Chairman McReynolds called the special meeting of the Planning Commission of
the Town of Los Altos Hills to order at 8:00 p.m. in the Council Chambers
of Tovin Hall, 26379 Fremont Road, Los Altos Hills, California

Present: Commissioners Lachenbruch, Perkins, Spencer, Ueisbart and
Chairman McReynolds.
Absent: Commissioners Magruder and Mueller

1. APPLICATION FOR A USE PERAIT: Mr. David Bellucci, Applicant.
Request for a Use Permit for a non-profit recreational facility to
be located on Boody Road.
Mr. Lawson gave a brief summary of the progress rade on the Use Permit
Application for Hr. David Bellucci at the last Commission Meet?ng.
Mr. Lawson stated that he was of the understadJing that the Public Hearing
process in the review of this application, had been closed at the last
meeting and has been carried to this meeting for further discussion by
the Commission and action.
41r. Lawson further pointed out that the Comnisison need not take further
testimony on the Use Permit and that if the Commission voted on the
Use Permit the matter could end with the Commission unless the Council
chooses to review the decision of the Planning Commission, in which case
it would be set for Public Hearing.
Mr. Mader advised the Commission the Use Permits must meet all the require-
ments listed before it can be granted, just as a variance must meet all
the six requirements listed.
The Commission was in agreement that it would be in the best interests of
the applicant and the Town to continue to hear ccmments from the public
and to review correspondence received from residents in the area of the
proposed Use Pernit.
Mr. Lao -son read the correspondence received from ?r. James a Saeba,
Nr. Uiiliam S. Phy and Mr. J. 1•1. McCleary. All three letters were opposing
the approval of the Use Permit and expressed areas of concern with regard to
traffic, drainage, etc..
Commissioner 4leisbart felt that since for. 5ellucci was under the impression
%, that the Public Hearing hard bean closed at t'le last regular meeting of
the Planning Commission, he should have the right to have his application
heard at the Council meeting, as a public hearing, when he would be able
to prepare and notify people who would speak in his behalf.
fir. Lawson pointed out that if Fir. Bellucci was not satisfied with the
decision of the Commission, he had the right to appeal the decision, or
any portion of it, to the Council and at that time it will be set for public
hearing.
The Commission expressed concern over the fact that the map, as presented
by fir. Bellucci, was out of scale. lir. Mader pointed out that the portion
of the map that was not to scale was the stadium. He stated that the rest
Df the mar could be-computed:at one' incb,equal 131 feet. -'A(? further
pointed out that the size of the area needed was computed at five square
feet per spectator.
Mr. Mader felt that it was not necessary for the Commission to concern
itself with size at this time since one of the requirements of the staff
memorandum would be for fir. Sellucci to provide the Commission with a
nap that showed everything to scale.
fir. flader reviewed the recommendations of the staff with tine Commission.
Curing the review changes were made in the wording of the recommendations
and the final recommendations read as follows:
4 1. The permit is for a non-orofit private tennis and swim club with a
maximum membership of 1,000 families.
2. The following facilities are permitted
(1) Three swimming pools
(2) One wading pool
(3) Locker rooms
(4) Dressing rooms and showers
(B) One staff housing unit
(6) Three rental units (To be converted into staff housing for the
Los Altos Hills P.acquat Club).
(7) Owner's residence
(8) Two tennis courts
(9) Playgrounds, recreational areas, gardens lar;ns
Additional facilities planned which include:
(1) Flo mere tennis courts than can be fit in the area shown on the
Site 0eve10rment.
(2) Championship tennis court
(3) Buildings to house locker rooms, lounge and small pro shop.
L 3. The championship tennis court shall be allowed to have a permanent
4/ seating capacity of 3,000 persons with room for an additional seating
for 3.000.

4. The only permitted tennis tournaments open to other than club members
`� are the annual Pacific Coast Intarnational Tournament and five lesser
`' tournaments per year with attendance not aceeding 3,000 persons each,
to be organized and run by the Tennis Patrons of 1!orthern California, a
non-profit coPporation. There shall be no limit to the number of inter-
club tournaments.
5. All provisions for lighting shall be to the satisfaction of the Envir-
onmental Planning Commission and all sound amplification shall be
reviewed by the Noise Ahatement Committee and the Environmental Planning
Commission.
6. The property included (Assessor's parcels 351-03-002 and 182-24-004.)
shall be used exclusively for the permitted tennis and swim club except
that parking attandart to the use of the Tally Ho and Supper Club shall
be permitted until the expiration of their permitted non -conforming sta-
tus in 1976.
7. Prior to any additional construction, a detailed site plan shall be
submitted showing all new construction, all existing construction,
including drives and parking areas, all existing and new landscaping.
The plan shall be prepared by 'licensed professional designers and shall
be satisfactory to the Environmental Planning Commission. The plan
shall be substantially in conformance with the plot plan submitted with
the. conditional Use Perrit Application.
8.
The picnic grounds parcel (351-03-001) shall be included as a part of

Use Permit because it is intended to srrnply parking necessary for
the Pacific Coast International-Tannis "tournament.. The plot plan will
show the area to be used for parking.
9.
Peon -conforming uses, i.e. Tally 11o, Supper Club and Picnic Grounds,
shall be phased out in 'l976 unless such uses are at that time permitted
by the zoning ordinance.
10.
Compliance with recommendations of the Health Officer and Fire Chief as
required by the City 11anager.

Trail and path easements and ir::provements recommended by the Patho-rays
Committee and deemed appropriate by the Town Council.
12.
The conditional Use Permit shall not be effective until the Racquet Club
has furnished evidence to the Town that it has been legally established
as a non-profit corporation.
13.
The site plan sSrall desiinate the hillside area ( area �enlsra'iy'above
the elevation of 500 feet) as open space with no grading or structures
other than are approved on the Use permit c:- a part of an approved
trail and path system and are of a minor nature. Any uses shall be
subject to the apo:^oval of the City "tanager.
14.
The conditional Use Permit shall not become effoctiur_ until an EIR has
bear, approved by the Planning Coa,mission and the CW,71issien finds the
impact acceptable.

15. The conditional Use Permit shall be subject to annual review for

compliance wits, conditions of the permit and for modification of
conditions of the Use Permit to insure continued compatibility of
the Racquet Club with surrounding areas and the Town. The life of
the permit shall run for 25 years subject to renewal at that tieie,
.. until the loss of non-profit status of the club.
16. Traffic control on floody toad in the vicinity of the club and at
its entrances shall be furnished as necessary to insure safety,
expeditious traffic movement and no delay to emergency vehicles.
All reasonable means of moving traffic rapidly off Ploody Road
- shall be used. Traffic control shall meet the approval of the
Chief of Police.
17. Use of the picnic grounds shall be linited to 2,000 persons at any
one time until phased out pursuant to condition 9.
18. The maximum number of persons on the entire property, (351-03-001
351-03-002 and 182-24-004) shall be 6,000 and may occur only during
the P.C.I.T.T. at all other times the maximum number shall be
4,000 until after 1976 when the maximum shall be 3,000.
-19. The Pro -Shop shall sell to club members, guests and tournament
participants only.
20. The above recommendations shall meet all legal requirerents as
determined by the City Attorney.
Chairman AcRaynolds questioned whelhar the operation a` z. pro shop
would be a non -conforming use in Los Altos Hills.
Mr. Lawson felt that the Tom could rely on the standards set by the
Federal and State governments with regard to a non-profit status. He
pointed out that if the tennis Club at any time lost its status as a
non-profit corporation, the Use Permit would automatically become void.
Fir. Mader pointed out that at the time of review, more conditions could
be imposed with regard to the Use Permit.
The Commission decided that fir. Lawson should check to see if a
business license would be required for the operation of the pro shop
and, if so, the Town would have to anend the Use Permit of the Fremont
Hills Country Club as well as require the Los Altos Hills Racquet Club
to obtain one.
The Commission expressed concern over the areas to be covered in the
ESR study to be prepared. They felt that the Hydrologic description,
irract rF revfsions, noise and traffic problems, intensity of use,
additional services and the areas of concern as expressed in the letters
transmitted by the neighbors, are all areas that should be covered in
the EIR study.

Mr. Hader informed the Commission that the process of the EI^ study could
be handled in nne of two wcvs. The Commission could have the Tom prepare
%W the study and charge 'sir. Delluccri, or the could request Hr. Bellucci to
have the study prepared and the Commission could review it. Mr. 1lader
Pointed out that the Staff was recoFiTending that t1r. Bellucci be responsible
for the prpp:aration of the study.
I101`I0iJ, SECONDED A?!D CARRIED: Commissioner 41eisbart moved,, seconded by
Commissioner Perkins and carried with a majority vote with Commissioners
Lachenbruch and Spencer voting no, that the Use Permit for hir. David Bellucci
be accepted with the 20 conditions as set forth in the revised staff
memorandum and contingent upon the approval of the EIR study.
Mr. Lawson informed itr. Bellucci of the appeal process open to him.
2. Request for Rel- 2f of Cne Condition Imposed at the Time of Building Site
Approval Granted on July 6, 1971 to Powell and Lee (,Mrs. Laurence
Valente, current property owner)
.he City Engineer informed the Commission that in June of 1971, the City
Council granted Building Site .Aporoval for Lot 24, Tract 2953, on Olive
rea Court ( a private road). I',mong the several conditions imposed for
.approval were two conditions relative to drainage. The first was "In -
tract and off -tract drainage as required by Toon Engineer." The second
condition was "Drainage from driveway to be disposed of to the existing
swale at a point where the driveway meets the road. All surface water
from the common combined driveway is to be intercepted and conducted into
the existing swale,"
H=_ further stated that recently, the property was sold and the nese
property owners, Mr. and Firs. Valenti, are concerned about condition
number one. The City Engineer feels that two (2) catch basins and
approxinately 6o feet of 15" RCP drainage pipe should be installed on the
private road to take the water from the road and divert it down the s�.:+ale
along; the property. This will substantially reduce the amount of runaff
Iron the property, which, in past years, has caused substantial dzmaai
to the residence opposite the cul-de-sac on Olive Tree Court ( a oubiic
road). He pointed out that in essence, because this is the only lot re-
maining to be built upon, and because of the condition imposed at tietime of Building Site Approval, it was the City Hanager's and his feeling
that these drainage improvements should be required.
After review and discussion by the Commission, they were in agreera.nt that
off -tract drainage meant only that drainage required to handle mater
directly passing through or emanating from the property. If that be the
case, tie will 'roily require one catch basin and approximately 30 feet of
15" RCP dre,inc;, pipe ani! instruct the City manager to fen;+m-d this
matter to the City Council with that recom-mendation.
