This report identifies existing and anticipated future cir- culation concern that need to be treated in revising the General Plan of Lop Altos Hills. As a part of this study, Mr. Mader noted basic policy questions had emerged regarding the circulation system and these questions should be dealt with prior to resolution of specific •raffic problems reviewed in his report. ADJOURN TO STUDY SESSION {Cont.) Planning Commission concurred that the Traffic Study would be scheduled for the September 25, 1972 Commission meeting under "Study Session' and also es an agended item. 2. PRESENTATION AND DISCUSSION OF THE GEMERAL PLAN GOALS REPORT Town Planner, George Mader, presented a document encompassing state- ments of assumptions, goals, objectives and principles recommended for inclusion in the revised General Plan for Los Altos Hills. Mr. Mader summarized this document and recommended that the Commission review this report prior to general distribution. 3. TENNIS COURTS The Town Planner reviewed his memorandum of June 22, 1972, which suggested some flexibility in the Zoning Ordinance regarding setback requirements for swimming pools and tennis courts. Further discussion was deferred since this item was agended as Scheduled Item No. S. RECESS: 9:00 P.M. to 9:15 P.M. RECONVENE TO REGULAR SESSION: 9:15 : P.M. Staff reviewed the applicant0s wish to split a 4.26 acre parcel into two building sites located at the and of So. Fork Lane, a private road. This item was continued from the August 28, 1972 Commission meeting to permit the Town Engineer and the Pathway Committee to determine the most feasible location for the pathway easement across the Lands of Stegner. MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Weisbart and carried unanimously to proceed with the Check List. MOTION, SECONDED AND CARRIED: Commissioner Weisbart moved, seconded by Mueller and carried unanimously to approve the Tentative Map of Lands of Stegner {389-72) in accordance with the approved Check List, dated Septsmier 11, 1972. ,HurDWLED ITEM NO 2: VARIANCE REQUEST OF O.A. GOTH TO ENCROACH WITHIN 8° OF A FRONT PROPERTY LINE AND 10• AND 11' OF SIDE PROPERTY LINES FOR TENNIS COURT AT 2060 PAGE MILL ROAD, AND TO ALLOW 10" HIGH FENCE WITHIN 25• SETBACK. This item was continued from the last meeting due to the lack of a quorum when Commissioner Magruder disqualified himself from the participation in the discussion because of personal friendship with the applicant. Staff reviewed the Variance request of O.A. Goth to -2- - SCHEDULED ITEM NO. 2: {Cont.} encroach Within 8' of a front property line and 10' and I1' of side property lines for a tennis court at 2060 Page Mill Road and to allow a 10' high fence within a 25+ setback. The Town Planner recapped the main aspects of the variance which he presented at the August 28, 1972 Commission meeting. Mr. 0. A. Goth, applicant, spoke on his own behalf and presented various slides supporting his request for a variance. It •waN the general consensus of the Commissioners that the lot would be ovar-used by adding a tennis court and that in reviewing the find- ings required by the six criteria of Section 9-5.905ibl of the Municipal Code, agreed no exceptional circumstances existed to justify the variance requested. MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Spencer and carried unanimously that the request of Variance, O.A. Goth, 0-376-72} to encroach within 8' of a front property line and 10" and 11' of side property lines for a tennis court at 2060 Page Mili Road and to allow a 10" high fence within the 25' setback be denied without prejudice. JUNTA TO ENCROACH WITHIN 25" OF THE EAST PROPERTY LINE AND 15' OF THE SOUTH PROPERTY LLJE FOR TENNIS COURT" 6 ON LOT 0. 3 AT THE END OF ARIC LANE, AND TO ALLOW A 10° HIGH FENCE `y WITHIN 25" SETBACK. Staff reviewed the Variance request of Dale W. Junta to encroach within 25' of the East property line and 15" of the Sa th property line for a tennis court on Lot No. 3 at the and of Aric Lane, and to allow a 10' high fence within the 25" setback. Floor participation was heard by George Cody, architect for the applicant, who spoke in behalf of his client. Commission concurred that since this land was undeveloped, perhaps the applicantAs architect could revise the house and tennis court layout to more conform to the setback requirements of the Town. The Commission in reviewing the findings required by the six criteria of Section 9-5.905Cbi of the Municipal Code, agreed no exceptional circumstances existed to justify the Variance requested. MOTION, SECONDED AND CARRIED: Commissioner Weisbart moved, seconded by Spencer and carried unanimously that the request of Dale W. Junta tv-377-721 to encroach within 25' of the East property line and 15' of the Soeth property line for a tennis court on Lot No. 3 at the and of Aric Lane and to allow a 10" high fence within the 25" setback be denied without prejudice. -3- A SCHEDULED ITEM No. 4: MITN971A PRM: LAN TJ REORGANIZE THE PLANNING FUNCTIONS OF THE TOWN Staff reviewed the August 9 minutes of the Reorganization Committee for the proposed plan to reorganize the planning functions of the Town. Councilman Miller stated that there were two areas on which the Committee were not in total agreement and requested the Planning Commissions comments: i.e., the number of Commissioners to serve C5, 7 or 91 and the rotation basis for serving on the Board of Planning Administration {BPA}. Commissioner Spencer recommended nine members serve on a rotating basis due to the workload and number of meetings involved. General discussion ensued on the merits of having nine versus Seven members. MOTION• SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Weisbart and carried unanimously that the Planning Commission recommend that the City Council proceed with the change as outlined in the chart and report with the exception that a seven member Planning Commission be increased to nine members which does include the two non-voting, rotating members. SCHEDULED ITEM NO. 5: REQUEST FROM CITY COUNCIL FOR PLANNING COMMISSION TO WORK ON GUIDE- LINES FOR THE LOCATION OF SWIMMING POOLS AND TENNIS COURTS ON PRIVATE PROPERTY* ESPECIALLY AS THEY RELATE TO SETBACKS. This item was continued from the August 28, 1472, Commission meeting. The Town Planner discussed his recommendations for setback requirements for swimming pools and tennis courts. General discussion ensued. It was recommended that the Town Planner write further guidelines for Commission review. SCHEDULED ITEM N0. 6: TMER'l= SS BY PLANNING COMMISSIONERS None.
