HomeMy WebLinkAbout07/25/1973EMIRONNUITAL PLAHHING C-91MISSIOH Town of Los Altos Hills 26379 Fremont Road Minutes of a Reqular fleeting July 25, 1973 Preceded by a Study Session Study Session Reel 19, Tract 1, Side 1 000 -End The Study Session of the Environmental Planning Commission of the Town of Los Altos Hills met at 7:45 p.m., with Chairman McReynolds presiding. Chairman McReynolds requested that two items be added to the study session agenda: 1. Review of I°iiscellaneous Planning Items. 2. The Town Engineer's Proposed Capital Improvement Program. A. ITEMS FOR DISCUSSIN: 1. Review of Staff Procedures for Processing Haterials to the Environ- mental Planning Commission. AW George !fader stated that the material to be presented on this item was incomplete. He pointed out that their office had devoted time to com- pleting the Proposed Subdivision Checklist and felt that it was very crucial that this information be reviewed with the Commission at this time, so that it could be put into use as soon as possible. The Commission concurred and continued the general review of staff pro- cedures to the next study session. 2. Review of the Pronosed Subdivision Checklist. George Mader stated that the Proposed Subdivision Checklist was more extensive than the old checklist used. The Proposed checklist references all design and improvement items in the revised Subdivision Ordinance. The list is meant to be used for review and imposing conditions of approval by the Environmental Planning Commission and the Board of Planning Administration. Mr. Mader said that it was intended that a modified version of the check list; indicating staff responsibilities for review of the various items, be prepared and used by staff in the subdivision review process. From this modified checklist the Environmental Planning Commission Checklist would be prepared by staff. 4W -2 - Mr. Mader reviewed the proposed list with the Environmental Planning Commission. He noted that room was left on the last two pages for con- tinuation of additional conditions. Commissioner Mueller said that he had reviewed the list and felt it looked very good. He further felt that we should use the list for awhile and the Commission could see how it worked out. George Mader stated that this would also be used for Conditional Use Permits. Commissioner Young noted an error in the spelling of°retention" on page 3 of the proposed checklist and requested that the error be corrected. After discussion, the Commission was in agreement that the list was acceptable as proposed. George ?fader informed the Commission that the list would be completed by the staff prior to the time the Environmental Planning Commission re- ceived it, but they could make changes at the time of the meeting. He further stated that the checklist would accompany a normal staff memorandum and would be crossreferenced to the memo. The Commission decided to use the checklist and to make it official. The Commission decided to make a motion later in the regular session formally adopting the checklist. 3. Miscellaneous Planning Items. George Mader reviewed the following items in progress, proposed to be completed during the current fiscal year. 1. Review of Staff Procedures for Processing Materials to the Envir- 2. Road Standards -- Estimated date of Completion, August 22, 1973. George Mader stated that certain revisions to the Town Road Standards had been prepared by Mr. Jerry Crabtree during his em- ployment with the Town. Mr. Mader felt that these revisions should be reviewed by the Town Engineer to ensure they are complete and so that additions or corrections, if necessary, could be made. The revision then could be presented to the Commission for their review and consideration. Mr. Russell, the City Engineer, stated that with his current work- load situation, he felt that his review could be completed by the secgn-1 meeting in August. The Environmental Planning Commission scheduled review of the,revisions,fdr the August 22, meeting. 3. - 3 - Mr. Mader stated that a clear delineation of duties to be performed by the Environmental Planning Commission and Board of Planning Administration should be made to be carried into the current Sub- division and Site Development Ordinance. There was general agree- ment among Commissioners that they would like to review this item as soon as possible and schedule the review for the August 8, study session. 4. Environmental. Impact Report rroceaures -- George Mader told the Commission that all members of staff had re- ceived copies of the packet for Environmental Impact Review proce- dures and that the staff was in agreement that the packet was good enough to be used as prepared. Mr. 'fader pointed out to the Commission that because of State Law, the Town would be forced to put the Environmental Impact Report procedures into use immediately but he would like to set aside some time in one of the study session for the Commission's review and comment. Mr. Mader further pointed out that he believed that it was important that the Commissioners 4 be aware of State Law and the procedures because staff is requestinc that they make Environmental Impact decisions. 5. General Plan Revision Program -- Estimated Date of Completion, uqust 8. 1973. George Mader informed the Commission that now that the budget has been adopted by the Council, he would be able to go into the General Plan Program and set up the proposed timetables. George Mader pointed out that $2,300 had been cut from the Planning Commission budget with the intention that this be deleted from the money budgeted for General Plan Revision, and that we would have to decide exactly how it would affect the General Plan Program. Chairman McReynolds felt that the loss of money in their budget could create problems since the General Pian portion of the budget was very important to the Town and citizens. Mr. Mader told Chairman McReynolds that he would evaluate the change that the cut would make in the proposed work to be done on the General Plan Revision. Mr. Mader reviewed the budget with the Commission and pointed out that the Commission had been given a special allocation for the Geologic Hazard Study Program and with th addition of these monies, the Commission had more money than the kme previous year. -4 - Commissioner Perkins pointed out that the Commission worked very hard and felt that the budget request was reasonable in terms of work that had to be done. He noted that the Planning Commission had not asked for an increased budget but prcposed that the same monies be allocated in the 1973-74 fiscal year as were budgeted in the 1972-73 fiscal year. He further noted that the Geologic Study was a special program and that after you eliminate that money, the budget approved, with the $2,300 reduction, less than the actual budget of last fiscal year. Speaking from the floor, Mr. Lawson, City Manager, stated that it w: his recommendation that the budget be cut in this area. He felt the the General Plan could still be accomplished without the additional money. Chairman McReynolds felt that the Environmental Planning Commission should have been advised before the recommendation was made to the Council to cut the budget. He further requested that the Commissici receive an accounting, at least on a quarterly basis, of where they stand with the expenditures on their budget. He felt that in way the Environmental Planning Commission could keep better track of the Planning program and could determine if or when additional funds would have to be requested from Council. Mr. Lawson stated that the Planning Commission could request the City Council to reallocate the funds at any time. Mr. Lawson firth: stated that if at a later date we run out of money, he will go be- fore the City Council and ask for the additional funds. He went on to mention that during the past fiscal year the Planning Commission overspent their budget by $5,000 and that the City ;ill came up with the money to cover the expenditure and can do so again. Chairman McReynolds reviewed the history of the General Plan and stated the importance of compieteng the General Plan Revision as soon as possible. He further felt that this was too important to let pass. Commissioner Perkins felt that by going along with the reduction in the budget that the Commission was actually saying that they were wrong in their budget estimates. He felt that the chances for getting the money at a later date could present problems. He thought that the Commission should ask for the money now and if, at the end of the fiscal year, there was money left over, we could re- turn it to the City. Commissioner Phillips felt that it would be. best to have any reserv, money in the general budget rather than in the departmental budgets. He further felt we should wait for the Town Planners revised budget based on the $2,300 reduction, to see actually how it effect ` `r the Environmental Planning Commission and the progress it will make in the upcoming year. -5- 4. Geologic Hazard Study Program. George Mader stated that he has been unable to obtain figures on the probabl,. costs of an outside firm doing the geologic study program. He was able to reach the Professional Geologist who was a friend visiting in the area, but worked out of an office in Los Angeles. Mr. Mader said that this geologist expressed an interest in this study, however after reviewing the job in- volvements, felt that he could not do it for the money set aside and informe Mr. Mader he thought the Town was getting a good deal for their money with the preliminary proposal before the Town from Professor William Dicksnson involving graduate student Kerry Sieh. Mr. Mader said that Mr. Sieh was now in Alaska working on the pipeline project but was in the process of setting up his schedule for next year. He said that we must make a decision as soon a possible so that Mr. Sieh could make plans for the coming school year. The Commission was in agreement that they should recommend to the Council tc go ahead with the study and hire the student. 5. Review of the Town Engineer's Proposed Capital Improvement Program. Chairman McReynolds continued the item to the study session of August 8, as the alloted time had run out. End of Study Session Return to Regular Meeting Lr Chairman McReynolds called the regular meeting of the Environmental Planning Commission of the Town of Los Altos Hills to order at 8:45 p.m. in the Council Chambers of the Town Hall, 26379 Fremont Road, Los Altos Hills, California. A. ROLL CALL: Present: Commissioners Mueller, Perkins, Young, Neisbart and Chairman McReynolds. Absent: Commissioners Lachenbruch and Magruder. B. APPROVAL OF MINUTES: June 25, 1973 MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, Seconded by Commissioner Mueller and carried with a majority vote with Commissioners Weisbart and McReynolds abstaining that the minutes of the meeting of June 27, 1973 be approved. C. CONTINUING BUSINESS: 1. PUBLIC HEARING ON THE LANDS OF BROEKHOFF: File No. 401-73 Mr. Broekhoff, . Owner/Developer. Mr. John Riley, Engineer. Commissioner Young informed the Commission that he would abstain from any action on this request as he was a neighbor of the applicant. He wished `, to comment as a citizen rather tnan in his capacity as Planning Commiss+oner -6- 06 George "fader reviewed the Progress made since the June 27, meeting of the Planning Commission including review of a meeting held July 5, to resolve problems which arose at the Environmental Planning Commission meeting. Based on this for their urork,staff recommends approval of the subdivision with the following conditions: 1. Dedicate an easement for path purposes within the 20 ft. strip on the north side of the property between the Koblick right-of-way and the Lands of Chamberlain. 2. At the discretion of the Town, construct or pay in lie ufor one-half of an 8 ft. wide bike path in front of Parcel A. ( If in lieu funds are collected and the Town elects not to install the bike path, the funds may be used to widen the road to accommodate bicycles). 3. If a repaving rather than a rebuilding of Manuella Road is deemed atter able by the Town Engineer, the subdivider shall be responsible for constructing or paying in lieu (at the Town's discretion) for one-half of an 8 ft. wide bike path in front of Parcel B. ( If in lieu funds are collected and the Town elects not to install the bike oath, the funds may be used to widen the road to accommodate bicycles.) I 4. Dedicate an easement for path purposes on Parcel B at the bend in Manueila if necessary to provide space for the bike path in a safe location above the road. S. Bring one-half the width of Pianuella in front of Parcel A un to Town standards through rebuilding or reconstruction. 1 6. Improve drainage along 'Ionuella in front of Parcels A and 8 to the satisfaction of the Torm Engineer. This shall include at least im- proving the catch basin opposite Estacada and grading for drainage aloe; the entire frontage of the subdivision. 7. Place four Los Altos Hills standard monument boxes, complete with cover. at locations designated by the Town Engineer. S. Connect the proposed new residence on Parcel A to the sanitary sewer. 9. Obtain water for domestic purposes from the California !Rater Service Company. 10. Abandon and fill the existing well on Parcel A or render so as to meet State and Town health requirements. 11. Dedicate a 30 ft. strip for Hanuella Road right-of-way. V -7- `, Chairman McReynolds opened the Public Hearing. Speaking from the floor, Bob Stutz stated that the Pathway Committee recom- mended that a native trail, (ten foot easement) be placed on Manuella to run the extent of both parcels A and B and abandon the bike path concept. Mr. Stutz stated that the Pathways Committee felt that Fremont was a more crucial area than Manuella and therefore, they withdrew their recommendation of the last meeting. He felt that a path on Manuella was important but since the Pathways Committe had to ask for so much money for capital improvements, they felt they must concentrate on Fremont rather than Manuella because Fremont has a great deal more traffic. Commissioner Young expressed concern, as a resident of the area, over the cutting of the curves on the west side of Manuella since they were created for control of overflow waters. George Mader stated that the curves would be redesigned but would actually remain. He felt that the Town Engineer could review that problem. MOTION SECONDED AND CARRIED: Commissioner Weisbart moved, seconded by Commissioner Perkins and carried with a majority vote, with Commissioner Young abstaining, that the subdivision of the Lands of Broekhoff be approved with the conditions recommended by Staff. 4W MOTION SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Commissioner Heisbart and carried with a majority vote, with Commissioner You abstaining, that the subdivision of the Lands of Broekhoff will have no significant effect on the environment and that a negative declaration be filed with the County of Santa Clara. 0.. NEN BUSINESS: 1. PUBLIC HEARING ON THE PROPERTY OF C. L. ROCKHELL: File No. 398.73 Thomas Barton, Developer. Paul Nowack, Engineer. Tom Vlasic illustrated the request for the Property of C. L. Rockwell. Mr. Vlasic informed the Commission that staff was recommending approval of the subdivision with the following conditions: 1. Parcel "A" shall be dedicated to the Town for park and recreational purposes as required by Section 9-4.805 of the subdivision ordinance. 2. Direct access rights from Parcels 2 and 3 on to Fremont Road shall be dedicated to the Town. 3. Barton Court shall be dedicated to the Toem. 4. Off -tract drainaue at the eastern corner of t"e subdivision along Fremont Road shall be improved to thn satisfaction of the Town Engineer. The improvement of off -tract drainage shall he done in con unction with path improvement. 7. Along the western half of Fremont Road the existing A.C. Pavement sha be improved to Town standards to the satisfaction of the Town Engine - 3. Storm Drainage Assessment Fees per Section q-4.905 of the subdivision ordinance. 9. Stake and string the proposed property lines. 10. Locate the existing sewage disposal system for the guest house. No portion of thexisting system may be located within 10 feet of a property line. ( To be completed prior to filing of final man or as Part of the subdivision agreement). 11. Install a new sewage disposal system for the residence on Parcel Z. This system must comply with Town of Los Altos dills r!nnicipal Code Title 6, Chapter 4. This system will require non feet of drainfieid plus area for 100 expansion and a 15,0 -gallon septic tank. ( to he completed prior to filing of final mao or as part of the subdivision agreenent). 12. Pump and fill any existing septic tang or cesspools that are aban- doned. ( To be completed prior to filing of final nap or as part of the subdivision agreement). 13. Obtain septic tank permit prior to construction. 14. An on-site inspection by the Health Deoartnent is required for wit- nessing of the existing sewage disposal systems location; pumping ane. filling of any existing septic tanks or casspcols; and installation of the net, septic tan! and drainfield. 15. Prior to filing of final map soli percolation tests shall he require to determine adequacy of Parcel 1 and Parcel 3 for dgvelonrent as required by Town of Los Altos Hills :Municipal Code Title 6, Chapter ' 16. Obiain water for don=stic purposes from the California "a ter Service Company. 17. Prior to any zxcavation on property contact the Health D=epartment re- garding placement of fill.. 4 Commissioner Perkins felt that planting would soften the proposed road :.d to it should be considered. George Mader pointed out that this could be taken care of at the time of Site Development but the Planning Commission could require planting at any area where grading does take place. °peaking from the floor, Mr. Nowack, felt that the change in the driveway position would be enough to cover the problem and that the road could not be seen from Fremont Road. Commissioner dueller, representing the maps Committee, agreed with the staff report. MOTION, SECONDED AND CARRIED: Commissioner Heisbart moved, seconded by Commissioner Mueller and unanimously carried that the commission review the checklist attached to the staff memo. Tom Vlasic reviewed the checklist with the commission and the following changes were made. Item 1 Landscaping: "Subject to review by the Environmental Design Commi Item 5> Traffic S1 ns: "Stop signs to be installed at the intersection of carton our an remont Road and street name signs installed at the intersections of Barton Court and Fremont Road. [ Speaking from the floor, Mr. Thomas Barton, informed the Commission that he was the new owner of the property. He stated that the road the Commission w concerned with could not be seen from Fremont Road. He pointed out that WE item has been held up for some time in staff areas and they wanted to procee as soon as possible and that the requirement to have Vie Environmental Desig Committee review the area would again hold it up. The Commission informed Hr. Barton that this would not hold up the approval of the subdivision. Speaking from the floor, Conncilwoman Miller, stated that the Environmental Design Committee would not be meeting for approximately one month since they have not filled the vacancies. MOTION, SECONDED AND CARRIED: Commissioner Heisbart moved, seconded by commissioner Perkins and unanimously carried that the checklist of the subdivision of the Property of C. L. Rockwell be approved with the changes made on items 1 and 5. MOTION, SECONDED AND CARRIED: Commissioner Perkins moved, seconded by HIsbart and unanimously carried that the Property of C. L. Rockwell will have no significant effect on the environment and that a ^legative Declaratio be filed with the County of Santa Clara. -10- 2. PUBLIC HEARING ON THE LAND OF ALAM KINKEAD: File Ho. 400-73 fir. Alan Kinkead, Ovmer/Developer. George S. Nolte, Engineer. Mr. Hader informed the Commission that at the time the July 6 memo had been Prepared for this subdivision proposal,staff was under the impression that Mr. Kinkead agreed with all the staff recommendations, however they found out that he was in disagreement with certain conditions imposed. Mr. Hader state that on July 24, a staff meeting was held to resolve the disagreement and a supplementary memo was prepared based on the outcome of that meeting. The supplementary memo which was distributed immediately prior to the Environmenta Planning Commission meeting indicates general changes to conditions imposed by the July 6, memo. Mr. Mader reviewed the changes made by the July 25, memo with the Commission pointing out the items changed from the original staff recommendations. Hr. Stutz, speaking from the floor, stated that the Pathways Committee has not had time to review the changes or request. He felt that the Pathways Committee need not meet on this item again and felt that Mr. Kinkead was quite adamant about encroachment on his property. fir. Kinkead, speaking from the floor, stated that he did not want to dedicate .the recommended pathways at this time but he would dedicate a path easement along Elena. He further requested that the Planning Commission make some acts, during the evening. Commissioner Weisbart felt that since the Environmental Planning Commission on" received the supplementary memo just prior to the meeting that a continuance was in order at this time. icsi-:, -.:�-.ueller a•.! Commissioner Perkins felt that since vie cancelled a meeting earlier this month. the Planning Commission should hold a special meeting to pick up the backlog that was created frim the cancellation and ;ecided the Kinkead matter could be covered at a special meeting. Mr. Kinkead, from the floor, said he would agree to continuance to a special meeting. MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Commissioner Weisbart and unanimously carried with the concurrence of Mr. Kink( that the Lands of Kinkead be continued to the special meeting to be held on August 2, 1973, at 7:45 p.m.. 3. "^ -1^ Tom Vlasic explained staff position that draft Environmental Impact Report should be prepared for the proposed Davin Ridge Estates Subdivision. Listed below are three areas that staff feels should be given particular attention in preparation of the Environmental Impact Report: \r' 1. George Mader stated that it was staffs position the proposed tentative subdivision map of Corbetta, received at Town Hall 6/20/73, should be accepted for filing with a contingency that a letter be submitted by Dr. Rose, the applicants geologist, as to the suitability of lots number 1 and number 3 as adequate building sites, particularly indicating the effect [ of the proposed development on the lower dam structure. 2. The foundation bearing capabilities of lots 1,2 and 3 and the eczl? of f,,-.1that :-:es 'i n nlac-d on "':se lots ( a soils Trd geologic analysis should address the suitability of all four lots in regard to adequate building sites). 3. The improvement of the storm drainage channel to minimize impact on proposed residences from flooding and other drainage problems. (This has to be coordinated with the Santa Clara Co. Flood Control District). In discussion following the staff presentation chairman McReynolds stated that the Commission should consider the impact of noise for future buyers Commissioner Perkins stated that due to the underground springs on the site and the possibility of slippage should also be considered in the Environ- mental Impact Report. Commissioner Perkins said that the ability of the property to hold the houses would not affect other properties but because of the large devel- opment the creeks run-off of waters could create some problems. He felt that the Environmental Impact Report has not directly related to the existing housing but the Commission should question whether the area is safe for development. George Mader pointed out, according to State Law there are two findings. The first being Environmental effects of a project which will cause sub- stantial effects on human beings either directly or indirectly. The second being that all applications must be looked at in terms or the effect of the development on the quality of that environment within the developmen not just the effect on the surrounding area. C. REQUEST FOR RCCEPTAXE OF FILINr,: Lands of Spector. File No. 403-73. Tom Vlasic stated that staff felt the information on the proposed subdivi- sion presently on file was sufficient for staff to recommend Commission acceptance of the proposed subdivision map received at Town Hall 6/20/73, MOTION SECONDED ANO CARRIED: Commissioner Mueller moved, seconded by Commissioner Young and unanimously carried that the proposed tentative subdivision map of the Lands of Spector (received at Town Hall 6/3n/73) be accepted for filing. 7. PUBLIC HEA.RL.^,G nl' THE CONDIT10"AL USE PERMIT FOR RURAL RETREAT: File '!umber 388-73. Richard L. Smith, Applicant. Tom Vlasic presented staff evaluation of the Conditional Use Permit appli- cation to the Commission. ( See staff memo dated 7/18/73) He stated that the applicant is requesting to use the same facilities previously known as Berry Hill Farm. The existing facilities are to be upgraded, however no new buildings or new use areas are proposed or requested. lie further stated that staff recommends Commissions approval with the following conditions being imposed: 1. The buildings and facilities shall be limited to those shown on the site plan prepared by Randiett ...Clegg ... Foulk dated flay 1973. Specifically, the number and size of buildings shall be limited as follows: A. Stable 156'x 72' B. Covered Ring 160' x 80' C. Hay Barn 30' x 55' 2. No structures which relate to the boarding of horses that are not shown on the plot plan referred to in Item fio. 1 shall be erected without an amendment to this Use Permit. 3. The Use Permit is to cover 17.nO acres. 4. Drainage at the intersection of the entrance driveway and Page Milt Road shall be improved to Town standards and th the satis- faction of the Town Engineer within ?linety (90) days after approval of this Use Permit unless precluded by state ownership of subject area. 5. All driveways and parking areas used by guests shall be paved sufficient to control dust and be satisfactory to the Town Engineer. The cars of all guests and visitors shall at all times be parked on the property. -13- `� 6. Any condition of the Santa Clara County Health Department and/or. the Los Altos Fire Department issued pursuant to duly vested legal authority shall be met. All facilities shall be maintained so as to control dust, flies, odor, fire hazard or any other poten- tial nuisance to surrounding properties. The level of maintenance in regard to these items shall be satisfactory to the Fire Depart- ment and County Health Officer. 7. A 10' !improved path easement shalt be dedicated from Page 'sill Road southeast and east along the southern property line to its eastern limit, and north from that point along the eastern pro- perty line to Arastradero Road. 8. A full landscaping plan shall beprepared and submitted to the Town for approval within six (6) months of the approval of this Use Permit. The site shall be improved in accord with the land- scaping plan within four (4) months of the plan's approval by the Environmental Planning Commission after receiving recommendations from the Environmental Design Committee. 4. Only trailers and/or trucks used by the owners and operators of Rural Retreat shall be allowed to be parked on the premises. The, shall be reasonably screened from view. The parking of all other [ � trucks, trailers, etc., shall be limited to a twenty-four (24) 4I, hour period. 10. The total maximum number of horses or other hoofed animals shall not exceed fifty (50). 11. The total number of stalls shall not exceed forty (40). 12. There shall be no outdoor lights, except those required for safe- ty, and they shall be adequately shielded to prevent any nuisance to adjoining property owners and be satisfactory to the Environ- mental Design Committee. 13. There shall be no public address system. 14. There shall be at least one (1) competent person on the premises at all times, who is experienced in horse care and capable of caring for said premises. 15. Public riding instruction shall not be given, but this shall not be deemed to prohibit giving of instruction to the owners of horses boarded on the premises and to members of their immediate families. 16. This Use Permit shall be issued in the name of Rural Retreat, LTD. and the life of this permit shall run with the life of this ownership of the property of until it is amended or cancelled. 14 17. This Use Permit shall be reviewed annually at the time of Business License renewal to assure compliance with the above conditions, and all conditions shall be subject to amendment and/or additional conditions deemed necessary by the City Council and to assure compliance with Title 6, Chapter 1., Article 2. and Title 7, Chapter 5. of the Los Attes Hills Muni- cipal Code. This review shall be conducted at a duly noticed Public Hearing. After discussion by the Commission conditions number 9 was changed to read as follows: 9. George Mader indicated that numerous letters of support for Rural Retreat have been received at Town Hall. Among the letters was one from Page Mill Park Incorporated owners of the closet parcel (This parcel borders along two sides of the Rural Retreat parcel. The letter indicated no objections to the Conditional Use Permit. Mr. Kenneth Madsen, the applicants attorney spoke from the floor. He presented the fact that Rural Retreat would be holding some horse shows and he would like some indication in the conditions that horse shows of a limited nature would be permitted. In addition, he requested that the limited use of a public address system during horse shows be allowed. After much discussion the Environmental Planning Commission recommended cin folioriir. (18th) condition be added to the list of conditions of approval: 18. Horse shows shall be limited to four per year. However, addi- tional horse shows may be allowed upon the granting of a permit by the Environmental Planning Commission. Also, that condition number 13 be changed to read: 13. There shall be no public address system except during horse shows, limited to the hours of 10:00 a.m. to 4:00 p.m, unless an exception for hours of use is granted by the Environmental Planning Commission. Mr. Madsen stated that this addition and change satisfied his request. MOTISM, SECOMDED AND CARRIED: Commissioner Weisbart moved, seconded by Commissioner Perkins and unanimously carried that a Conditional Use Permit should be issued with the above stated conditions of approval. - 15 - MOTION, SECONDED AND CARRIED: Commissioner lueller moved, seconded by McReynolds and unanimously carried that Rural Retreat is categorically exempt from the requirement of the California Environmental Oualit,y Act and that an Exemption Determination form should be completed for the project. The letter was misdated,however,it referenced, according to George Mader, current activities on the Pappas Subdivision and therefore appeared to be current. The Planning Commission asked that the date be confirmed in writing. MOTION, SECONDED AND CARRIED: Commissioner Mueller moved, seconded by Commissioner Perkins and carried with a majority vote with Commissioner Young abstaining that the Public Hearing on the Lands of J. N. Pappas be continued to the August B, 1973 Environmental Planning Commission meeting. 9.
