HomeMy WebLinkAbout10/10/1972PLANNING COMMISSION TOWN OF LOS ALTOS HILLS MINUTES OF A REGULAR MEETING October 10, 1972 REEL PC -10 SIDE 2 TRACK I 620 -END SIDE I TRACK 2 00-565 Chairman McReynolds called the regular meeting of the Planning Commissior of the Town of Los Altos Hills to order at 8:50 P.M. in the City Cpuncil Chambers of the Town Hall, 26379 Fremont Road, Los Altos Hills, California. The following members answered roll calls Ccmmissioners Lachenbruch, Mueller, Perkins, Spencer, Chairman McReynolds. Absent: Commissioners Magruder and Weisbart. CITY COUNCIL REPRESENTATIVES APPROVAL OF MINUTESt September 25, 1972 Commissioner Mueller moved, seconded by Perkins and carried unanimously that the minutes of September 25, 1972 be approved with the following corrections Page 4, Scheduled Item No. 4, Paragraph 4, should reads 4W Commissioners "Lachenbruch and Perkins" felt . COMMUNICATIONS: 1. Staff read a letter from Michael Stewart who asked for the tennis court setback requirements for Palo Alto whibh is a follow-up on the Juntas variance request denial. 2. The State of California, Dept. of Emergency Services, announced the release of the film °Earthquake' which may be hoorrowed from the OES Regional Offices. COMMITTEE REPORTS' 1. Commissioner Spencer reported on the discussion at the Pathway Committee meeting. 2. Commissioner Mueller reported on his attendance at the Policy Planning Committee in which the housing element was discussed. ANNOUNCEMENTSt 1. Staff announced the next Planning Commission meetings Monday, October 30th. A notice will be sent out later on in the month as a reminder. • ADJOURNED TO STUDY SESSION: 8:02 P.M. 1. REVIEW REPORT FROM GEORGE G. MADER% TOWN PLANNER, ENTITLED ^PRELIMINARY POLICY STATEMENT" The Town Planner, George Mader, iegan reviewing the Preliminary Policy Statement. Mr. Mader first asked if +ere were any questions on the Introductory comments before proceeding with the Assumptions on page 4. Each Assumption was reviewed and additions and/or changes were recom- mended and discussed. Mr. Mader then proceeded to discuss the next section on this policy statement. General discussion ensued. Under section "Regional Goals of Los Altos Hills' Mr. Mader stated that the Town has a concern with what happens beyond the Towns immediate boundaries and suggested that the Town have some statements on Regional Goals. Commissioner Perkins felt Items 1 and 2 under this section stood out by themselves on their own merits, but felt Item 3 should be deleted. Further review and discussion wasccurtailed At this point. This item is continued to the next Planning Commission meeting. RECESS: 9:05 P.M. RECONVENE TO REGULAR SESSION: 9:20 P.M. SCHEDULED ITEM NO. 1: REVIEW FOR ERVIR-0-07NTAL IMPACT OF VARIANCE APPLICATION FOR A REDUCTION OF SIDEYARD SETBACK FOR A TENNIS COURT FOR HOWARD STOKES, 25698 ELENA RD Mr. Stokes had appealed to the City Council the Planning Commissions decision to deny his variance request. Due to the City Attorney0a announcement regarding the environmental impact ruling, the City Council referred this matter back to the Planning Commission for a recommendation on environmental impact only. Staff and Planning Commission reviewed the guidelines to determine degree of environmental impact. MOTION, SECONDED AND CARRIED: Commissioner Lachenbruch moved, seconded by Perkins and carried unanimously that the Environmental Impact of the Variance application for a reduction of sideyard setback for a tennis court for Howard Stokes, 25698 Elena Road CV -366-72) is limited to a local visual effect and in a gross environmental sense this is judged to be trivial, however, this judgement in no way effects the earlier findings and recommendations of this variance. For the record, Commissioner Spencer stated this is a misuse of the Supreme Court+s decision regarding environmental impact. The environ- mental impact is intended to cover such things as subdivisions, major land changes, but not individual lots, individual tennis courts or individual swimming pools: that 1s not the purpose of this rulling; it is to protect a major community such as the Mammoth Case', extending these to individual situations 1s a waste of applicant and Towns time. f -2- SCHEDULED ITEM NO. 2: REVIEW FOR ENYIRONMENTAL IMPACT OF BUILDING SITE APPROVAL FOR W.H. WOLFF, LOT •2, TRACT • 2093, (ON LA CRESTA DRIVE OPPOSITE CARILLO LANE) This Building Site Approval was referred from the City Coundil to the Planning Commission for a recommendation for environmental impact only. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Mueller and carried unanimously that the Environmental Impact of this Building Site Approval for W.H. Wolff, {BSL -86-72), Lot •2, Tract 02093 ton La Cresta Drive opposite Carrillo Lane) was trivial. SCHEDULED ITEM NO. 3: REOUEST FOR VAR ANCE TO REDUCE REAR YARD SETBACK {FROM PRIVATE ROAD) FROM 309 TO 20' FOR THE GARAGE OF NEW RESIDENCE ON LOT •2, TRACT 02093, APPLICANT: NORMAN R. BERGRUN Staff reviewed this variance request which was agended for the last Planning Commission meeting but due to some technical errors on the applicant0s map was carried over to this meeting. The Town Planner reviewed this variance request. Speaking frm the floor, Mr. Bergrun spoke on his own behalf. MOTION, SECONDED AND CARRIED: Commissioner Lachenbruch moved, seconded by Perkins and carried unanimously that the request of Norman R. Bergran <V-378-721 to reduce rear yard setback {from private road) from 30' to 209 for the garage of new residence -in Lot •2, Tract 02093 met the six criteria of Section 9-5.905(b) of the Munt ipal Code and be approved conditional upon the Site Development Committee+s approval of requested additional landscaping of the structuress supports. SCHEDULED ITEM NO. 4: REQUESTOR FAR-90-1—MR-r. SITE APPROVAL {BSA -87-72) FOR LOT •4, TRACT •2043 <ON LA LOMA DRIVE) APPLICANT: WM. T. POWELL Staff reviewed this request for Building Site Approval {BSA -87-72) for a lot served by a private driveway from La Loma. Staff noted that this lot is in the proposed sewer assessment district number 10, which is In the process of being formed, and therefore, should be served by a sanitary sewer rather than a septic tank. Speaking from the floor, Mr. William Powell, Applicant, spoke on his own behalf. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Mueller and carried unanimously that the Environmental Impact of the Building Site Approval for Wm. T. Powell {BSA -87-72) for Lot 04, Tract 02043 ton La Loma Drive) alas trivial. MOTION. SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Perkins and carried unanimously to approve the request for Building Site Approval, Wm. T. Powell {BSA -67-72) for Lot 04, Tract 02043 ton Le Loma Drive) in accordance with the approved Check List dated October 101 1472. -3- SCHEDULED ITEM N0. SCHEDULED ITEM NO. 69 SET PUBLfC`­H_EA_R_1WG_0N AMENDMENTS TO TITLE 9, CHAPTER 5 {ZONING}, OF THE LOS ALTOS HILLS MUNICIPAL CODE FOR NOVEMBER 13TH PLANNING COMMISSION MEETING Staff recommended that this Public Hearing be set for November 13, 1472 since the October 30th agenda was quite heavy. However, the Town Planner felt that changes should be discussed since this ordinance had to be retyped and, thus, these changes could be incorporated at this time. General discussion ensued. MOTION, SECONDED AND CARRIED= Commissioner Spencer moved, seconded by Perkins and passed unanimously that a Public Hearing on Amendments to Title 9, Chapter 5 {Zoning} of the Los Altos Hills Municipal Code be set for the November 13, 1972 Planning Commission meeting. OTHER BUSINESS BY PLANNING COMMISSIONERS9 1. Staff reported that the Town had to respond to the Environmental Impact Study prepared by the Santa Clara County Flood Control and Water District on the Adobe Creek Channel.
