The following members answered roll call: Present: Commissioners Iachenbruch, Magruder, Spencer, Weisbart and Vice Chairman Mueller. Absent: Commissioner Perkins. Chairman McReynolds arrived at 8:10 P.M. CITY COUNCIL REPRESENTATIVE: Councilman Kubby APPROVAL OF MINUTES: December 27, 1972 MOTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by Weisbart and carried by majority vote (Commissioner Magruder abstained as absent) that the minutes of December 27, 1972 be approved as written with the following corrections: Page 2, Study Session, Item 1: change "deoxygenization" to 1.reoxygenizatlon". Page 4, Scheduled Item No. 3, change motion to read: MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by lachenbruch and carried by majority vote (Commissioner Weisbart abstained) that the Planning Commission finds that the facts presented in connection with this variance request established, beyond reasonable doubt, the requirements setforth in Section 9.5.905(b) of the Municipal Code and grant the variance request of Dr. Abraham A. Goetz (V-380-72) for a 25' reduction of aide setback line (from 30' to 5') for a cabana at 12791 West Sunset Drive, and that the environmental impact is trivial. COMMUNICATIONS: None. SPANGLE & ASSOCIATES, TOWN PLANNER Mr. George Mader, Town Planner reviewed his memorandum to the Commission dated December 28, 1972, re: Continuation of Modifications to Revised Policies Statement, dated December 27, 1972, based on Planning Commission Directives given at Study I.- Session held December 27, 1972. Mr. Mader stated that if the Commission concurs, STUDY SESSION, ITEM NO. I (Cont.) the revised Policies Statcment will be retyped to include all changes and then this +`i document will then be enc lable for use by the Commission, Council and other Town Officials and staff. Mader reviewed hii memo to the Commission dated December 11, 1972 re: Setback requirements for Tenni,. Courts. Commissioner Lachwnbruch felt Mr. Mader did an excellent job in s='mrizing the points that the Commission had raised in past discussions, and thct he was consistent with the Town's attitude toward tennis courts. fir.. Mader felt that it was appropriate to indicate to the City Council that the Commission is considering adopting this policy statement and that the Town Attorney would be checking it before final adoption. Commissioner Ischenbruch felt it was important to get the reaction of the Council; Commission concurred to submit this Policy statement to both the City Council and the City Attorney at the same time. Councilman Kubby stated that he felt the Commission had accomplished only half of the Job that the Council had asked: i.e., draw up a policy statement for tennis courts and swimming pools. Councilman Kubby felt that the policy statement covered tennis courts but that swimming pools were not adequately covered. Commission concurred and directed the Town Planner to write a policy statement that would Include both tennis courts and swimming pools and have this statement ready for review at the next Commission meeting, 3. Mader reviewed this report and reviewed the comments made at the last Commission meeting. Commissioner Iachenbruch stated he fully agreed with Commissioner Perkins' statements made at the last meeting. Commissioner Iachenbruch felt there were two important factors that should be brought out. 1) The misrepresentation in this report of the word 'minority': i.e., minority . low ncome; low income a minority. There is a very clear criterion by which you can describe the effect of low density zoning --economical. 2) The righteous implication that business should be run for the public welfare. Business should have a legitimate right to make a judgment. General discussion ensued evolving around Commissioner lechenbruch's statements. Commissioner McReynolds stated he was not prepared to support any of the report's six recommendations at this point as he didn't feel the report considered both aides of the issue; therefore, both sides should be represented before this report can be considered. Commission concurred and asked the Town Planner to prepare a brief summary of comments made by Commissioners lechenbruch, Perkins and McReynolds in the form of a statement that could be sent to the City Council for their concurrence and submittal to the County along with a covering letter. -2- RECESS: 8:55 P.M. Commissioner Spencer excused himself at this time. RECONVENE TO REGULAR SESSION: 9:10 P.M. SCAEDULID ITEM N0. 1: TENTATIVE MAP OF WILLIAM E. JARVIS (394-72) 3 LOTS, 12.65 GR. ACRES, PAGE MILL ROAD. ENGR.: J.W. RILEY The Town Planner reviewed the discussion which ensued at the last planning Commission meeting regarding the route of the path connecting Page Mill Road and the Lands of Stanford University. Since Mr. Jarvis objected to having a path run through the sub- division and residents on Garth Lane objected to a path along their private road, Staff was asked to study the area for another alternate route. The Town Engineer has reviewed Christophers lane and the public right-of-way between lots 9 and 10. It is Staff's opinion that Christophers Lane and this 40' public right-of-way could serve as an adequate alternate trail from page Mill Road to the Lands of Stanford. If the Commission concurs, then the requirements for a through path from Page Mill Road to the lands of the Sierra Club could be waived. Mr. Mader then reviewed his memo to the Planning Commission, dated January 10, 1973, outlining three observations regarding the trail which were offered to the Commission for consideration. Commissioner lachenbruch stated that Christophers lane was the logical access to Stanford lands; although it wasn't the kind of trail the Town should have, it would get people from Page Mill Road to Stanford land. He further stated that this was an interesting solution to the problem. Commissioner Mueller concurred with Commissioner Iachenbruch. Mr, Bob Stutz, Chairman of the Pathway Committee, stated that the Committee feels the five acres of tie Sierra Club would be opened for public use and this would be the last opportunity to get access to this land, Mr. Stutz felt the Staff should contact the Sierra Club for their comments on the long range use of this property. Mr. M. Fritseble comments on the Sierra Club access of Garth Lane. MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Weisbart and carried unanimously to proceed with the Check List dated December 13, 1972. MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Weisbart and carried unanimously to approve the Tentative Map of William E. Jarvis (394-72) 3 lots, 12.65 Sr. acres, Page Mill Road in accordance with the amended Check List dated Dacem'oer 13, 1972 and that the environmental impact is trivial. uu^CREDULID ITEM iIO. 2 VARIANCE REQUEST OF JOHN A. GUI13ERT (V-361-72) FOR AN 8' REDUCTION OF SIDE SEMACE LINE (FROM 30' TO 221) FOR A POOL AT 12930 TRIPOLI COURT. :"ha T>wn Planner reviewed this variance request stating that this item was continued from the last meeting so that Staff could review the Building Permit and the Site Development Permit, issued to the applicant in 1970, prior to the building of their i_ome. -3- SCHEDULED ITEM NO. 2 (cont.) Staff finds that all requirements of that Site Development Permit have been met and recommends that the applicant be required to landscape heavily the area between the applicant's home and the Schneider property. A permit has been issued the applicant for the construction of a retaining wall to hold this raised area and eliminate the need of a sloping bank. The applicant agrees to the planting of rose bushes and oleanders along the entire length of the joint property line, occupied by the raised area. With this heavy planting, it would appear that there will be no adverse impact on the neighbor (Mr. Schneider). Staff recommended approval. Mr. Schneider, a concerned neighbor, asked clarification on how close to the property line can grading be done. General discussion ensued between the Commission members and Mr. Schneider regarding Mr. Guilbert's variance request and pool site location. MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by lachenbruch and carried by majority vote (Commissioner Weisbart voted no) that the Planning Commission finds that the facts presented in connection with the application of Mr. J.A. Guilbert (V-361-72) for an 8' reduction of side setback line (from 30' to 221) for a pool at 12930 Tripoli Court establishes beyond a reasonable doubt the requirements of Section 9. 5.905(b) of the Municipal Code and that the variance, as requested, is granted with the following conditions as setforth in the Staff Report dated January 10, 1973, and that the environmental impact is trivial. 1. The variance allows a pool as shown on the site plan submitted with the application and received by the Town on December 6, 1972 with the provision that the pool be moved eight feet in a generally eastward direction and parallel to the garage. The ends of the pool would then be approximately 23 ft. and 29 ft. from the southern property line. 2. The applicant shall plant along the southern property boundary for a distance of at least 100 ft. so as to provide visual screening between the pool and the neighboring property. A substantial number of the plants shall be of at least 5 gallon size. The plans shall be satisfactory to the Site Review Committee before issuance of the building permit and the applicant shall submit an acceptable planting schedule. 3. The applicant shall submit plans for planting along the southern property line necessary as a part of prior grading on the property (under a 1970 site development permit) satisfactory to the Site Review Committee and Mr. F. C. Schneider prior to issuance of a building permit for the pool. SCREDUIJ3M ITEM ITO. 3: TENTATIVE MAP OF EDGERTON COOLEY (396-72), 12 LATS, 20.54 GR. ACRES ON EDCERTON ROAD. ENGR.: J.W. RILEY MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Weisbart and carried unanimously to continue the Tentative Map request of Edgerton Cooley (396-72) to the January 24, 1973 Planning Commission meeting. OTHER BUSINESS BY PLANNM COMMISSIONERS: 1. MOTION, SECONDED AND CARRIED: Commissioner Magruder moved, seconded by Weisbart and carried unanimously to have the revised Preliminary Policy Statement retyped and then forwarded to the City Council for their review and information.
