MINUTES OF A REGULAR MEETING
May 22, 1972

Chairman McReynolds called the Regular Meeting of the Planning Commisslon of the Town
of Los Altos Hills to order at 7:50 P. M. at the Town Hall, 26379 Fremont Road, Los
Altos Hills, California. The following members answered roll call: Commissioners
Lachenbruch, Magruder, Mueller, Perkins, Spencer, and Chairman McReynolds. Commission-
er Weisbart arrived at 8:00 P. M. Absent: None.
CITY COUNCIL REPRESENTATIVE: Councilman Lee J. Kubby
APPROVAL OF MINUTES: May B. 1972.
Commissioner Spencer moved, Seconded by Magruder and carried by majority vote
(Commissioner Perkins abstaining since he was absent from the May 8th meeting),
that the Minutes of May 8, 1972 be approved as submitted.
COMMUNICATIONS: (PC -8: SI, T I - 300-350)
I. Letter and petition submitted by Mr. Duncan Curry, III, 26750 Almaden Court,
dated May 10, 1972, and residents of Almaden Court, were read. The residents of
Almaden Court are asking the Town to consider abandoning that portion of Almaden
Court which extends west from the bulb at the end of the cul-de-sac. They are
objecting to the possibility of Almaden Court becoming a through street by
connecting with Natoma Road at some future date.
The Commissioners concurred that this request should be agended at the next
meeting since they had not had sufficient time to review the request.
COMMITTEE REPORTS: (PC -8: SI, T I - 04 - 08)
1. Commissioner Magruder reported that the Adobe Creek Channel Committee had met and
that a written report had been circulated to Interested parties. He Indicated
that it would be August or later before the Santa Clara County Flood Control and
Water District would have more detailed information for the Committee's considera-
tion.

REVIEW PROPOSED 1972-73 BUDGET AND STUDY COMMISSION AND COMMITTEE RESPONSIBILITIES
AS THEY PERTAIN TO PLANNING.
Mr. Charles S. McCandless, Chairman of the Council appointed Open Space Committee,
presented the Inventory map Indicating all the land in Los Altos Hills currently un-
developed. Discussion ensued regarding how this Inventory would be used in develop -
Ing the Town's Open Space Element of the General Plan. Mr. George G. Mader, Town
Planner, reported he would use this Inventory as a tool but would hope that the
Citizens Committee could be called upon to give guidance as to priority of land to
be acquired for open space. The Commissioners unanimously expressed their apprecia-
tion and thanks to Mr. McCandless and his Committee for their fine work.

RECONVENE TO REGULAR SESSION: ITEM NOW:

VARIANCE REQUEST (V-366-72) TO ENCROACH
INTO THE REQUIRED 30' SETBACK FOR TENNIS
COURT AT 25698 ELENA ROAD. APPLICANT: HOWARD W. STOKES. (PC -8: S I, T I - 350)
The applicant has requested that this Item be continued to the June 26th meeting to
allow him time to contact the owners of the 24' wide easement on Vinedo Lane, In an
attempt to get this easement abandoned.
MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Magruder and
carried unanimously, that this Item be continued to the June 26th meeting.
ITEM NO. 2:
TENTATIVE MAP FOR HERMAN SPECTOR (386-72) 3 LOTS, 8.26+ ACRES, BLACK MOUNTAIN ROAD.
ENGR. J. W. RILEY. (PC -8: S I, T I - 400)
Staff reviewed this application, noting that It had been continued from the May 8th
meeting togive the applicant time to study In detail the exact location of the line
separating Parcels A and B and to supply additional detail for the Joint driveways
to Parcels A, B, and C, and Lot XI.
This new Information was presented and appeared to be satisfactory for the current
use and the proposed use when Parcel C and Lot MI are developed. It was noted that
the area of Parcels A and B is 0.14 acres shy of meeting slope density requirements.
Mr. J. W. Riley, engineer for the applicant, stated that the north line of Parcel B
can be rotated slightly to pick up this additional acreage.
MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Mueller and
carried unanimously, that the Check List be prepared.
The Tentative Check List was read and the following Items added:
2. ROADS: "(c) Parcel C has the right to dedicate easements over
Parcels A and B and Lot kl for roadway purposes."
ADDITIONAL CONDITIONS: "B. Comply fully with slope density requl rements
as determined by the Town Engineer."
MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Magruder and
carried unanimously that the Tentative Map of Herman Spector (386-72), 3 lots,
8.26+ acres, be approved, In accordance with the conditions of the Check List.
ITEM N0. 3: (PC -8: S I, T I - 520)
USE PERMIT FOR WESTWIND HUNGARIAN HORSE FARM (UP -369-72), AMENDING USE PERMIT
UP -351-71, LOCATED AT 27420 ALTAMOM ROAD, TO ADD ELEVEN STALLS TO THE EXISTING BARN.
Staff reported a review of the operation at Westwlnd Hungarian Horse Farm, show Ing
pictures of the Improvements that have been made since Use Permit UP -351-71 was
Issued on June 7, 1971. This application is to add a wing onto the existing barn
and Install the necessary landscaping to help soften the lines of the barn. This
addition will increase the number of existing scalls from 23 to 34. The maximum
number of horses allowed remains at forty-one (41).
it was suggested that a statement be added to the List of Conditions of Approval
originally Issued, which would require a letter of compliance from the applicant
stating that they will comply with the Fire Department's requirement for sprinklering
the entire barn by July I, 1976.
MOTION, SECONDED AND CARRIED: Commissioner Weisbart moved, seconded by Spencer and
ifto carried unanimously, that the list of Conditions of Approval be read.
MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Weisbart and
carried unanimously, to recommend that Use Permit UP -369-72) be granted to Westwind
Hungarian Horse Farm, subject to the List of Conditions of Approval dated May 22, 1972..

ITEM NO. 4: (PC -8: S I, T I - 800)
TENTATIVE MAP FOR JOSEPH SZABO (340-68) 2 LOTS, ALTA LANE SOUTH, AND REQUEST FOR
VARIANCE (V-370-72) TO SLOPE DENSITY REQUIREMENTS FOR SAID SUBDIVISION, AND APPROVAL
WOF 5' ENCROACHMENT OF THE EXISTING RESIDENCE AND POOL HOUSE INTO THE SIDEYARD SETBACK
ON LOT #I.
Staff reviewed this application for a variance and lot split. It was noted that
there were two variances being requested: (1) that the existing residence and pool
house would encroach Into the sideyard setback on Lot #1; and (2) that the parcel
does not have sufficient acreage to comply with current slope density requirements.
The Santa Clara County Health Department has Indicated that Lot #2 has insufficient
area for a drain system and therefore could not qualify as a building site at this
time. The Fire Department indicates that the water supply In that area Is below
standard and that certain improvements would have to be made before they could
approve the construction of a new residence.
Staff recommended that the Planning Comm lsslon consider the variances first, for if
they could not be granted, the parcel could not be subdivided.
Letters were read from Mrs. C. Daly King, 13021 Alta Lane North, and Mr. Patrick
Beatts, 13171 Alta Lane South, objecting to the granting of the variances and the
lot split. Mrs. P. Beatts spoke from the audience against the lot split, stating
that the traffic situation Is poor and that the Health and Fire Departments both
have recommended against the application of Mr. Szabo. It was rated that there are
eight houses being served by Alta Lane, a private cul-de-sac. Town Planner George G.
Mader Indicated that he could not find that all six required conditions exist and
therefore would have to recommend to the Planning Commission that the variances be
denied.
4 MOTION, SECONDED AND CARRIED: Commissioner Weisbart moved, seconded by Lachenbruch
and carried by majority vote, to deny the application of Joseph Szabo for the two
variances (V-370-72). Commissioner Magruder abstained stating he was a close
neighbor and therefore felt he should not vote on the matter.
Discussion on the subject of the lot split (340-68) brought out the fact that the
applicant Intends to appeal the Planning Commission's decision on the variances and
therefore it was felt that action on the subdivision should be continued to the
June 12th meeting. The applicant concurred In this suggestion.
MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Welsbart and
carried by majority vote (Magruder abstained) that the action on the request for
lot split be continued to June 12, 1972.
ITEM NO. 5: (PC -8: S I, T I - 1240 to end; PC -8: S 2, T I - 00 to 250)
TENTATIVE MAP FOR PAUL I. MYERS, JR. (387-72) 5 lots Julietta Lane. Engr. P. Nowak.
Staff presented their report, pointing out the request for a 5 -lot subdivision of
which one lot was Lot #7 of the Lands of Eshner Su,divisIon, Tract #4897, It was
noted that there is a 4' water easement running ccross lots #1 and 2 and a private
sewer easement crossing lot #3, all of which might Interfere with future buildings
on these lots. Staff recommended that these-asements be moved to avoid potential
problems. Lot #5 will be served over an existing 20' emergency access along the
northwesterly side of lot #4 and across the southwesterly portion of lot #4. There
will be provided an emergency fire road from Julletta Lane to Chaparral Way. Lot #5
(3.088 acres net) cannot be further subdivided under current slope density require-
ments. The applicant has presented a soil and geological Investigation report,
ANW prepared by Unified Soil Engineering, Inc., Indicating that the stability of the area

Is adequate for residential purposes.
MOTION was made by Commissloner Welsbart to have the Check List prepared, but the
MOTION DIED for lack of a Second. Applicant concurred with following Motion:
MOTION, SECONDED AND CARRIED: Commissioner Spencer, seconded by Mueller and carried
by majority vote, Chairman McReynolds abstaining since he Is a neighbor, to continue
the application of Paul I. Myers, Jr. (387-72) to the June 12th meeting to give
Staff sufficient time to request a review by Town Geologist, Dr. Jon C. Cummings.
ITEM NO. 6: (PC -8: S 2, T I - 250)
VARIANCE REQUEST (V-366-72) FOR REDUCTION OF REQUIRED FRONT 40' SETBACK TO 30' FOR
POOL AT 13920 FREMONT PINES LANE. APPLICANT: LIONEL W. CARUFEL. WITHDRAWN BY
APPLICANT.
Staff reported that since the last meeting Mr. Carufel, In consultation with his
architect, determined that the front of his property could be considered as that
portion facing the extension of Fremont Pines Road, and that being the case, would no
longer need a variance for the location of his pool and pool house. The City Manager
has concurred with this request and has received a letter from Mr. Carufel withdraw-
ing his application for a variance.
ITEM NO. 7: (PC -8: S 2, T I - 260)
ELECTION OF OFFICERS FOR PLANNING C%VISSION.
The following officers were elected by unanimous vote to serve a one year term:

ITEM NO. 8: (PC -8: S 2, T I - 300)
OTHER BUSINESS.
Staff presented a site development plan prepared by Wendell Roscoe for a lot on
Summitwood Road. This lot Is surrounded on three sides by Summitwood Road, thereby
causing a problem in determining building setbacks. The Commissioners felt that they
needed additional time to study this situation and suggested that It be considered
at the Wednesday night Study Session. Mr. Roscoe was asked to provide seven copies
of the plot plan in time for the Commissioners' revl ew, prior to Wednesday night.
ADJOURNMENT:
There being no further business, the meeting was adjourned at 12:20 A. M.
NEXT REGULAR MEETING: Monday, June 12, 1972 at 7:45 P. M. at the Town Hall.
