject lots were created in 1957 and the apDllcant wishes them to be declared
legal building sites per Ordinance No. 102. The lots are located at the end of
E. Sunset Drive.
MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Spencer and
carried unanimously, that the Check List be prepared.
MOTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Mueller and
carried unanimously, that the Planning Commission recommend building site approval
be granted to Mr. Hugh L. Monahan for 2 lots, subject to the conditions of the
Approved Check List.
5. VARIANCE REQUEST (V-366-72) FOR REDUCTION OF REQUIRED FRONT 40' SETBACK TO 30'
FOR POOL AT 13920 FREMONT PINES LANE. APPLICANT: LIONEL W. CARUFEL.
(PC -7: S2. T2-210)
Staff reported on this application stating that the requested location of the pro-
posed swimming pool Is a reasonable location but that It would be hard to find the
necessary conditions for recommending a variance In the front yard setback. There
Is sufficient land on this property to accommodate a pool observing the required
setbacks, but the applicant feels that he would have to remove too many trees to
accomplish this.
MOTION: Commissioner Spencer moved to recommend approval of this variance. Motion
died for lack of a second.
MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Magruder to
continue this matter for two weeks, so that the applicant could study the use of his
land to determine if the swimming pool could be accommodated without requiring a
F variance.

6. VARIANCE REQUEST (V-368-72) TO ENCROACH 30' INTO THE REQUIRED 30' SETBACK FOR
TENNIS COURT AT 25698 ELENA ROAD. APPLICANT: HOWARD W. STOKES. (S2.T2-300)._
Staff reported on this application stating that one corner of the tennis court Is
proposed to be located on the easement line of Vinedo Lane, with the court enclosed
by a 12' high fence. This application involves two variances: (1) the tennis
court encroaches 30' Into the sideyard setback, and (2), a 12' high fence encroaches
Into the required 25' setback.
Mr. Stokes expI a l ned there is a 20' easement, between the paved area of VI nedo Lane
and his fence,dedicated to neighboring property owners for use for roadway purposes.
It Is not being used for that and he contends that it probably never will.
Commissioners concurred that the applicant should try to have the 20' easement
abandoned and amend his request for a 30' variance to a 10' variance.
MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Mueller and
carried unanimously, that this Item be continued for two weeks to allow the
applicant time to contact the owners of this 20' easement In an attempt to abandon
It.
CONSIDER REQUEST OF JOHN I. QUIMBY FOR HEARING RE REQUIREMENTS OF SITE DEVELOPMENT
PERMIT FOR NEW RESIDENCE AT 12797 LA CRESTA DRIVE (PC -7: S2 T2-555)
Mr. Quimby Is requesting a review by the Planning Corm fission of the decision and
action of the Site Development Committee as it pertains to the construction of the
Bugge residence on the lot adjacent to his home. Mr. Quimby feels that the
contractor overgraded in the area within 10' of his property line and that a
retaining wall should now be constructed on the Bugge property, so that this area
can be filled back to natural grade.
Discussion evolved around the legal Interpretation of the Site Development
Ordinance and it was suggested that the City Attorney be asked for his legal
opinion. The Commissloners and applicant concurred that this Item should be
continued until the City Attorney's opinion Is obtained.
