HomeMy WebLinkAbout04/25/1973PLANNING COMMISSION "TOWN OF LOS ALTOS HILLS MINUTES OF A REGULAR MEETING Preceded by a Study Session April 25, 1973 Study Session Reel PC 15; Side I; Track 1 000-936 The Study Session of the Planning Commission of the Town of Los Altos Hl l is met at 8:00p.m., with Chairman McReynolds presiding. A. ITEMS FOR DISCUSSION 1. Review of those portions of the Town's budget for the fiscal year 1973-74 which pertain to planning areas including that portion covering a potential study of geological faults. City Manager, Bruce Lawson, reviewed the proposed Planning budget for fiscal year 1973-74 to the Commissioners, pointing out that the 1973-74 budget would be a Program Budget. Nr. Lawson explained that to more accurately reflect the cost of providing services with respect to administration of the zoning ordinance and other statutory procedures, processing and review of zoning, Use Permits, Variances, Building Site Approvals and Sub -Division Maps by the Town Planner, the cost should be charged against the budget and the revenues should be charged as revenues. Mr. Lawson pointed out that this Is an accounting change and will not affect the actual operations. Town Planner, George Mader, read the proposal that Mr. Dickinson of Stanford University had submitted In regard to the Geological Hazard Study Program portion of the budget. The work to be provided In 1973-74, at a cost of $5,500, would Include a general geologic map and a preliminary fault -trace map of the half of the Town traversed by the Black Mountain fault complex. The report would provide a general Indication of the potential rift hazard from fault rupture within the Town limits. During 1974-75, at a cost of $7,500, they would provide the Town with a specific evaluation of the potential for rift hazard for each fault trace mapped. These costs would Include all expenses Incurred by the geologist, Including salary. Mr. Mader pointed out that the California Council on Int,r-Governmental Relations is going to adopt guidelines which will require that those elements be adopted by communities by approximately September, 1974. Following discussion by the Commission, It was agreed that the Town Planner, George Mader, should see what the cost would be to obtain these services from a professional firm rather than an Institution such as Stanford University. In all other areas, the Commission concurred with the budget as presented. Town Planner, George Mader, stated that by the end of this fiscal year the General Plan revision would be presented to the Commission for study. Those portions presented would Include land use, circulation, housing, recreation, conservation and open space. The policy portion of the General Plan has previously been approved. Immediate action may need to be taken on the open space and conservation portion of the General Plan. City Council Representative: Councilman Kubby A. ROLL CALL Present: Commissioners McReynolds, Mueller, Magruder, Lachenbruch, Spencer, Welsbart, Perkins Absent: None B. CONSENT CALENDAR 4 I. APPROVAL OF MINUTES: April 11, 1973 Commissioner Mueller moved, seconded by Spencer, and carried by majority vote, with Commissioners McReynolds and Perkins abstaining due to aSsence from the last meeting, to adopt the CONSENT CALENDAR of April 25, 1973. C. CONTINUING BUSINESS: I. APPLICATION FOR VARIANCE: For tennis court on Lot #3, end of Aric Lane. (File No. V-377-72) Applicant: Mr. and Mrs. Dale W. Junta, 904 Elsinore Drive, Palo Alto, California Town Planner, George Mader, Illustrated Mr. Junta's request for variance. He pointed out that the court could be placed on the property to comply with the set -backs, but It was Mr. Junta's desire to place the tennis court from seven to ten feet beyond the set back lines on two sides. It was the opinion of Staff that Mr. Junta's request was not consistent with variances granted in the past. Speaking from the floor, Mr. Junta further Illustrated his request for variance, pointing out the fact that he had redesigned his home to facilitate the building of the tennis court. After discussion, it was agreed by the Commission that Mr. Junta's application did not meet any of the six requirements to grant a variance. PLANNING COMMISSION MINUTES APRIL 25, 1973 PAGE 2 MOTION, SECONDED AND CARRIED: Commissloner Lachenbruch moved, seconded by Commissioner Weisbart and carried by majority vote with Commissioner Spencer opposed that the application of Dale W. Junta for variance be denied. Town Planner, George Mader, advised Mr. Junta of the 10 -day appeal process that Is open to him. 2. REQUEST FOR ACCEPTANCE FOR FILING OF TENTATIVE MAP: Lands of Marcus Stedman, 16 lots, Page Mill at Three Forks Lane (File No. 393-72) Applicant: Bahl Homes, 40 WooBhams ssoRoad, Santa Clara, California. Engineer; Stan Schupp Dublin, California. Town Engineer, Alec Russell, advised the commission that there was no action necessary on the tentative map request. It was just a process of acceptance by the Commission to give the Staff time to revl ew it and It will then come back to the Commission for consideration. Mr. Lawson pointed out that this map was briefly discussed at the last meeting and at that time there were many areas which did not the mapwtohSubdivision with'the Ordinanceein someOflhas the areas and in ic those that did not, he has specifically asked for an exception. The map does comply with requirements for acceptance of filing. MOVED, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by Commissloner Welsbart, and carried by majority vote with Commissioner Lachenbruch abstaining, that the Tentative Map for Lands of Marcus Stedman be accepted for filing. D. NEW BUSINESS: I. Further to his attendance as Planning Commission representative at the regular meting of the City Council of April IB, 1973, Commissioner Mueller spoke in favor of consulting the firm of Livingston and Blaney to learn the cost and content of a possible study by that firm, analyzing alternative future uses of the Adobe Creek Lodge property. Following discussion, it was agreed that consideration of potential uses of the Adobe Creek Lodge property be continued to the Planning requestedCStaffstonAgnda provide aotopographical map ofCt el further property in question prior to their consideration. 2. REQUEST FOR BUILDING PERMIT: Applicant: Mr. and Mrs. Robert Robson, 10723 Magdalena. Road, Los Altos Hills. k. PLANNING COtiwMiSSION MINUTES APRIL 25, 1973 PAGE 3 Mr. Lawson and Town Planner, George Mader, submitted the plans requesting a building permit for an addition to the garage of i Mr. and Mrs. Robert Robson. Mr. Lawson asked the Commission for 4y an interpretation of the Ordinance 207 with respect to property and easement lines. Mr. Lawson pointed out that although the building was within the set back requirements of the property, It did not meet set back requirements within the easement line. Mr. Mader felt that the Robsons should be required to file for a variance since the building plans were not meeting the required setback from the easement line. After discussion by the Commission, It was agreed that It was the Intent of the Ordinance to Include all easements and that since the building did not meet the set back requirement, a variance should be required. The Commission advised Mr. Mader to make the necessary revisions to Ordinance 207, Paragraph 2, so that It would include all easements as well as property lines. However, final determination on this particular problem should be made by the City Attorney. 3. REQUEST FOR USE PERMIT: Applicant: Los Altos Hills Horsemen's Association. (File No. UP 388-73) Located on Purissima by the Little League Ball Park. Use Permit request for Public Riding Ring. Mr. Lawson explained that the plans for the Public Riding Ring, which were passed out to the Commissioners, were for their review only and that It would be an Agenda Item at the next Commission meeting on May 9, 1973.
