MINUTES OF A REGULAR MEETING
March 28, 1973

The Study Session of the Planning Commission of the Town of Los Altos Hills
met at 8:00 PIA, with Chal man Thomas McReynolds presiding.
A. ITEMS FOR DISCUSSION:
1. Possible recommendation to State Legislature that State Subdivision
Map Law be revised to permit flagging of Subdivision Maps, alerting
potential buyers to earth slippage or other, geological hazards.
Town Planner George Mader revI awed a current State Law which allows
cities to adopt ordinances requiring that property reports must be
obtained from the City by the responsible real estate agent prior to
resale of land with a house on It. Mr. Mader further Indicated that
this law could be expanded, within the limits of the State Law, to
111W cover new and undeveloped pieces of land as well.
Following discussion, it was agreed that a motion recommending adoption
of a Property Report ordinance for Los Altos Hills be presented at
the regular meeting following Study Session.
Discussion of Hillside Subcommittee of Planning Policy Council
recommendations regarding Montebello Ridge Study.
Following discussion, the Planning Commission directed that Staff
write a letter to the Hillside Subcommittee of the Planning Policy
Committee Incorporating the CommIssionts conclusions that It
cannot properly evaluate the Study or make recommendations on It
without having more complete Information as to topography, ownership,
slope, geology, etc., and that the May 10, 1973, deadline date for
Planning Commission appraisal, does not allow enough time to
evaluate the Study properly.
3. Commissioner Perkins requested that the Staff provide the follow Ing
materials for Planning Commission reference In studying applications
for subdivision, variance, building site approval, etc.: (a) List
of Town Ordinances, (b) updated I" to 4001 scale maps, (c) List of
private roads now existing in the Town.

Chairman Thomas McReynolds called the regular meeting of the Planning Commis-
sion of the Town of Los Altos Hills to order at 9:00 p.m. In the Council
Chambers of Town Hall, 26379 Fremont Road, Los Altos Hills, California.
City Council Representative: Mayor Helgesson
A. ROLL CALL:
Present: Commissioners McReynolds, Magruder, Spencer, Welsbart, Perkins
Absent: Commissioners Mueller and Lachenbruch
B. CONSENT CALENDAR:
I. APPROVAL OF MINUTES: March 14, 1973
MOTION, SECONDED AND CARRIED: Commissioner Spencer moved, seconded by
Welsbart and carried by majority vote with Commissioners McReynolds
and Perkins abstaining due to absence from the last meeting, to adopt
the CONSENT CALENDAR of March 14, 1973.
C. NEW BUSINESS:
1. REQUEST FOR BUILDING SITE APPROVAL: for one Lot, known as Lot #2,
Tract 3306, located on Radcliffe Lane (File No. BSA -95-73).
Applicant: D.F. Swannack (c/o Bob Card Builders, 960 N. San Antonio
fbw Road, Los Altos).
MOTION, SECONDED AND CARRIED: Commissioner Spencer moved,
seconded by Commissioner Weisbart, and carried unanimously that
the request for Building Site Approval be approved subject to
the conditions noted In the Staff Report of March 22, 1973, as
follows:
1. Connect to existing sanitary sewer system.
2. Obtain water for domestic purposes from the Purissima Hills
County Water District.
3. A soils and geologic report shall be furnished for the site
and found to be acceptable to the Town Engineer.
4. The private road pavement shall be widened to 161 and con-
structed to Town standards.
5. A 4' wide rock path shall be constructed within the private
road easement on the southerly side of the road.
6. The applicant shall enter Into a continuing maintenance
agreement for the private road satisfactory to the City
Manager.
7. A 151 path easement shall be provided along Arastradero Road.

Applicant: Bahl Homes, 40 Woodhams Road, Santa Clara. Engineer:
Stan Schupp & Associates, Dublin, California.
City Manager Bruce C. Lawson Indicated to the Commission that the
application before them was a Request for Filing of Tentative Map, not
a hearing item, further stating that the Staff recommends that the Map
not be accepted for filing or hearing by the Commission until It com-
plies In all particulars with the ordinance pertaining to subdivisions
within the Town.
Speaking from the floor, the applicant, Don Bahl, Bahl Homes,
requested that conditional exceptions be permitted In the filing of
the Map. Town Planner George Mader advised the Planning Commission
that conditional exceptions may be presented along with the Map, which
must, however, first include all Information required by the Ordinance.
Mr. Mader stated further that a conditional exception already
requested by the applicant was a sales office Incorporated Into plans
for the subdivision, and that this did not constitute a conditional
exception, but rather a violation of the Zoning Ordinance.
Follow Ing discussion, the Planning Commission recommended to the
applicant that he present a Map to Staff which complies In every
regard with the requirements of the Ordinance, for eventual hearing by
the Planning Commission.
4W 3. APPLICATION FOR VARIANCE: For reduction In setback for lath -greenhouse
and pergola at 12179 Hilltop Drive, Los Al-ros Hills (File No. V-385-73)
Applicant: James R. and Mary F. Blackaby, 12179 Hilltop Dr.,Los Altos
Hills.
MOTION, SECONDED AND CARRIED: Commissioner Perkins moved,
seconded by Commissioner Magruder, and carried unani mously
that the request for Variance be approved subject to the
conditions listed In the Staff Report of March 22, 1973, as
follows:
1. That the lath greenhouse be constructed of non -reflective
materials of a color compatible with the existing residence
and adjacent landscape. Final plans for the structure
Including construction materials and color shall be
approved by the Town Engineer prior to Issuance of a
building permit.
2. Any proposed alterations to drainage shall be approved by
the Town Engineer.

4. APPLICATION FOR USE PERMIT: Request for Permit to board horses at
Z4970 -0'Koefe Lane (known as Shalom Acres). (File No. UP -386-73).
Applicant: Frank Ugle, 196 Santa Monica Ave., Menlo Park. A Use Per-
mit has been Issued and Is In effect to Zachary Brandstetter at the
above address for the boarding of 14 horses. Approval of a new Use
Permit Is required In the transfer of ownership from Mr. Brandstetter
to Mr. Ugle.
MOTION, SECONDED AND CARRIED: Commissioner Welsbart moved,
seconded by Commissioner Perkins and carried unanimously that
the request for Use Permit be approved subject to the
conditions noted in the Staff Report of March 22, 1973, as well
as the additional conditions required at the time of the origi-
nal application of Zachary Brandstetter. Said conditions are
as follows:
1. Only those buildings, corrals, and associated facilities
shown on the plot plan dated March 6, 1973, and received
March 6, 1973, are allowed on the site.
2. This use permit shall be Issued In the name of Frank K.
Ugle and the life of this permit shall run with the life of
the ownership of the property or until It Is amended or
cancelled.
3. No structures which relate to the boarding of horses that
are not shown on the plot plan referred to In Item No. I
liar shall be erected without an amendment to this Use Permit.
There Is no Implication of the continued use of the non-
conforming structure which will house the restrooms.
4. All driveways and parking areas used by guests shall be
paved sufficient to control dust. The cars of all guests
and visitors shall at all times be parked on the property.
5. The trees and brush adjacent to this property along O'Keefe
Lane shall be kept tri wed back so that the full paved
width of O'Keefe Lane Is available for traffic.
6. Parking on either side of O'Keefe Lane adjacent to this
property shall be prohibited and posted.
7. Any condition of the Santa Clara County Health Department
and/or the Los Altos Fire Department issued pursuant to
duly vested legal authority shall be met.
8. Public riding Instruction shall not be given, but this
shall not be deemed to prohibit giving of Instruction to
the owners of horses bearded on the premises and to me�
bars of their I mediate families.

9. There shall be no outdoor lights, except those required for
safety, and they shall be adequately shielded to prevent
4hW any nuisance to adjoining property owners.
10. There shall be no public address system.
11. There shall be one competent person on the premises at all
times, who Is capable of caring for said premises.
12. The total maximum number of horses or other hoofed animals
shall not exceed the number of fourteen (14).
13. This Use Permit Is to cover only 3.125+ acres (Assessor's
Parcel No. 175-39-00).
14. All manure shall be hauled away and disposed of as often
as required to maintain sanitary conditions, unless a
different system Is approved by the Santa Clara County
Health Department.
15. This Use Permit shall be reviewed annually at the time of
Business License renewal to assure compliance with the
above conditions, and all conditions shall be subject to
amendment and/or additional condItIons deemed necessary by
the City Council, and to assure compliance with Ordinances
No. 78 and No. 179, as amended. This revi ew shall be con -
AW ducted at a duly noticed Public Hearing.
5. APPLICATION FOR VARIANCE: For tennis court on Lot #3, end of ArIc Lane.
(File No. V-377-72) Applicant: Mr. and Mrs. Dale W. Junta, 904
Elsinore Drive, Palo Alto.
The application was continued to the regular Planning Commission
meeting of April 11, 1973, due to the absence of the applicant or any
representative for him at this hearing.
D. ADDITIONAL BUSINESS:
1. Further to Its Study Session discussion of a Property Report require-
ment In the Town, the follow Ing was resolved:
MOTION, SECONDED AND CARRIED: Commissioner PerkIns moved,
seconded by Commissioner Spencer, and carried unanimously that
the Planning Commission recommend that the City Council
Instruct the City Attorney and Staff to prepare an ordinance
requiring the seller of any real property within the Town,
to obtain a Property Report to be Issued by the Town and Indi-
cating any probi ems relating to the property, building appro-
vals Issued or denied, setbacks, etc., such Report to have a
fee affixed to It and required to be obtained by the seller
prior to transfer of the property.

2. Commissioner Perkins requested clarification of the City Council's
#6V action, In Its regular meeting of March 7, 1973, In which the
checklist pertaining to the Subdivision of Lands of Edgerton Cooley
(see Planning Commission Minutes of February 28, 1973) was changed
to require multi-purpose paths throughout the subdivision In both
exterior and Interior areas.
Mr. Lawson reported that the Intent of the City Council was to allow
equestrian as well as pedestrian traffic throughout the subdivision's
path system, and that the decision pertained to use rather than the
construction of the paths Involved.
